Book excerpt: This book investigates the strategic use of public procurement as a way to establish “buying green” as a common practice – not only in the EU, but all over the world. However, imposing environmental requirements may affect the conditions of competition between suppliers, especially between local and foreign ones. This is particularly relevant for signatory states to the Government Procurement Agreement (GPA), a plurilateral WTO agreement that aims at liberalizing public procurement markets. So how can these countries strike a balance between trade concerns and using the environmental potential of public procurement? What scope does the GPA 2012 leave for environmental criteria and how are signatory states making use of it? The need for answers to these questions is becoming even more pressing with the increasing use of green public procurement (GPP). This book discusses approaches to finding legal solutions to this question, using a multilayered approach to do so: In a first step, an analysis of the pertinent GPA provisions serves to delineate the scope for GPP under WTO law. In a second step, an evaluation of the implementation of the respective provision at the regional and national level by the EU and Switzerland helps reveal the impact of the GPA on its signatory states. While the book chiefly focuses on the legal framework for GPP, it also takes into account the latest developments in jurisprudence and policy initiatives. It concludes by proposing practical solutions regarding the specific design of GPP policies and measures in compliance with the GPA. The comparative approach applied in the book, focusing on the implementation of the WTO/GPA by two selected signatories, makes it an informative and insightful resource for practitioners, policymakers and legal scholars from all GPA signatory countries, extending its relevance beyond the selected examples (the EU and Switzerland).

Book excerpt: Abstract: Green Public Procurement (GPP) can play a significant a role in efforts to influence the private sector towards more sustainable products and services. Following an account of the environmental impact of Nordic public procurement, the project provides an assessment of the potential of strengthening GPP within three key product groups in Nordic public procurement: Taxi and coach services, Computers and related services, and Cleaning products. The analyses show that compared to traditional regulatory instruments GPP tends to be more soft and dynamic - but also slower and less comprehensive. A decision model for GPP is developed. Two cases illustrate the potential benefits of GPP: Procurement of a new server centre in the City of Copenhagen, and procurement of transportation for disabled and elderly people in the City of Stockholm. Conclusions and recommendations on how to strengthen the benefits of GPP are provided. The study has been initiated and supervised by The Working Group on Environment and Economics under the Nordic Council of Ministries

The problem with sector in the Nordic countries is that it contains large installed amounts of very strong climate gases, the HFCs. The total Nordic installed amount in 2018 is estimated to be approx. 43.5 million tons CO2 eqv. A market study roughly estimates that appr. 10 % are publicly owned installations. The project has formulated green procurement criteria for 25 product categories, based on screening data of the current technology stage for low GWP refrigerants and energy efficiency in different RAC product categories. The criteria can be directly inserted into tender documents. The overall conclusion is that natural refrigerants are applicable for most RAC products at equal cost and can be used as a selection criteria in GPP.
