Book excerpt: Proliferation of weapons of mass destruction (WMD), terrorism, and the nexus between the two are inarguably among the greatest threats facing international peace and security today. In 2004, the United Nations Security Council adopted Resolution 1540, obligating states to take steps to counter the proliferation of chemical, biological and nuclear weapons to non-state actors. Regional organizations are widely considered an important part of the puzzle to implement Resolution 1540. To that end, this thesis analyses the oft-overlooked complementary relationship between regional organizations and the United Nations in maintaining global peace and security. It demonstrates that regional bodies have evolved throughout history to become assistant guardians, together with the UN, against regional and international perils. In turn, it explores the opportunities and limitations of regional bodies--specifically the League of Arab States and the Gulf Cooperation Council (GCC)--in the Middle East to assist their memberships in complying with the Resolution 1540. This region was selected because of its relatively low 1540 implementation rates, porous borders, lax export controls, challenges stemming from transnational crime, and the increased interest in nuclear power--all which make Middle Eastern states attractive and prone to being exploitation by non-state actors seeking to acquire WMD or transfer such devices through the region. The thesis concludes that key features of the League of Arab States and the GCC--scope and focus, current and evolving institutional infrastructure, and ongoing and prior work related to 1540 implementation--make them appropriate bodies that can effectively assist their membership with 1540 implementation. Policy recommendations include that the League of Arab States and the GCC request assistance available under 1540's mandate to employ a dual-hatted 1540 Coordinator for their overlapping memberships to further 1540 implementation in the Middle East.

Book excerpt: Faced with the urgent and grave threat of WMD terrorism, the international community has responded with a new approach of international legislation by adopting Security Council Resolution 1540. The traditional approach of multilateral treaties on WMD has primarily been aimed at the prevention of proliferation of such weapons to states and not to non-state actors. Another traditional approach of utilising anti-terrorism treaties has been a sort of patchwork, and thus provides no guarantee that a new treaty is made in a timely manner in response to a newly emerging type of terrorism. By contrast, the new approach of international legislation through Council resolutions makes it possible to enact rules that legally bind all UN members immediately and automatically without exception and are equivalent to those in a treaty instantly ratified by all UN members. Indeed, a new thinking is necessary to effectively respond to a new, urgent and grave threat to the international community. In that sense, Resolution 1540 is welcome. This does not, however, mean that everything is allowed if it is effective to deal with the present or imminent threat. Not only from the viewpoint of legitimacy, which guarantees the long-standing effectiveness, but also from that of the rule of law in the international community, it seems of fundamental importance to establish some kind of understanding that we discuss in this article, if international legislation by the Security Council is destined to become inevitable in the future and is to be better implemented.

The ability to resolve conflicts through peaceful contestation is a measure of any well-ordered society. Arguing is almost as ubiquitous in international affairs, yet it is not viewed as an important element of world order. In The Power of Deliberation: International Law, Politics and Organizations, Ian Johnstone challenges the assumption that arguing is mere lip service with no real impact on the behavior of states or the structure of the international system. Johnstone focuses on legal argumentation and asks why, if the rhetoric of law is inconsequential, governments and other international actors bother engaging in it. Johnstone joins the efforts of international relations scholars and democracy theorists who consider why argumentation occurs beyond nation states. He focuses on deliberation in and around international organizations, drawing on various strands of legal, political and international relations theory to identify common features of legal argumentation and deliberative politics. Johnstone's central claim is that international organizations are places where "interpretive communities" coalesce, and the quality of the deliberations these communities provoke is a measure of the legitimacy of the organization.
