Available in PDF, EPUB and Kindle. Book excerpt: DROIT PENAL DES AFFAIRES ET DROIT COMMUNAUTAIRE ENTRERIENNENT DES RAPPORTS COMPLEXES. SI ON NE NIE PLUS AUJOURD'HUI L' EXISTENCE DE CES RELATIONS, ON S'INTERROGE EN REVANCHE SUR LEUR NATURE. LES PRINCIPES GENERAUX DU DROIT COMMUNAUTAIRE N'ONT PAS SPECIALEMENT VOCATION A S'APPLIQUER AU DROIT PENAL CECI CONDUIT A LA DECOUVERTE DE PRINCIPES DIRECTEURS QUI COIFFENT LES DEUX DISCIPLINES. EN CE QUI CONCERNE LE PREALABLE LEGAL, LES PRINCIPES DE SECURITE JURIDIQUE ET DE CONFIANCE LEGITIME CONDUISENT A S'INTERESSER DAVANTAGE A L'ASPECT MATERIEL DE LA LEGALITE ET DE LA NON RETROACTIVITE. L'INFLUENCE QUANT A LA NORME DE COMPORTEMENT EST PLUS DIFFICILE A DEFINIR EN RAISON DU CARACTERE SPECIFIQUEMENT PENAL DE LA QUESTION. LA CONCEPTION INTERNE DE L'INTENTION EST RENOUVELEE PAR LA MISE EN PLACE DE PRESOMPTIONS DE RESPONSABILITE, D'UNE VERITABLE POLITIQUE DE LA RESPONSABILITE DE LA PERSONNE MORALE ET DU FAIT D'AUTRUI. ENFIN, LA NORME DE SANCTION EST ELLE AUSSI INFLUENCEE, PUISQUE LE DROIT COMMUNAUTAIRE REINTRODUIT D'UNE PART LE PRINCIPE DE PROPORTIONNALITE, QUI ENTRE EN CONCURRENCE AVEC LE LEGALITE DES PEINES, ET D'AUTRE PART L'EQUITE, QUI VIENT LIMITER LE NON CUMUL.

Book excerpt: “A reference book in this area of EU competition law and a must-have companion for academics, enforcers and practitioners alike, as well as EU and national judges.” Judge Nils Wahl, Court of Justice of the European Union This seminal text offers an authoritative and integrated treatment of the legal and economic principles that underpin the application of Article 102 TFEU to the behaviour of dominant firms. Book excerpt: This volume offers a critical analysis and illustration of the challenges and promises of ’stateless’ law thought, pedagogy and approaches to governance - that is, understanding and conceptualizing law in a post-national condition. From common, civil and international law perspectives, the collection focuses on the definition and role of law as an academic discipline, and hybridity in the practice and production of law. With contributions by a diverse and international group of scholars, the collection includes fourteen chapters written in English and three in French. Confronting the ’transnational challenge’ posed to the traditional theoretical and institutional structures that underlie the teaching and study of law in the university, the seventeen authors of Stateless Law: Evolving Boundaries of a Discipline bring new insight to the ongoing and crucial conversation about the future shape of legal scholarship, education and practice that is emblematic of the early twenty-first century. This collection is essential reading for academics, institutions and others involved in determining the future roles, responsibilities and education of jurists, as well as for academics interested in Law, Sociology, Political Science and Education.

Book The Notion of Restriction of Competition

Download or read book The Notion of Restriction of Competition written by Damien Gerard and published by Bruylant. This book was released on 2017-03-16 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: The transformations induced by the process of “modernisation”, including in its substantive dimension, as well as recent judgments by the EU Courts, have left many lawyers and economists wary as to the standards actually governing findings of antitrust infringement under EU competition law, thereby affecting their ability to advise businesses effectively on the design of their commercial practices. While not ignoring institutional constraints, this volume revisits the notion of restriction of competition in the framework of Articles 101 and 102 TFEU with a view to taking stock of recent developments, to identifying common trends and to informing the application of core EU antitrust principles in current market contexts. Associating lawyers and economists, practitioners and academics, it seeks both to revisit long-standing theories of harm to competition and to explore novel forms of antitrust concerns.

Book European Competition Law Annual 2007

Download or read book European Competition Law Annual 2007 written by Claus-Dieter Ehlermann and published by Bloomsbury Publishing. This book was released on 2008-11-28 with total page 882 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the twelfth in a series on EU Competition Law and Policy produced by the Robert Schuman Centre of the European University Institute in Florence. The volume reproduces the written contributions and transcripts in connection with a roundtable debate which examined the EU's enforcement policy as regards the abuse of a dominant position under Article 82 EC. The workshop participants included: senior enforcement officials and policy makers from the European Commission, from the national competition authorities of certain EU Member States and from the US Department of Justice and Federal Trade Commission; and renowned international academics, legal practitioners and professional economists. In an intense, intimate environment, this group of experts debated a number of legal and economic issues structured according to three broad lines of discussion: 1) comparisons of the concept of monopolization under Section 2 of the Sherman Act with that of abuse of dominance under Article 82 EC; 2) a reformed approach to exclusionary unilateral conduct; and 3) exploitative unilateral conduct and related remedies.

Book L int gration Du Droit International Et Communautaire Dans L ordre Juridique National

Download or read book L int gration Du Droit International Et Communautaire Dans L ordre Juridique National written by Pierre Michel Eisemann and published by Martinus Nijhoff Publishers. This book was released on 1996-06-26 with total page 606 pages. Available in PDF, EPUB and Kindle. Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.
