Book excerpt: In its report of last year on the Communities and Local Government's Departmental Annual Report 2007 (HC 170, session 2007-08, ISBN 9780215037978) the Committee commented on the particular nature of the Department's work: on its unusual reliance for the achievement of the goals Government has set it on a plethora of other Departments, agencies, non-departmental bodies, local authorities and other stakeholders; on the long, devolved delivery chains by which those goals therefore have to be delivered; and on the skills of influence, brokering and negotiation which are required to achieve them. In this Report the Committee assesses the progress made since last. The most recent Cabinet Office Capability Review concludes that there has been a positive "direction of travel" for CLG in that period, but the Committee concludes that there is still some way to go before CLG can be said to be performing at the highest achievable level of effectiveness. The Department's overall performance against its Public Service Agreement targets is likewise moving in the right direction but still short of full effectiveness. Achievement of efficiency targets is applauded. Finally, the report considers examples of particular policies which highlight some of the Department's strengths and weaknesses, and follow up some issues in earlier inquiries. These issues include: eco-towns; the Decent Homes programme; Home Information Packs; Fire Service response times; Firebuy; the FiReControl programme. The report also considers the Department's response to the serious flooding of summer 2007, and to the reviews which followed; and the mismanagement of European Regional Development Fund monies.

Book excerpt: This report follows up one issue left from the Committee's 2013 report on the Private Rented Sector (HCP 50, session 2013-14, ISBN 9780215060730): whether or not England should follow Scotland and introduce a ban on letting agents charging fees to tenants other than rents and refundable deposits. The change in Scotland had only been made in November 2012 and when the Committee reported in July 2013 views on its impact were speculative and varied widely. The Committee therefore decided to wait two years from its introduction and seek hard evidence on the impact of the change in Scotland. The Committee sought evidence from a number of organisations representing tenants, agents and landlords in Scotland and have examined relevant published reports. The Committee concludes that the evidence available is not strong enough to reach a view on the impact of the ban on fees in Scotland. In addition, the issues around fees that were raised in the original inquiry are more broadly based than simply fees to tenants, as they affect the overall role of agents in the market and the transparency of that market. The Committee therefore call on the Department for Communities and Local Government to commission a comprehensive impact assessment of the effects of the introduction of a ban on agents' fees in England.

The country faces a significant housing shortfall, and the financial crisis has amplified the problem. 232,000 new households are forming each year in England, and yet in 2011 fewer than 110,000 new homes were completed. The Committee sets out four key areas for action, which, taken together, could go a long way to raising the finance needed to meet the housing shortfall: large-scale investment from institutions and pension funds; changes to the financing of housing associations, including a new role for the historic grant on their balance sheets; greater financial freedoms for local authorities; new and innovative models, including a massive expansion of self build housing.

Book excerpt: The £40bn Decent Homes Programme has had a positive effect on the living conditions of most social housing tenants, this report finds, but the Government has failed to invest enough resources in the parallel programme to improve homes occupied by vulnerable people in the private sector. The Government must also clarify future funding: it is still unclear how the elimination of the remaining backlog of disrepair (around 3 per cent of social homes) will be funded; and how much will be available to maintain standards in the future. The Government must prevent another backlog of disrepair from building up after the current programme comes to an end in 2010. Carbon emissions reduction targets mean that the entire UK housing stock must be made more energy efficient. The decent homes standard has an important part to play and should be updated to enable this. The use of arm's-length management organisations (ALMOs) to manage council housing has led to improved standards and better planning, though not all councils were able to follow this model. The decent homes standard remains a low benchmark, however. The target for decency applied to private housing should be retained and strengthened by creating a National Indicator for private sector accommodation. A clear long term target should be set at a national level to bring all private sector homes (not just those occupied by vulnerable people) up to the decent homes standard.

It is time for a rethink and restructure of government policy, support, and industry practices to better protect housing consumers and deliver high-quality and sustainable housing that creates social value. Through evidence-based research and international case studies, this book focuses on the effects that dangerous defects have on the housing consumer. The ongoing construction cladding crisis is used as a primary case study throughout to highlight these implications, with other previous large-scale defect examples, such as leaky buildings and asbestos. Based upon the range of emerging evidence, we propose ideas for policy makers, construction and built environment professionals, owners corporations, and households on how to move forward towards a higher-quality, sustainable, and socially valuable way of residential living. Government policy has long focused on ‘making industry work’ through building regulations and standards. It is now time for greater government and industry focus on the consumer to make ‘consumer protection work’ in the built environment. There is a need to prevent dangerous defects like combustible cladding, better support consumers when defects emerge, and to create buildings for social value rather than minimum standards. The focus of this report is the private rented sector, specifically the repair and maintenance of the property and harassment and unlawful eviction. It builds on the consultation paper on this topic (2007, Consultation paper 181, ISBN 9780117037816). Part 1 sets out the background, and part 2 considers the case for change. Part 3 reviews the history of regulation. The options for change outlined in the discussion paper are rehearsed in part 4 and part 5 sets out the conclusions drawn by the Commission from the responses to that paper (which are detailed in appendix B). Part 6 sets out the recommendations for reform. The review offers the prospect of a new regulatory approach that will be of significant social benefit. Implementation of the recommendations in "Renting homes" would contribute to the understanding of both landlords and occupiers of their mutual legal rights and responsibilities and encourage responsible renting. Smart regulation is proposed, involving much greater self-regulation by the sector, the establishment of housing standards monitors and codes of practice for housing management practice and letting agents. The recommendations set out a series of affordable and proportionate measures that, by enhancing self-regulation, will improve the management of the private rented sector.
