Governments make environmental policies and put them on their domestic firms. Firms decide their outputs and compete in the international market. Pollution are local or transboundary.First, we discuss governments’ preference when their firms compete Cournot in the international market. Our results suggest that under local pollution governments tend to apply looser environmental policies on their firms which decrease their production costs. However, these polices become more stringent if governments and firms are under transboundary pollution.Second, we analyze firms’ payoffs in Stackelberg competition and find that under this case, both governments and firms obtain less payoffs than what they can get when firms compete Cournot. This is different from the results that a firm can get more profits as the leader in Stackelberg model than its profits in Cournot model if there is no intervention from governments.Finally, we discover governments’ and firms’ payoffs by collusion and compare all the possible choices for governments and firms. Our results shows that in the first stage governments choose collude in making environmental policies and in the second stage firms would collude in deciding their outputs.

During the course of the analysis the model is modified to analyze an array of contexts for which eco-tariffs have been claimed to improve environmental quality or welfare. The circumstances and conditions are characterised under which such tariffs can be shown to improve environmental quality and social welfare, taking account of general equilibrium effects. The theoretical results are applied in a policy analysis of eco-tariffs and other trade instruments in the context of domestic and global environmental policy in order to assess the relevance of the eco-tariffs that have been subjected to the theoretical analysis. Finally, the GATT/WTO rules and regulations are presented, since to date these have banned the use of eco-tariffs. The rules and regulations are mapped against the theoretical results to show which rules ought to be changed.

Climate change, tropical deforestation, biodiversity loss, ozone depletion, hazardous wastes, and ocean pollution are among several issues that have brought national governments together in common purpose. As they have worked to mitigate these global problems, governments have developed a wide variety of environmental regime designs. Some global environmental regimes are more institutionally integrated than others. Some regimes impose legally binding obligations on countries while others involve non-binding commitments. And some regimes involve global standards and rules while others leave national commitments up to countries' discretion. What explains the pattern of regime design in global environmental governance? Alexander Ovodenko demonstrates that national governments have developed different institutional responses to global issues because the markets producing environmental pollution impose varying constraints and create varying opportunities for governments. Contrary to the prevailing literature, governments are more inclined to impose stringent rules and regulations on oligopolistic industries than on competitive ones. The capital resources and innovation potential of oligopolistic businesses make them more cost-effective and economical in reducing pollution and meeting global standards than businesses in competitive industries. In global governance, oligopolistic businesses face a "double-edged sword" arising from their wealth and market concentrations. Regulating the Polluters inverts the literature on regulatory capture and collective action by presenting empirical evidence of the irony of market power in global environmental politics.
