Available in PDF, EPUB and Kindle. Book excerpt: Child labor law strikes most Americans as a fixture of the country’s legal landscape, involving issues settled in the distant past. But these laws, however self-evidently sensible they might seem, were the product of deeply divisive legal debates stretching over the past century—and even now are subject to constitutional challenges. Child Labor in America tells the story of that historic legal struggle. The book offers the first full account of child labor law in America—from the earliest state regulations to the most recent important Supreme Court decisions and the latest contemporary attacks on existing laws. Children had worked in America from the time the first settlers arrived on its shores, but public attitudes about working children underwent dramatic changes along with the nation’s economy and culture. A close look at the origins of oppressive child labor clarifies these changing attitudes, providing context for the hard-won legal reforms that followed. Author John A. Fliter describes early attempts to regulate working children, beginning with haphazard and flawed state-level efforts in the 1840s and continuing in limited and ineffective ways as a consensus about the evils of child labor started to build. In the Progressive Era, the issue finally became a matter of national concern, resulting in several laws, four major Supreme Court decisions, an unsuccessful Child Labor Amendment, and the landmark Fair Labor Standards Act of 1938. Fliter offers a detailed overview of these events, introducing key figures, interest groups, and government officials on both sides of the debates and incorporating the latest legal and political science research on child labor reform. Unprecedented in its scope and depth, his work provides critical insight into the role child labor has played in the nation’s social, political, and legal development.

  • Pages : 1506 pages

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Download or read book The Fair Labor Standards Act written by William G. Whittaker and published by Nova Publishers. This book was released on 2003 with total page 76 pages. Available in PDF, EPUB and Kindle. Book excerpt: We often define ourselves by our work, with a frequent introductory question being, 'What do you do?' Because we devote so much of our lives to our jobs, anything affecting them is of special concern to us. The federal government has assumed a role of protecting the rights of labourers, with the prime example being the Fair Labor Standards Act, which is the primary federal statute in the area of minimum wage, overtime pay, and child labour. Since its adoption in 1938, the act has undergone several amendments and periodic changes. A constant issue is the level of the minimum wage, with many public officials and labour groups calling for its raise. Some though, have made proposals to weaken federal wage protection and exempt certain businesses from the law. Heated debate continues on both sides of this topic, which so closely impacts a significant portion of the population. Federal oversight of labour and work conditions is a fact of life, and the standards by which authorities fulfil this task need to be understood. This book studies the history behind and application of the Fair Labor Standards Act in its three distinct areas of minimum wage, overtime pay, and child labour. As a people who so intimately tie ourselves to careers and work, the information this book holds becomes necessary to developing a clear vision of how the government influences the 'workaday world'.
