Book excerpt: Sustainable use, development and conservation of the world's livestock genetic resources are of vital importance to agriculture, food production, rural development and the environment. In recognition of the need to develop and effective framework for the management of these resources and to address the threat of genetic erosion, 109 countries came together in September 2007 at the first International Technical Conference on Animal Genetic Resources for Food and Agriculture held in Interlaken, Switzerland. The Conference adopted the Global Plan of Action for Animal Genetic Resources- which includes 23 strategic priorities for action to promote the wise management of these vital resources. The Global Plan of Action is the outcome of a country-driven process of reporting, analysis and discussion, which also resulted in the preparation of the State of the World's Animal Genetic Resources for Food and Agriculture, the first comprehensive global assessment of livestock diversity and its management. The Conference also adopted the Interlaken Declaration on Animal Genetic Resources, which affirms countries' commitment to the implementation of the global Plan of Action and to ensuring that the world's livestock biodiversity is utilised to promote global food security and remain available to future generations.

Book excerpt: The livestock sector faces a range of challenges, including climate change, emerging diseases, competition for natural resources and evolving demand for animal-source foods, which is increasing globally, especially in developing countries. Genetic diversity of livestock is a key resource for allowing livestock keepers to address these challenges, but this diversity has been in a state of decline. The diminishing genetic diversity thus represents yet another obstacle for sustainable livestock production. Cryoconservation (i.e. ex situ – in vitro conservation) of genetic resources through gene banking provides one of the most powerful tools governments and other stakeholders have to manage genetic diversity in both the short and long term and thereby provide future generations with the tools to meet the challenges ahead. Gene banking genetic resources fits within the context of the Global Plan of Action for Animal Genetic Resources, which was developed and adopted by FAO Member Nations. Specifically, Strategic Priority 9 of the Global Plan of Action is “Establish or strengthen ex situ conservation programmes” and Strategic Priority 11 urges countries to “Develop approaches and technical standards for conservation. To assist countries in the implementation the Global Plan of Action, FAO worked with experts from around the world to prepare technical guidelines. In 2012 FAO published FAO Guidelines on Cryoconservation of animal genetic resources.Gene banking is a long-term effort that needs to be viewed in terms of decades rather than years, as demonstrated by similar systems for agricultural crops. The responsibility for establishing such resources lies squarely within governments’ roles of providing public goods and food security. Gene banking of animal genetic resources is a technology-intense undertaking and the associated technologies are in a continual state of research and development. The livestock sector also continues to evolve rapidly. Since the development and release of the previous guidelines, numerous changes have taken place. Critical among these is a greater appreciation of the opportunities for actively utilizing cryopreserved material to enhance management of in vivo populations, rather than as simply an “insurance policy” to protect breeds against extinction.This key development has led to further changes in gene bank management. First, interaction with users of the stored material has increased. This in turn has created a need to involve stakeholders more closely in the management of genetic collections and to better monitor and document the processes of gene banking to ensure quality management.

The book consists of 11 chapters. Chapter 1 locates intellectual property rights within the armoury of food security policies. Chapter 2 deals with definitional issues and examines the role of intellectual property rights in incentivizing agricultural research and development. Chapter 3 examines the international landscape of intellectual property and the approaches taken to the relationship between intellectual property rights, agricultural biotechnology, access to biological resources, food security and globalization which are taken by the WTO, FAO, CBD and WIPO among the various international and development agencies. Plant variety rights (PVRs) are a specially created form of intellectual property right originally minted to encourage agricultural innovation and Chapter 4 examines the effectiveness of PVRs in a food security context. Agricultural innovation is in part dependent upon access of researchers to the genetic resources of the biodiverse countries of the South. Chapter 5 considers the attempts to construct an international regime to secure this access. The important role of traditional farmers in preserving landraces and cultivars from which improvements can be derived has generated for a call for the recognition of farmers' rights, and this is examined in Chapter 6 together with agitation for the protection of the traditional knowledge which often informs access to the useful genetic resources. Chapter 7 examines the intellectual property implications of the use of genetically modified (GM) crops as a technological solution to food insecurity. The protection of GM crops is achieved through patent protection and Chapter 9 looks at the competition law implications of patent licensing, patent pools and patent thickets. An old intellectual property device that underpinned the commercial development of European agricultural marketing is the geographical indication, and Chapter 8 examines the contribution it might make to achieving food security. Returning to the theme of the role of intellectual property law in incentivizing innovation, Chapter 10 examines its role in promoting agricultural research. The concluding chapter proposes a number of recommendations for action in deploying intellectual property law in the struggle for food security.

The livestock sector has been an active participant in the so-called “genomic revolution.” Advancements in the sequencing of genomes and related genotyping methods have created opportunities for gathering much more information on the molecular level than ever possible, at a faster rate, and for exponentially decreased costs. Scientists and other livestock stakeholders in countries with highly developed economies have been among the main beneficiaries of this revolution. However, the greatly decreased costs of genomic applications have also created opportunities in countries with developing and transitional economies. In many instances, the lack of awareness of these opportunities and in the technical capacity for the full application of genomic tools may represent a greater obstacle to their utilization than the expenses involved.The development of these guidelines and the subsequent application of the information contained herein may help to bridge this gap, bringing new opportunities to light and transferring knowledge that can be used to increase the genetic characterization of AnGR and subsequently improve the sustainable use and conservation of livestock genetic diversity.
