The current trends indicate that the overall situation is likely to deteriorate further, at least for the next decade, unless the water profession eschews "business as usual" practices, which can only allow incremental changes to occur." Groundwater is the least understood and least appreciated, yet the most important, natural resource available to mankind. Groundwater represents about 97% of the existing fresh water resources, excluding the resources locked in polar ice. More than one and a half billion people in the urban parts of the world today depend on groundwater. Groundwater supply is more reliable than the seasonal, and sometimes erratic, surface water and provides the main line of defense against drought. Moreover, the quality of groundwater is, by and large, superior to surface water and cheaper to develop. However, when available, data on groundwater is very scanty. As a result, the World Bank is now paying increasing attention to this valuable resource, through both operations and sector work. This publication represents the proceeding of the seminar "Groundwater: Legal and Policy Perspectives" that was organized by the Legal Vice Presidency of the World Bank. It explains some basic technical aspects of groundwater, surveys the regulatory framework for it, and discusses the World Bank experience and international law regarding this precious resource. It is a timely publication and should also assist in a better understanding and appreciation of this valuable source. It will be of interest to Bank staff, borrowing country officials, international agencies and research organizations working on groundwater.

Book excerpt: This book undertakes a scholarly assessment of the state of the art of law and policy perspectives on groundwater and climate change at the international, regional and national levels. A particular focus is given to India, which is the largest user of groundwater in the world, and where groundwater is the primary source of water for domestic and agricultural uses. The extremely rapid rise in groundwater use in many Indian states has led to a growing groundwater crisis that they must address. The existing regulatory framework has not adapted to the challenges and fails to address any environmental concerns. On climate change, India has adopted a policy framework that makes the link with water, but no legislation has followed up to make the link operational. The subject matter of this book has been widely debated with regard to each of its main two components separately. Bringing these two domains together is what makes this book unique. The link between climate change and groundwater has been acknowledged to some extent, and there is growing interest in studying the impacts of climate change on (ground)water. Similarly, in water and environmental law and policy, increasing attention has been given to the study of climate change and groundwater legal and policy frameworks but generally separately. This book contributes to filling this knowledge gap by drawing on contributions from leading experts in the field of environmental and water law and policy who have been involved in climate change and/or groundwater research. The chapters in this book were originally published in a special issue of Water International.

Book excerpt: The principle of transferable groundwater rights is that by making water rights capable of being traded in the market, water resources can be used more sustainably and efficiently. Groundwater would achieve its economic value, by switching from the high volume-low value irrigation, which is prevalent with many farmers, particularly in South Asia, to low volume-high value urban supply or the growing of intensive horticultural or cash crops. This book discusses transferable groundwater rights in their broader context. It starts with a detailed description of the physical aspects of groundwater, which non-technical readers should find useful, followed by a discussion of legal and economic aspects. Water transfers and the international experiences in transferable groundwater rights are dealt with in detail in two subsequent chapters. A model is presented to guide those involved in water resources management and planning in their decision process to introduce transferable groundwater rights and water rights trading. The author concludes that transferable groundwater rights potentially offer a better alternative to land-based water rights systems. However, he casts serious doubt on whether groundwater rights trading on its own can achieve water resources sustainability, environmental protection and social equity. Government intervention seems to be almost always needed to assist the water rights market and take responsibility for any of its adverse consequences.

Book excerpt: The marginal price elasticities estimated by Martinez-Espineira conforms to expectation. The price specification that accounts for the changing proportion of water users in each block yields a higher elasticity (-0. 47) compared to the spec ification ignoring this feature of the data. However, this difference is not found to be statistically significant, a result attributed to the low power of the test (small sample size limiting the accuracy of estimates). In conclusion, the paper provides a theoretically correct price specification for demand functions under block pricing and aggregate data. The empirical findings in the paper, however, are not conclusive and further empirical work using more data and alternative (nonlinear) demand functions, is needed to show the practical implications of the arguments put forward by the Martinez-Espineira's paper. Static empirical consumer demand functions estimated with aggregate data are well known to suffer form serial correlation and other statistical problems asso ciated with misspecified dynamics. These dynamics arise because consumers do not react immediately to a change in prices due to their largely predetermined lifestyle. In the case of demand for water, for example, current purchases can be largely predetermined due to commitments arising from past purchases such as swimming pools, bathtubs, dishwashing machines, etc. Muellbauer and Pashardes (1992) show that the autoregressive nature of consumer demand data can be cap tured in a theoretically consistent manner by incorporating intertemporal aspects of consumer behaviour in the model through habit formation and durability.

Conservation and better management of this invisible resource should be a key ingredient of sustainable water policies. This is especially true in areas, such as many Mediterranean regions, which are already exposed to scarcity problems and which are likely to experience increasing competition between freshwater uses and users. Agriculture is an important user of groundwater not only in terms of abstractions, but also in terms of generation and release of pollutants. Agricultural policies, traditionally directed towards other objectives, are beginning to pay more attention to environmental considerations. However more effective initiatives are required to reduce the pressure upon groundwater resources and to achieve a better integration between agricultural and environmental policies. This book has been developed from three workshops held as part of the EU Concerted Action SAGA, "Sustainable Agricultural Use of Aquifers in Southern Europe: Integration between Agricultural and Water Management Policies" (FAIR5-CT97-3673).
