Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The German Civil Code: Translated and Annotated, With an Historical Introduction and Appendices Nor is the German Code of more academic interest to the English-speaking peoples. Both England and America are closely connected with Germany - the former commercially, by its proximity to the Continent; the latter socially, by the great influx of German im migrants ia recent years. In this age of international intercourse, cases involving the conflict of laws come up from time to time, and it is not an uncommon thing for an English or American Court to be called upon to decide a question of German law. To place in the hands of English-speaking lawyers a reliable rendering of the Code is my object in undertaking this task. How far this object has been attained will depend upon the judgment of the profession. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Separate property includes also that which the wife acquires by virtue of a right forming part of the separate property, or as compensation for the destruction, damage, or deprivation of an object forming part of such property, or by a juristic act affecting such property. 1371. The provisions applicable to the property of the wife under the regime of separation of goods (q) apply mutatis mutandis to the separate property; the wife is required, however, to contribute towards the expense of the joint household only in so far as the husband has not already received a reasonable contribution through his usufruct of the contributed property. 1372. Either spouse may require the other to concur in determining the condition of the contributed property by the drawing (n) I.e., by her labour on her own account. If sho works as an assistant of her husband, then what she acquires is not only not her property, but is the exclusive property of her husband. 1356, par. 2. (o) The question whether she can conduct a separate business or not depends upon whether her duties towards her husband and children would be thereby interfered with or not. In the event of a divergence of opinion between husband and wife, the husband decides as provided in 1354. The presumption, however, is that tho wife can conduct a separate business without interfering with her duties as wife and mother. (p) Without such specification the acquisition would belong to the wife's contributed property. 1363, par. 2. (g) I.e., 1427 et seq. up of an inventory. Book Introduction to German Law

Download or read book Introduction to German Law written by Mathias Reimann and published by . This book was released on 2005 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is nearly ten years since the appearance of the successful first edition of this convenient English-language introduction to the law of Germany. This new edition covers all the significant changes and innovations that have occurred during that period, encompassing the pervasive impacts of European law and of globalisation, the major recent reform of the German Civil Code, and the greatly increased activity of the German legislature in every area. With fifteen lucid chapters written by academic expects in their respective fields of law, as well as detailed bibliographies, this is the ideal starting point for research whenever a question of German law must be answered. The authors clearly explain the legal concepts, customs, and rules arising from such basic elements as the following: characteristic problems of Germany legal unity; principles and practices of constitutional law; administrative law and procedure; the German Commercial Code; formation and conduct of corporations and partnerships; contracts; tort liability; property rights; family law; succession and inheritance; labor and employment; issues of private international law; courts and civil procedure; the penal code and criminal procedure. Introduction to German Law, Second Edition provides an authoritative description of all issues likely to emerge in the course of normal application of German law in any context.

Book A Modern History of German Criminal Law

Download or read book A Modern History of German Criminal Law written by Thomas Vormbaum and published by Springer Science & Business Media. This book was released on 2013-10-01 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. While there are many reasons for this, one stands out very clearly: Language. English has become the lingua franca of international legal research. The present book addresses this issue. Thomas Vormbaum is one of the foremost German legal historians and the book's original has become a cornerstone of research into the history of German criminal law beyond doctrinal expositions; it allows a look at the system’s genesis, its ideological, political and cultural roots. In the field of comparative research, it is of the utmost importance to have an understanding of the law’s provenance, in other words its historical DNA.
