Yet in Democratic Anarchy, Matthew Scully asks, how can “the people” be represented in a way that acknowledges what remains unrepresentable? What would it mean to face up to the constitutive exclusions that haunt U.S. democracy and its anxious fantasies of equality? Democratic Anarchy develops a rigorous theory of equality that refuses to repeat the inequalities against which it positions itself, and it does so by turning to moments of resistance—both aesthetic and political—inaugurated by the equality that inheres in and antagonizes the order of things.

Book excerpt: Shaolin Brew: Race, Comics, and the Evolution of the Superhero looks at how the comic book industry developed from a white perspective and how minority characters were and are viewed through a stereotypical white gaze. Further, the book explores how voices of color have launched a shift in the industry, taking nonwhite characters who were originally viewed through a white lens and situating them outside the framework of whiteness. The financial success of Blaxploitation and Kung Fu films in the early 1970s led to major comics publishers creating, for the first time, Black and Asian superhero characters who headlined their own comics. The introduction of Black and Asian main characters, who previously only served as guest stars or sidekicks, launched a new kind of engagement between comics companies and minority characters and readers. However, scripted as they were by white writers, these characters were mired in stereotypes. Author Troy D. Smith focuses on Asian, Black, and Latinx representation in the comic industry and how it has evolved over the years. Smith explores topics that include Orientalism, whitewashing, Black respectability politics, the model minority myth, and political controversies facing fandoms. In particular, Smith examines how fans take the superheroes they grew up with—such as Luke Cage, Black Lightning, and Shang Chi—and turn them into the characters they wished they had as children. Shaolin Brew delves into the efforts of fans of color who urged creators to make these characters more realistic. This refining process increased as more writers and artists of color broke into the industry, bringing their own perspectives to the characters. As many of these characters transitioned from page to screen, a new generation of writers, artists, and readers have cooperated to evolve one-dimensional stereotypes into multifaceted, dynamic heroes.

It proposes reflexive regulation as an alternative approach. This book provides strategies for a reflexive regulation approach to cryptocurrencies, developed through the identification of the internal self-regulatory mechanisms of the cryptocurrency system. Apportioning blame for current problems to the regulators’ failure to take into account the inherent technical features of cryptocurrencies, the work promotes reflexive regulation in which the law acts at a subsystem-specific level to install, correct, and redefine democratic self-regulatory mechanisms. It provides strategies for this approach, developed through the identification of the internal self-regulatory mechanisms of the cryptocurrency system. These are identified as imbedded in the technical functionality of computer code and consensus-based distributive governance mechanisms respectively. In addition to providing a technical, historical and legal overview of cryptocurrencies, the book concludes by providing recommendations aimed at redirecting code and consensus towards achieving regulatory goals. In this way, it draws from the theory of reflexive law, in order to provide both a substantive and jurisprudential perspective on the regulation of cryptocurrencies and to illustrate how Financial Technology (Fintech) regulation can only be effective once regulators consider both the ‘Fin’ and the ‘tech’ in their regulatory approaches. The optimal mix of market forces and government intervention to allocate resources is one of the longest-standing problems facing human civilization. At the theoretical extremes, resources in centrally planned economies are allocated by the government, while resources in capitalist economies are allocated by private markets. In practice, market forces and government interventions co-exist to allocate goods and services in a political environment with shifting pressures to give one approach more responsibility than the other. Current public attitudes toward markets are at a low point in the wake of the Great Recession and the growth in income inequality that began in the 1970s. However, in this book, noted Brookings economist Clifford Winston argues that it is a serious mistake to overlook that markets will be a critical part of the solution to any public objective—whether it be to reduce inequality, stimulate long-term growth, slow climate change, or eliminate COVID 19. In Winston's view, policymakers should be much more aware of the many ways that markets help government to achieve economic and social goals and the potential that markets have to provide greater assistance in achieving those goals. Winston synthesizes the empirical evidence on the efficacy of markets in helping to protect consumers against anti-competitive behavior and when technology appears to prevent price competition; to enable individuals to make more informed decisions; and to reduce negative externalities, improve public production, and encourage innovations. Importantly, Winston presents evidence indicating how markets can also help to reduce poverty, promote fairness in labor markets, and provide merit goods. Winston subjects his assessment to a robustness test by explaining how market forces have helped to address the COVID-19 pandemic by, for example, finding new ways for people to work safely and providing incentives for pharmaceutical companies to develop safe and effective vaccines. Winston takes a proactive approach in his conclusion by suggesting the formation of a major “Commission” composed of academics, policymakers, and businesspeople. Such a panel could explore how market forces could provide greater help to government to address economic and social problems and could provide specific recommendations to facilitate market solutions where appropriate.
