By awarding government contracts to corporations as compensation for lavish gifts and personal favors, the United States government fails to serve the public interest effectively and honestly. William Sims Curry identifies and categorizes multiple deficiencies in how government contractors are selected, and proposes how reforms can be instituted. This book is based on extensive research. Curry sifted through two years worth of contractor claims maintained by the Government Accountability Office (GAO) regarding improper behavior of federal government agencies during the contract award process. He identified additional government contracting failures through review of media stories, inspector general reports, court cases, and press releases by government investigatory agencies. Much of this abuse originates from the mandated but ineffective practice of color coding rating proposals and a subjective ratings system. Curry proposes replacing the current practice with a scoring system that weighs contractor selection criteria according to the government’s needs. This, along with the other procurement reforms Curry recommends, offers promise for an alternative to the fraud, waste, and incompetence currently rampant in government contracting.

Book excerpt: Since the beginning of the Global War on Terror in 2001 the amount of money lost annually to government procurement fraud is in the billions. Investigators are receiving an overwhelming number of these investigations which take years to move through the legal system. Investigations of this nature demand a complex set of skills and in-depth knowledge of the government procurement system. Investigators are often expected to understand and handle these investigations without having the requisite training. Without employer sponsored training, investigators are forced to either search for training on their own which can be costly and time consuming, or review a myriad of intricately detailed books with such complicated and foreign terms that it can be frustrating to find the beginning. Inexperienced investigators must then either rely on senior investigators, who often are already are working a heavy caseload, or simply attempt to handle these non-traditional investigations without the proper knowledge base. Investigators must understand that whichever route they choose their methods, calculations, interpretations of contract clauses, and resulting criminal/civil charges will be scrutinized by groups of specialists with years of experience in government contracting. This project creates a self-explanatory manual on contract fraud investigations that enables an investigator to maneuver through a procurement/substitution fraud investigation including the civil, criminal, and/or administrative remedies. This manual serves as a readily available, affordable, and sufficiently detailed, investigator focused manual until they can attend specialized training. The manual also serves as a useful comprehensive reference after investigators have completed training.

Fraud occurs in the award of contracts, in the technical aspect of performance, and in the submission of false claims. Dishonest contractors, a small minority, must be found out and brought to justice. The response of the Government is channeled along several lines. Fraud is both a civil and a criminal matter. The Government may sue for financial recompense and may also invoke criminal penalties, and may debar bidders. The Contracting Officer and eventually the whole contracting team may be needed to detect fraud. The using activity, the Office of Special Investigation, the FBI and ultimately the Justice Department attorney and Federal Court are involved. (Author).
