Book excerpt: Excerpt from The Government of Ohio: Its History and Administration This book is intended to give in brief compass a comprehensive account of the government of the State of Ohio as it has developed to the present year - the hundredth anniversary of Ohio's admission to Statehood. The plan of treatment conforms in general to that laid down for all the volumes of the series to which this book belongs, but several features have been suggested by the excellent work of Professor W. C. Morey on The Government of New York, which also appears in this series. In accordance with this plan, the growth of the government during the fifteen years of its Territorial life and the hundred years of its life as a State has been treated in Part I (Chapters I and II); the structure of the government has been described in Part II (Chapters III, IV, V, and VI); and the work of the government has been set forth in Part III (Chapters VII, VIII, IX, X, XI, and XII). It will be seen from this arrangement that an effort has been made to lay due stress on the functions of the State, a subject generally slighted despite the fact that these functions are an expression of the will of the people, are performed for the benefit of the people, and constitute the objects for which a modern government exists. Not illustrated. 1875 edition. Excerpt: ...JUSTICES' COURTS--TRIALS, JUDGMENTS AND EXECUTIONS. A civil action is "a legal demand of one's right, or it is the form given by law for the recovery of that which is due." Civil actions before justices of the peace are commenced by summons, or by the appearance and agreement of the parties without summons. Where it appears by affidavit that the defendant is guilty of certain frauds, the justice may issue an order of arrest to bring the defendant into court. At the time of issuing a summons, or afterward, an attachment may be issued against the goods and chattels of the defendant, when the circumstances are such as the law deems justifiable in order to secure the plaintiff's claim. These facts and circumstances must be made to appear by affidavit. The student is referred to the statutes, Swan and Critchfield, 773, for particulars as to commencement of suits, service and return of process, and proceedings in arrest and attachment. In case a person has in his possession property which he has no right to keep, the person who has a right to it, if the property does not exceed in value three hundred dollars, may apply to a justice for a writ to authorize the constable to take and deliver such property to the plaintiff. If the value of the property is less than one hundred dollars, justices have exclusive jurisdiction; from one hundred to three hundred, concurrent jurisdiction with the court of common pleas. The writ is called a writ of replevin, and after it is executed, the parties have a trial before the justice, to determine who has the right to the possession of the property. If the plaintiff fails, he must return the property to the defendant, or pay him the value of it. In whatever way a suit is commenced, a trial must be had, ...

Book Ohio Government and Politics

Download or read book Ohio Government and Politics written by Paul Sracic and published by CQ Press. This book was released on 2015-03-13 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ohio Government and Politics provides a thorough, highly readable overview of the history, processes, and institutions of the state’s government and politics. In a country increasingly divided into blue and red states, Ohio is “purple” – one of the few states that is not dominated by a single political party. Covering the crucial strategies of both the republicans and democrats as they vie for power in Ohio, authors Paul Sracic and William Binning demonstrate the “nationalizing” of Ohio politics. However, contemporary issues specific to Ohio politics are not neglected; coverage of important issues such charter reform in Cuyahoga County and the controversies over the regulation of "fracking" is included.
