Er stellt sein Werk dabei selbst in direkten Bezug zu den neuzeitlichen Vertragstheorien von Thomas Hobbes' Leviathan, John Lockes Abhandlungen über die Regierung, Jean-Jaques Rousseaus Gesellschaftsvertrag und Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre. Diese wiederum greifen vielfach auf Platons Politeia und Aristoteles' Politik zurück. Sozialethik ist Strukturenethik: Sie beschäftigt sich demnach mit den sich Menschen gebenden Strukturen und Ordnungen von Institutionen und Normen. Hierzu prüft sie diese nach anthroposophischen Maßstäben und übt gegebenenfalls Kritik. Oberstes Prinzip ist hierbei der Mensch als Subjekt und Person. Sie erstreckt sich folglich über die gleichen Wirkungsbereiche wie Rawls' Gesellschaftstheorie. Gemeinsam stellen sie die Forderung nach sozialer Gerechtigkeit auf. Diese setzt sich aus den Gerechtigkeitsgrundformen der iustitia commutativa (Vertrags-Gerechtigkeit), iustitia distributiva (Teilhabe-Gerechtigkeit) und iustitia legalis (Gesetzes-Gerechtigkeit) zusammen. Darauf bauen die Dimensionen von Besitzstands-, Leistungs-, Chancen-, Bedürfnis- und Zukunftsgerechtigkeit auf. John Rawls schuf 1971 mit A Theory of Justice gleichermaßen persönliches und philosophiegeschichtliches Hauptwerk. Die vorliegende Arbeit hat keinen Anspruch auf streng genommene wissenschaftliche Stringenz bei der Durchf hrung des Vergleichs. Das w re auch aufgrund des ungew hnlichen Designs nicht machbar. Viel mehr liegt ihr Reiz in dem orginellen Ansatz. Als Ergebnis l sst sich festhalten, dass der zentrale Unterschied zwischen dem Philosophen Rawls und Scharping bzw. Merkel der Umgang mit dem "Paradox der gerechten Ungleichheit" (Scharping) ist.

This highly accessible book provides an extensive and comprehensive overview of current research and theory about why and how we should protect future generations. It exposes how and why the interests of people today and those of future generations are often in conflict and what can be done. It rebuts critical concepts such as Parfits' 'non-identity' paradox and Beckerman's denial of any possibility of intergenerational justice. The core of the book is the lucid application of a 'veil of ignorance' to derive principles of intergenerational justice which show that our duties to posterity are stronger than is often supposed. Tremmel's approach demands that each generation both consider and improve the well-being of future generations. To measure the well-being of future generations Tremmel employs the Human Development Index rather than the metrics of utilitarian subjective happiness. The book thus answers in detailed, concrete terms the two most important questions of every theory of intergenerational justice: 'what to sustain' and 'how much to sustain?' Ultimately this book provides a theory of intergenerational justice that is both intellectually robust and practical with wide applicability to law, policy, economics, climate change and all other contexts that affect future generations.

Zu Beginn gibt es eine kurze Einführung und Übersicht über das gesamte Werk "a theory of justice" die als Grundlage für weitere Erläuterungen dient. Im Anschluss wird dann das zweite Kapitel des Buches näher vorgestellt. Dies mit besonderem Augenmerk auf Rawls Hinführung und Formulierung seiner beiden Gerechtigkeitsgrundsätze. Nach der Darstellung des Kapitels wird Rawls Argumentation für seine beiden Grundsätze hinsichtlich ihrer logischen Begründbarkeit auf Grundlage des Textes von Peter Koller kritisch hinterfragt. Neben der Kritik an der logischen Begründung wird im Anschluss der Frage nachgegangen inwieweit die Möglichkeiten existieren die Gerechtigkeitsgrundsätze von Rawls in der Realität umzusetzen und welche Grenzen und Unterschiede zwischen Theorie und Praxis verlaufen. Danach wird vor dem Hintergrund, dass Rawls Buch "a theory of Justice" vor über 50 Jahren geschrieben wurde außerdem erörtert welche Schwierigkeiten und Grenzen die heutige Zeit für seine Theorie birgt und ob seine Theorie auch die Möglichkeiten und Probleme der Globalisierung mit einbezieht.

Book excerpt: Economic analysis of law is an interesting and challenging attempt to employ the concepts and reasoning methods of modern economic theory so as to gain a deeper understanding of legal problems. According to Richard A. Posner it is the role of the law to encourage market competition and, where the market fails because transaction costs are too high, to simulate the result of competitive markets. This would maximize economic efficiency and social wealth. In this work, the lawyer and economist Klaus Mathis critically appraises Posner’s normative justification of the efficiency paradigm from the perspective of the philosophy of law. Posner acknowledges the influences of Adam Smith and Jeremy Bentham, whom he views as the founders of normative economics. He subscribes to Smith’s faith in the market as an ideal allocation model, and to Bentham’s ethical consequentialism. Finally, aligning himself with John Rawls’s contract theory, he seeks to legitimize his concept of wealth maximization with a consensus theory approach. In his interdisciplinary study, the author points out the possibilities as well as the limits of economic analysis of law. It provides a method of analysing the law which, while very helpful, is also rather specific. The efficiency arguments therefore need to be incorporated into a process for resolving value conflicts. In a democracy this must take place within the political decision-making process. In this clearly written work, Klaus Mathis succeeds in making even non-economists more aware of the economic aspects of the law.

Book excerpt: Fifty years after the famous essay “The Problem of Social Cost” (1960) by the Nobel laureate Ronald Coase, Law and Economics seems to have become the lingua franca of American jurisprudence, and although its influence on European jurisprudence is only moderate by comparison, it has also gained popularity in Europe. A highly influential publication of a different nature was the Brundtland Report (1987), which extended the concept of sustainability from forestry to the whole of the economy and society. According to this report, development is sustainable when it “meets the needs of the present without compromising the ability of future generations to meet their own needs”. A key requirement of sustainable development is justice to future generations. It is still a matter of fact that the law as well as the theories of justice are generally restricted to the resolution of conflicts between contemporaries and between people living in the same country. This in turn raises a number of questions: what is the philosophical justification for intergenerational justice? What bearing does sustainability have on the efficiency principle? How do we put a policy of sustainability into practice, and what is the role of the law in doing so? The present volume is devoted to these questions. In Part One, “Law and Economics”, the role of economic analysis and efficiency in law is examined more closely. Part Two, “Law and Sustainability”, engages with the themes of sustainable development and justice to future generations. Finally, Part Three, “Law, Economics and Sustainability”, addresses the interrelationships between the different aspects.
