Book excerpt: The TRIPS Agreement (for trade-related intellectual property rights) provides for the general protection of geographical indications (GIs) of product origin, including for example the special protection of wines and spirits and for the creation of a multilateral register for wines. The African Group of countries has been in the forefront of countries agitating in the World Trade Organization TRIPS Council for the extension of this special protection and of the multilateral register to industries which are of interest to developing countries, primarily agriculture. The so-called "extension question" is the central feature of the Doha Development Agenda at both the WTO and World Intellectual Property Organization. This book provides some empirical evidence and applied legal and economic reasoning to this debate. It provides both a general review of the key issues and a series of case studies from six Anglophone and four Francophone countries in Africa. These focus on major agricultural commodities such as coffee, cotton, cocoa and tea, as well as more specific and local products such as Argan oil and Oku white honey.

Rather than limitation (designed to prevent the use of ‘culture’ for protectionist purposes), the preponderance now favours recognition of GIs, with enforcement directed at protection. While the World Trade Organization (WTO) and its Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) remain the multilateral legal benchmarks for GIs, the field has been assertively entered by the World Intellectual Property Organization (WIPO) with the 2015 Geneva Act (which adds GIs to the Lisbon Agreement), national laws in key jurisdictions, and bilateral and proposed mega-regional trade agreements with provisions on food vastly more detailed than the relevant TRIPS articles. Legal drafters must therefore be well aware of the existing legal and administrative culture. They must also have a realistic appreciation of the resource constraints in the country, for inadequate resources certainly restrict the ability of implementing bodies to put new rules into practice. This study is about the nature and extent of these trade-related legal and institutional reforms with a particular focus on those of direct relevance to the agricultural sector. In addition to the sectoral focus on agriculture, the study places distinct emphasis on the challenges of developing countries in the implementation of trade-related international obligations in the agricultural sector. It derives from FAO's experience in advising countries on the implementation of agriculture-related WTO agreements, key elements of which are discussed and illustrated by three representative case studies.

In countries where GIs are recognized under a public framework, public authorities can play an important role in the creation of favourable conditions for GIs to contribute to sustainable development and sustainable food systems. In particular, public authorities in charge of GI rights have an important responsibility when examining applications for protection, and the registration should ensure that GIs can function well. The examination of applications not only serves to verify the legitimacy of the GI as an IPR in terms of the link to the origin, but can also influence the GI system’s effectiveness and sustainability performance, in relation with key factors highlighted in the literature such as the clear definition of the specific quality linked to the geographical origin, the local governance, the appropriate marketing strategy. The objective of these guidelines is to provide guidance to public authorities and experts that examine GI applications. These guidelines provide examples and recommendations related to the procedures for the examination of GI requests. They focus on the two types of criteria for the registration: 1) the legal criteria that determine the admissibility for registration (link to origin) and 2) additional criteria that can be considered to help improve the GI system’s sustainability. Finally, the guidelines offer a list of questions to guide examiners along the examination process.
