This book was released on 2005 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's report examines the Government's proposed changes to the system of legal aid payments in asylum appeal cases in England and Wales, under the draft Community Legal Service (Asylum and Immigration) Regulations 2005 (ISBN 0110723015). Issues discussed include: the introduction of a system of retrospective funding, the merits test, and the implications of the new system for solicitors offering legal aid services. Conclusions reached include that the merits test will have to be set at a lower level if the system of retrospective funding is introduced, to ensure that appellants and suppliers are not to be disadvantaged, since the legal aid system should not be used to restrict legitimate appeals.

Book Administrative Justice and Asylum Appeals

Download or read book Administrative Justice and Asylum Appeals written by Robert Thomas and published by Bloomsbury Publishing. This book was released on 2011-01-18 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: FIRST PRIZE WINNER OF THE SLS BIRKS PRIZE FOR OUTSTANDING LEGAL SCHOLARSHIP 2011 How are we to assess and evaluate the quality of the tribunal systems that do the day-to-day work of adjudicating upon the disputes individuals have with government? This book examines how the idea of adjudicative quality works in practice by presenting a detailed case-study of the tribunal system responsible for determining appeals lodged by foreign nationals who claim that they will be at risk of persecution or ill-treatment on return to their country of origin. Over recent years, the asylum appeal process has become a major area of judicial decision-making and the most frequently restructured tribunal system. Asylum adjudication is also one of the most difficult areas of decision-making in the modern legal system. Integrating empirical research with legal analysis, this book provides an in-depth study of the development and operation of this tribunal system and of asylum decision-making. The book examines how this particular appeal process seeks to mediate the tension between the competing values under which it operates. There are chapters examining the organisation of the tribunal system, its procedures, the nature of fact-finding in asylum cases and the operation of onward rights of challenge. An examination as to how the tensions inherent in the idea of administrative justice are manifested in the context of a tribunal system responsible for making potentially life or death decisions, this book fills a gap in the literature and will be of value to those interested in administrative law and asylum adjudication.

Available in PDF, EPUB and Kindle. Book excerpt: Public Law is a high quality introductory textbook that comprehensively covers the key topics found on undergraduate public law courses. Three key themes that permeate all of the content allow students to approach the content in a structured and easy to understand way and questions posed throughout the chapters give students the opportunity to provide answers that show how their knowledge has increased as the chapter progresses. The key themes are: -The significance of executive power in the contemporary constitution and the challenge of ensuring that those who wield it are held to account -The shift in recent times from a more political to a more legal constitution and the implications of this change -The increasingly 'multi-layered' character of the British constitution Online Resource Centre Public Law is accompanied by a free, open-access Online Resource Centre (www.oxfordtextbooks.co.uk/orc/elliott_thomas) which offers the following resources to support students: - Figures from the book reproduced online - A list of useful websites for students - Regularly posted legal and political updates for the book - A testbank of questions for tutors to assess students' progress This book has been highly endorsed by lecturers for level of coverage, accuracy, and the manner in which the three themes provide an excellent backdrop to the book's content. 'I think it will be a very welcome addition to the range of text books available and I suspect that it will become my personal favourite.' - Barbara Mauthe; Lancaster University 'I found the book impressive and likely to be of interest and use to a great many. It is written in a style that is pitched about the right level. It was easy to understand and provides - for me - a good blend of black letter law and socio-political context' - David Mead; University of East Anglia Written by two experienced teachers of the subject, Public Law is an essential new text that focuses on what students need to engage with and understand this challenging subject.

Book excerpt: "Effective policy-making in the administration of justice requires a solid understanding of public behaviour. This book presents the results of the most wide-ranging survey ever conducted by an independent body or government agency into the experiences of ordinary citizens as they grapple with the kinds of problems that could ultimately end in the civil courts. Funded by the Nuffield Foundation, the survey identifies how often people experience problems for which there might be a legal solution and how they set about solving them. Revealing crucial differences in the approach taken to different kinds of potential legal problems, the study describes the factors that influence decisions about whether and where to seek advice about problems, and whether and when to go to law. In addition to exploring experiences of courts, tribunals and ADR processes, the study also provides important insights into public confidence in the courts and the judiciary. For the first time the study reveals the public's perspective on access to civil justice and makes a significant contribution to debate about how far civil justice reforms coincide with public experience and expectations about resolving justiciable problems."--Back cover.

This book was released on 2005-10-17 with total page 158 pages. Available in PDF, EPUB and Kindle. Book excerpt: This White Paper sets out the Government's proposals for reforming the regulation and delivery of legal services in England and Wales, with the aim of creating a simplified, more consistent and accountable regulatory framework which better meets the needs of consumers. The White Paper follows on from a consultation paper issued in March 2004 and draws on the recommendations of the Clementi review published in December 2004 (further details of both documents can be found at http://www.legal-services-review.org.uk/content/pubs.htm). Proposals include: the creation of a new independent Legal Services Board to oversee the regulatory system with statutory powers; a system of front line regulators to carry out day-to-day regulation, including existing professional bodies such as the Bar Council and the Law Society; the establishment of a new single independent body to investigate complaints called the Office for Legal Complaints (OLC); and the development of alternative business structures to provide legal and certain other services for different consumers, with the aim of promoting competition and innovation within the sector.

Book Many Roads to Justice

Download or read book Many Roads to Justice written by Mary E. McClymont and published by . This book was released on 2000 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book attempts to convey some of the challenges that those wielding the law for social change purposes have faced and the successes they have achieved. By intention, it is more a studied appreciation than a critical analysis of their efforts. We asked an international team of consultants to help us document and describe how various law-based strategies have worked in very different settings, to draw out connections between those efforts, and to highlight some of the insights that emerge from grantees' experiences in law-related work. We also asked them to help us learn more about the ways the Foundation has played a role in these efforts. Known as the Global Law Programs Learning Initiative (GLPLI), this effort is not definitive, but rather suggestive. Our goal is to contribute to more serious future reflection and, ultimately, more effective programs in this field.
