Book Counter terrorism policy and human rights ninth report

Download or read book Counter terrorism policy and human rights ninth report written by Great Britain: Parliament: Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2008-02-25 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: On 30th January 2008 the Home Secretary laid before both Houses of Parliament a draft Order to renew the control order legislation, the third annual extension of the control order regime. The Government takes the view that no amendments to the legal framework are necessary. The Committee disagrees and considers it imperative for the Government to amend counter-terrorism laws where experience has shown them to lead to breaches of human rights. Amongst their recommendations are: ensurance of timely availability of Lord Carlile's annual report on the control orders; the need to strengthen the intrusive powers contained in the control orders; modification of the Prevention of Terrorism Act to impose a maximum daily limit 12 hours on the curfew which can be imposed; review of the fairness of the special advocate procedure and a need to take into account the Committee's own earlier recommendations concerning this; maintaining the preferred policy of priority of prosecution; and greater transparency of decisions that prosecution is not possible.

Book excerpt: This is the Committee's first report in its ongoing inquiry into counter-terrorism policy and human rights issues, focusing on the terrorist attacks in London in July 2005 and the Government's counter-terrorism measures taken in response. Issues discussed include: provisions of the Terrorism Bill, including those relating to glorification of terrorism, and pre-charge detention; changes to powers of deportation and exclusion, including the new list of 'unacceptable behaviours', deportation with assurances, torture and national security; and the counter-terrorism clauses of the Immigration, Asylum and Nationality Bill, including deprivation of British citizenship, deprivation of right of abode, and out of country appeals in national security cases. Conclusions reached include that the definition of 'terrorism' needs to be changed for the purposes of many of these measures in order to avoid incompatibility with human rights standards.

Download or read book Free Speech After 9 11 written by Katharine Gelber and published by Oxford University Press. This book was released on 2016 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: The relationship between counter-terrorism policy in liberal-democratic countries and freedom of speech has never been more prominent than it is today. Since the terrorist attacks of 2001, Western governments have made a distinct and deliberate move towards prevention - as opposed to purely prosecution - of terrorist crimes. However, in doing so, they have reached far into the freedom of speech, and, as Katharine Gelber argues, far further than many commentatorshave recognized. Examining the United States, the United Kingdom, and Australia, the book traces the significant shift in understandings of the appropriate parameters of freedom ofspeech and speech-practices in the counter-terrorism context, which has been seen both in policy change and in the discursive justification for that change. The book argues that this change has, to some extent, taken different forms in each jurisdiction, which reflect the pre-existing institutions within which the principle of freedom of speech was mediated in each country prior to 9/11.

Book Counter terrorism Policy and Human Rights eleventh Report

Download or read book Counter terrorism Policy and Human Rights eleventh Report written by Great Britain. Parliament. Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2008 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The main purpose of this Report is to comment on the adequacy of the additional safeguards which the Government has indicated it intends to bring forward to meet the human rights concerns about its proposal to extend the maximum period of pre-charge detention to 42 days. The report explains the Committee's conclusion that the additional safeguards are inadequate to protect individuals against the risk of arbitrary detention. The Committee recommends that the Government provide Parliament with the evidence on which it relies when it says that the threat from terrorism is growing. It also calls for information about the use made of the extended power to detain without charge for up to 28 days since it was last renewed in July 2007. No amount of additional parliamentary or judicial safeguards can render the proposal for a reserve power of 42 days' pre-charge detention compatible with the right of a terrorism suspect to be informed "promptly" of the charge against him under Article 5(2) ECHR. The Government has not included in the Counter-Terrorism Bill a provision to improve the existing arrangements for parliamentary review of the operation of extended pre-charge detention, and the report puts forward amendments to the Bill to improve such arrangements. In the Committee's view the recent examples of questionable information sharing by the intelligence services, which risk making the UK complicit in torture or other inhuman or degrading treatment, show that there is a need for substantive legal safeguards to guarantee against the arbitrary and disproportionate use of the power to disclose and use such information. The Committee proposes amendments to strengthen safeguards.

New to this edition: A brand new chapter is dedicated to exploring technology and the media, including contemporary issues such as the dark web, the surveillance state, internet censorship and the law and social media, including bloggers, vloggers and tweeters. The chapters on regulatory authorities have been expanded to provide greater clarification and explanation of broadcasting, press and advertising regulation, including the protection of journalistic sources and comparisons with EU Law. This book was released on 2009 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report presents the Government's response to the Committee's 29th report (HL 165-I/HC 150-I, session 2007-08, ISBN 9780104013472). The Committee welcomes various aspects of the Government response but also has some substantive comments. It also notes that publication of the Government's Green Paper has been repeatedly delayed and recommends that it be published as soon as possible. The Government's reiteration of its commitment not to detract or resile from the rights in the European Convention on Human Rights (ECHR); and its acknowledgement that there would be scope for including in a new constitutional document a range of rights and responsibilities which go beyond those in the ECHR, are welcomed. The Committee is concerned to detect some equivocation in the Government's view about the Human Rights Act, particularly following the interview given by the Secretary of State for Justice in the Daily Mail on 10 December 2008. It also remains unclear about the relationship between rights and responsibilities envisaged by the Government in a Bill of Rights. Finally, the Committee recommends that the Government should follow Australia's example and appoint an independent committee to conduct a national consultation on the whole range of options for a Bill of Rights for the UK, ahead of parliamentary consideration of the bill itself.
