Book excerpt: Our efforts to advocate for changes to the regulatory process are colored by our impressions of the balance of power among the agencies, OIRA, the regulated community, and the public, and our belief that government can and should play a positive role in protecting public health, safety, and the environment. [...] The group's discussions and recommendations were informed not only by recent experiences with the Bush administration, but by the long-brewing troubles many observers had grown frustrated with: the complexity of the process, the length of the typical rulemaking, access by special interests, the difficulty the public faces in engaging in the process, and the integrity and quality of regulatory deci. [...] The American Bar Association (ABA) has submitted to the administration a report calling for an overhaul of the current e-rulemaking system, both the "backend," the Federal Docket Management System (FDMS), and the online public portal, Regulations.gov. [...] The PRA was written long before the development of the Internet and modern computer technologies, and its implementation, and the law itself, must be brought into the 21st century.22 We urge Congress to consider a substantial revision of the PRA, refocusing it to be about managing information resources. [...] To fully understand the regulatory process and the reforms necessary to improve its inner workings, one must look not only at OIRA and the cross-cutting policies that govern the system but at the agencies' ability to carry out the tasks asked of them.

[...] The "pull of competing obligations" - EPA's mandate to inform the public about environmental dangers and the apparent conflicting duty of the federal government to keep peace and order - neutralizes any claim that government action amounts to "deliberate indifference," the standard required to shock the conscience. [...] The best argument for the refusal to disclose, according to Aftergood, is that the decision to disclose would create a precedent for the disclosure of additional information, which could potentially threaten the nation's security. [...] The lower court argued that the determination of whether the ad was electioneering should be based on the content of the message in the ad, not on the context of the ad. [...] The Arguments against WRTL and Questions and Comments from the Court Press coverage tended to focus more on the changed make-up of the Court since it upheld the general constitutionality of the rule and less on the actual issue before the Court, which was whether the specific facts of the WRTL ad require an exemption from the rule based on the First Amendment.

Fein maintained that the NSA program violates FISA and the Fourth Amendment and called the administration's argument for the legality of the program. [...] The brief argues that the NSA program "not only violates the clear mandates of the [FISA] statute and the Fourth Amendment, it constitutes the very 'exercise of arbitrary power' by the Executive that the Founders sought to prevent by adopting "the doctrine of separation of powers ... [...] The ACLU filed a lawsuit in Michigan against the NSA, arguing that the spying program violates the "First and Fourth Amendments of the United States Constitution" and the separation of powers principle. [...] Shortly after the Office of Management and Budget released the President's FY 2007 budget, the agency released a list of the 141 programs slated of cuts or elimination in the president's State of the Union address due to their lack of results.
