Book excerpt: The focus of this report is on the voluntary or not-for-profit organisations which are charities, and other organisations with charitable, philanthropic and benevolent purposes, many of which raise funds from the public including campaign groups. The Draft Bill aims to modernize charity law, allowing many campaigning and social justice groups to attain charitable status. In England and Wales 188,739 charities are registered with the Charity Commission, with a total income of £32 billion raised by the major charities. There are 471 charities, 0.29 per cent of those registered, which represent 45 per cent of the total income, two-thirds of charities actually have an income of £10,000 or less. The Joint Committee sets out 54 recommendations and conclusions, among them are: that the Bill should include a definition of religion; that there should be an additional charitable purpose of promoting religion, racial harmony and advancement of culture; that an account should be taken of the loss of assets to a charity, if it loses charitable status; that an independent review should look at the burden of regulation that charities face; that the Charity Commission should inform the charities the reason for any investigation and that compensation and costs can be awarded against the Commission.

PACAC also launched an inquiry, to examine both the regulation of charity fundraising and the way in which trustees of large charities govern fundraising. Witnesses to our inquiry, including employees and trustees of some of the charities whose outsourced fundraising activities have been criticised, expressed shock at the Daily Mail's discoveries. There was consensus amongst witnesses both that trustees had failed in their duty to extend their governance to fundraising, particularly in the management of sub-contractors, and in support of Etherington's proposals. The Government is right to welcome Etherington's recommendations. This is the last chance for self-regulation. It is essential that the Etherington system is made to work effectively, though it can only work by supporting effective governance by trustees.

The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

Not immune to scandals, sometimes nonprofits are in the news for all the wrong reasons and so, when they are in the public eye, regulators must respond to high profile cases. In this book, a team of internationally recognised charity law experts offers a modern take on a fast-changing policy field. Through the concept of policy debates it moves the field forward, providing an important reference point for developing scholarship in charity law and policy. Each chapter explores a policy debate, setting out the fault-lines in play, and often offering proposals for reform. Two important themes are explored in this edited collection. First, there is a policy tension in charity law between its largely conservative history and the need to keep up-to-date with social change.
