Book Great Jurists of the World Classic Reprint

Download or read book Great Jurists of the World Classic Reprint written by John Macdonell and published by . This book was released on 2015-07-01 with total page 682 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Great Jurists of the World I might instance in other professions the obligation men lie under of applying themselves to certain parts of History; and I can hardly forbear doing it in that of the Law, - in its nature the noblest and most beneficial to mankind, in its abuse and debasement the most sordid and the most pernicious. A lawyer now is nothing more (I speak of ninety-nine in a hundred at least), to use some of Tully's words, "nisi leguleian quidem cautus, et acutus praeco actionum, cantor formularum, au ccps syllabarium." But there have been lawyers that were orators, philosophers, historians: there have been Bacons and Clarendons. There will be none such any more, till in some better age true ambition, or the love of fame, prevails over avarice; and till men find leisure and encouragement to prepare themselves for the exercise of this profession, by climbing up to the vantage ground (so my Lord Bacon calls it) of Science, instead of grovelling all their lives below, in a mean but gainful application of all the little arts of chicane. Till this happen, the profession of the law will scarce deserve to be ranked among the learned professions. And whenever it happens, oue of the vautage grounds to which men must climb, is Metaphysical, and the other, Historical Knowledge. Henry St. John, Viscount Boungbroke, Letters on the Study of History (1739). Whoever brings a fruitful idea to any branch of knowledge, or rends the veil that seems to sever one portion from another, his name is wTitten in the Book among the builders of the Temple. For an English lawyer it is hardly too much to say that the methods which Oxford invited Sir Henry Maine to demonstrate, in this chair of Historical and Comparative Jurisprudence, have revolutionised our legal history and largely transformed our current text-books.-Sir Frederick Pollock, Bart., The History of Comparative Jurisprudence (Farewell Lecture at the University of Oxford, 1903). No piece of History is true when set apart to itself, divorced and isolated. It is part of an intricately pieced whole, and must needs be put in its place in the netted scheme of events, to receive its true color and estimation. We are all partners in a common undertaking, - the illumination of the thoughts and actions of men as associated in society, the life of the human spirit in this familiar theatre of cooperative effort in which we play, so changed from age to age, and yet so much the same throughout the hurrying centuries. The day for synthesis has come. No one of us can safely go forward without it. - Woodrow Wilson, The Variety and Unity of History (Address at the World's Congress of Arts and Science, St. Louis, 1904). Book Pleasantries of English Courts and Lawyers Classic Reprint

Download or read book Pleasantries of English Courts and Lawyers Classic Reprint written by John Cordy Jeaffreson and published by . This book was released on 2015-08-05 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Pleasantries of English Courts and Lawyers Well planned and well written, the story of the Great Seal would be a rare story. It calls up the dead of eight silent centuries, placing before the mind much of that which is most beautiful and noble, and not a little of that which is most to be deplored in the growth of England's greatness. The poet's song and the soldier's fame give music and brightness to the atmosphere that covers and surrounds the mystic emblem of sovereign will. For seven-and-twenty generations fair women and brave men have submitted meekly to its influence and bowed before it reverentially. More than a mere symbol of the ruler's power, it has been honored as the power itself by the flatteries of pliant courtiers, the prayers of wretched supplicants, the hopes of ambition, and the fears of cowardice. For twice four hundred years it has witnessed the most stirring scenes, held parley with the most famous personages, and been an actor in the grandest episodes of history. Is said in Carr's account of the Netherlands, was so dejected at the choice of a patron saint, that in a few months he died, and coming to heaven's gates knocked hard. Whereupon St. Peter asked who it was that knocked so boldly. He replied that he was St. Evona the advocate. Away, away! Said St. Peter; here is but one advocate in heaven; here is no room for you lawyers. Oh, but, said St. Evona, I am that honest lawyer who never took fees on both sides, nor pleaded in a bad cause; nor did I ever set my neighbours together by the ears, nor lived by the sins of the people. Well, then, said St. Peter, come in l He became the patron saint himself. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Inaugural Addresses: Delivered by the Professors of Law, in the University of the City of New-York; At the Opening of the Law School of That Institution The establishment of a Law Faculty formed a part of the original design of the University of the City of New-York; and as early as 1835, a plan for this purpose, drawn up by Mr. Butler, the present Principal of the Faculty, was adopted by the Council. The official engagements of that gentleman, not allowing him to enter on the duties of his Professorship until the present year, and the Council not wishing to lose his services in the school, its complete organization has been accordingly delayed. The Faculty consists of the following Professors: - Benjamin F. Butler, Professor of General Law, and of the Law of Real Property, and Principal of the Faculty. William Kent, Professor of the Law of Persons and Personal Property; and David Graham, Junior, Professor of the Law of Pleading and Practice. The School is divided into three Departments - a Department of Practice and Pleading; another of the Law of Persons and Personal Property including Commercial Law; and a third of the Law of Real Property and of Equity; - under the care of the Professors above named respectively. Book excerpt: Excerpt from Letters to John Bull, Esq., On Lawyers and Law Reform I AM sure my friend Bull will take these Letters in the same friendly spirit in which they are written We ofizen wonder at one another simply for want of a like knowledge. The Surgeon's boy wondered why his master should condescend to have salve written on his door-mat. His master however merely in tended a welcome to strangers. People who wonder at Lawyers, at what they do and at what they object to, sometimes merely want a little information. This I have endeavoured to supply in as plain and pleasant a manner as I could. I have tried to write pleasantly, wishing to be read - and plainly, wishing to be understood. J. W. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Law as a Means to an End Classic Reprint

Download or read book Law as a Means to an End Classic Reprint written by Rudolf Von Ihering and published by Forgotten Books. This book was released on 2017-10-12 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Law as a Means to an End The need of the series now proposed is so obvious as hardly to need advocacy. We are on the threshold of a long period of construe tive readjustment and restatement of our law in almost every depart ment. We come to the task, as a profession, almost wholly untrained in the technic of legal analysis and legal science in general. Neither we. Nor any community, could expect anything but crude results without thorough preparation. Many teachers, and scores of students and practitioners, must first have become thoroughly familiar with the world's methods of juristic thought. As a first preparation for the coming years of that kind of activity, it is the part of wisdom first to familiarize ourselves with what has been done by the great modern thinkers abroad to catch up with the general state of learning on the subject. After a season of this, we shall breed a family of well-equipped and original thinkers of our own. Our own law must, of course, be worked out ultimately by our own thinkers; but they must first be equipped with the state of learning in the world to date. Book excerpt: Excerpt from The Four Hague Conferences on Private International Law, the Object of the Conferences and Probable Results: Paper Read Before the Universal Congress of Lawyers and Jurists at the St. Louis Exposition, September 29, 1904 May the ideas which I developed before a world-forum have fallen upon productive soil and may they have gained new friends for the development of International Private Law! It should not be forgotten that the possible participation by other nations in the deliberations of The Hague conferences, pre supposes earnest study and methodical research in this partien lar domain of law. Especially is it necessary that International Private Law should be methodically taught and learned as an independent study at all the great universities. Real progress in this branch of law is dependent upon the fulfilment of this condition. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
