Congress has authorized certain enforcement actions, known as sanctions. One sanction -- temporarily replacing a home's mgmt. -- has been used infrequently. Federal temporary management (FTM) may be used instead of termination in cases where nursing homes place residents at risk of death or serious injury. This report focused on: (1) CMS and states' experience with the use of FTM and its effectiveness in achieving compliance in the short and longer term; and (2) obstacles to the use of FTM and how such obstacles could be addressed. States select a subset of homes as SFFs from a list of the 15 poorest performing homes in each state. States survey SFFs twice as frequently as other homes and there are more robust enforcement, including termination, for SFFs that fail to improve within about 18 months. This report: (1) determined the factors states consider in selecting SFFs and how SFFs differed from other nursing homes; (2) evaluated CMS regional office and state adherence to program guidance and the program's impact on homes' performance; and (3) identified other strategies that were used to improve poorly performing homes.

In response, the Centers for Medicare & Medicaid (CMS) Serv. began requiring immediate sanctions for NH that repeatedly harmed residents. Using enforcement & deficiency data, this report: analyzed fed. sanctions from FY 2000 through 2005 against 63 NH previously reviewed; & assessed CMS¿s overall mgmt. of enforcement. The 63 NH had a history of harming residents & were located in 4 states that account for about 22% of NH nationwide. Tables.

These questions were well introduced by Prof. Margaret Hall in the opening of her chapter in this book: “The fundamental idea of ‘law and aging’ as a discrete category of legal principle and theory is controversial: how and why are ‘older adults’ or ‘seniors’ or ‘elders’ (the very terminology is controversial and fraught with difficulties) a discrete and distinct group for whom ‘special’ legal thought and treatment is justified? For some, a category of law and aging is inherently paternalistic, suggesting that older persons are, like children, especially in need of the protection of the law. In this sense, the argument continues, the category itself internalizes ageist presumptions about older adults and is therefore inherently flawed and even harmful. If certain older adults are, because of physical or mental infirmities, genuinely in need of an enhanced level of legal protection, this entitlement should be conceptualized in terms of their disability; older adults are not a distinct group but an arbitrarily delineated demographic category which contains within it any number of groups that are legitimately distinct for the purposes of legal theory (the di- bled; women; persons of colour; Aboriginal persons; rich and poor; etc.) Indeed, the arti- cial category of “older adults” may be seen as obfuscating, submerging these more meaningful distinctions.

His publications include Prisoners of Space? and six co-edited volumes, in addition to more than 60 book chapters and articles.
