Book excerpt: The balance of power between central and local government matters because it affects the responsibility and accountability for delivery of services and improvements to local people and communities. Democracy is strengthened where local people understand what local government is responsible for in terms of both policy and resources, where they can hold to account local government for its performance, and where, crucially, they believe that local government can make a real difference. Local authorities should have the freedom to shape the development of their communities and the scope to unlock the full potential of local innovation. Yet the predominant trend, particularly since the second world war, has been for central government to increase its powers and responsibilities at the expense of local government. This report looks at the current role of local government, assessing where it could be more proactive in making best use of existing structures, and where change is required elsewhere - by central government and its agencies and by Parliament - to increase the scope for autonomous local government activity. It considers the role of central government, and the advantages to be gained at both the local and the national levels from adopting a "minimalist" as opposed to a "maximalist" role in relation to local government, advocating further cultural change within central government to facilitate a decentralised balance of power structure. The Committee also addresses the pressing need for reform of local government financial arrangements, with a view to enabling local government to raise more of its own money.

The code is intended to replace the estimated 1,293 duties imposed on local government today. The Committee concludes that the balance of power between central and local government is skewed in favour of the centre and needs to be addressed. The devolution of power to Scotland, Wales, and Northern Ireland has been successful and is an evolving process - there is no apparent reason why local government in England is not capable of using similar powers. Power and finance must go together, if local government is to become an equal partner it should have own source of revenue. Local authorities in England could also have a share of the existing income tax take and local councils freed to raise additional revenue, with the consent of their electorates. English local government lacks some of the most basic constitutional protections that are available to some of its counterparts in a number of other mature European democracies. The Government should examine the possibilities of a stronger constitutional status for local government, through an entrenched statutory code, or a similar proposal. A code for relations between central and local government, enforced by statute, could be beneficial to both tiers of government for several reasons. First, it could help set out exactly where powers do, and should, lie, thereby increasing transparency for the electors. Secondly, it could help redress the overcentralisation of England. Thirdly, it could provide an economic boost that the country sorely needs.

Book excerpt: This report finds that the Government's desire to deliver localism is neither supported consistently across Whitehall nor implemented coherently by each department of state. MPs warn that the Minister for Decentralisation will need to bring coherence, rigour and clear priorities to the Government's programme. The MPs call for a more explicit statement about where the dividing line will be drawn between a central, light-touch framework for local services and unwarranted interference from ministers in local affairs. So far the Government has shown itself all too eager to impose its preferences on local decision-making. Ministers have also introduced policies that circumvent rather than empower local government: elected police commissioners, free schools, academies and health service reform, threaten to fragment rather than integrate delivery of better public services at local level. As devolution proceeds, the manner in which local decisions are taken come under greater scrutiny. Any reduction in the inspection and performance management required by Whitehall must be accompanied by stronger local democratic accountability. Broadening the provider base for public services is an important plank of the government's decentralisation agenda, but it remains unclear how far the 'Big Society' can expand to take on services and functions shed by statutory bodies. Localism should not be adopted purely as a way to curb public sector costs not least because the financial benefits of more tailored services may not offset the loss of efficiencies of scale. Stimulating greater democratic participation and civic activism will itself cost money if it is to be successful and sustainable.
