Throughout the ages, restraint in warfare has been informed by religious and ethical considerations, chivalry and class, and, increasingly since the mid-19th century, a body of customary and treaty law variously referred to as the laws of war, the law of armed conflict (LOAC) or international humanitarian law (IHL). As they evolved from the mid-19th century, these laws were increasingly underpinned by humanitarianism, then in the mid-20th century, were assumed to be universal. But violations of these restraints are also as old as conflict itself. The history of conflict is replete with examples of exclusions from protections designed to moderate warfare. This edited volume explores the degree to which protections in modern warfare might be informed by notions of 'civility' and 'barbarism', or, to put it another way, asks if only those deemed to be civilised are afforded protections prescribed by the laws of war?

Und dadurch Krieg. Und gäbe es keine übergeordnete Macht, herrschte ständig Krieg jeder gegen jeden. Der Mensch ist des Menschen Feind. In diesem Krieg gibt es kein Unrecht, da es keine Gesetze gibt, da das Verhalten auf das unabhängige menschliche Naturell zurückzuführen ist. Hobbes vergleicht dies mit dem Verhalten von souveränen Machthabern, über denen es keine höhere Ordnung mehr gibt und die sich im ständigen Kriegszustand mit ihren Nachbarn befinden, damit jedoch auch den Fleiß ihrer Untertanen fördern. Die einzigen Möglichkeiten, diesem Naturzustand zu entfliehen sind für Hobbes die Leidenschaften und die Vernunft.

Book excerpt: The central aim of this book is to foster connections between scholarly discussions of German foreign policy and broader theoretical debates in International Relations and beyond. While there has been a lively discussion about ‘new German foreign policy’, this book argues that it has not engaged substantially with international and foreign policy theory, especially with respect to its more recent developments. Reviewing the recent literature on German foreign policy, this book posits that the most discussed works are still largely provided by the ‘Altmeister’ (Maull, Szabo, Bulmer and Paterson) who were already dominating the field a quarter of a century ago. While there is a general decline in the academic study of German foreign policy, the chapters in this edited volume show that a range of novel, theoretically sophisticated but often disconnected scholarship has appeared on the margins. This book contributes to this emerging work by providing conceptual interrogations, which question the existing research and provide theoretically-grounded alternatives; initiating critical discussions and evaluations of the nature of Germany’s actorness and the environment in which it operates and proposing applications of less familiar perspectives on German foreign policy. The chapters in this book were originally published as a special issue of German Politics.

All the more reason to consider carefully whether it is necessary. This can hardly be the case if previous research in the selected field has already been the subject of an earlier review-or even several competing surveys. On the other hand, more thorough study is necessary if the intensity and scope of research are increasing without comprehensive assessments. That was the situation in Western societies when work began on this project in the summer of 1998. It was then, too, that the challenges emerged: any manual, espe cially an international one, is a very special type of text, which is anything but routine. It calls for a special effort: the "state of the art" has to be documented for selected subject areas, and its presentation made as compelling as possible. The editors were delighted, therefore, by the cooperation and commitment shown by the eighty-one contributors from ten countries who were recruited to write on the sixty-two different topics, by the con structive way in which any requests for changes were dealt with, and by the patient re sponse to our many queries. This volume is the result of a long process. It began with the first drafts outlining the structure of the work, which were submitted to various distinguished colleagues. Friedheim Neidhardt of Berlin, Gertrud Nunner-Winkler of Munich, and Roland Eckert of Trier, to name only a few, supplied valuable comments at this stage.
