A 250 anni da Dei Delitti e delle pene” interroga l’opera di Beccaria non solo dal punto di vista storico-ricostruttivo, filologicamente iscrivibile nell’ambito della storia delle idee, intendendo, piuttosto, attualizzarne la ricezione, in risonanza con le tensioni dell’oggi, rivolgendosi a quanti (studenti, docenti, studiosi, operatori del settore) percepiscono la criticità dell’amministrazione della giustizia. Ascrivibile alla sfera dei classici, “Dei delitti e delle pene”, infatti, non cessa, in virtù di quella riserva di senso che lo caratterizza, di interrogare la contemporaneità, nella quale la sfera giuridica e lo statuto stesso dello Stato di diritto costituiscono l’oggetto di un’interrogazione non scevra da interrogativi e inquietudine. A rileggere l’opera di Beccaria, ad attualizzarne il significato, al crocevia tra conoscenze ed esperienze maturate in contesti, anche nazionali (due tra testi provengono da docenti che insegnano in università transalpine e sono pubblicati in lingua francese), storici e storici del pensiero, studiosi di filosofia del diritto, ma anche giuristi ‘pratici’, che si misurano con quei processi e quelle corti nel cui ambito solo con difficoltà è possibile far rivivere, in epoca post-moderna, gli ideale di giustizia e lo spirito giuridico razionale del “secolo dei Lumi”.Elio Palombi, già magistrato ordinario, è Professore Ordinario (f. r.) di Diritto penale presso la Facoltà di Scienze Politiche dell’Università “Federico II” di Napoli; nell’anno 1996 è stato nominato Giudice aggregato della Corte Costituzionale; è stato direttore della «Rivista penale dell’economia»; è avvocato Cassazionista nel settore penale. È autore di numerose pubblicazioni, tra le altre: “Mario Pagano e la scienza penalistica del XIX secolo” (Napoli, 1989); “Il diritto penale dell’economia e dell’impresa” (Torino, 1996); “La concussione” (Torino, 1998); “Processo a Gesù. Doubtless the Lisbon Treaty has constituted a milestone in the development of European criminal justice. Not only has the reform following the Treaty given binding force to the EU Charter of Fundamental Rights, but furthermore it has paved the way for unprecedented forms of supranational legislation. In this scenario, the enforcement of individual rights in criminal matters has become a core goal of EU legislation. Alongside these developments, new interactions between national and supranational jurisprudences have emerged, which have significantly contributed to a human rights-oriented approach to European criminal law. The book analyses the main developments of this complex phenomenon from an interdisciplinary perspective. Criminal and procedural law, constitutional law and comparative law must thus be combined to achieve a full understanding of these developments and of their impact on national law.
