Book excerpt: Excerpt from Three Letters on the Game Laws But then, m order to secure a sufficient breed of game for the supply of the market, 'in fair and Open competition, it 'will be necessary to authorize a certain number of persons, likely to breed game for sale, to take and dispose of it when reared at their expense. For this purpose I would suggest the propriety bf permitting by law, occupiers of land to take and kill game, for sale or Otherwise, on' their own occupations only, unless (if. Tenants) they are specifically prohibited by agreement with their landlord, reserving the game and the power of taking it to himself (as is now frequently done in leases). This permission should not, of course, Operate during the current leases, unless by agreement With this precaution, nothing could be fairer than such an enactment; for it is certainly at the expense of the occupier that the game is raised and maintained: and unless he receive an equivalent for it, either by abatement Of rent upon agreement, or by permission to take and dispose of it, he is' certainly an injured man. Whereas it is perfectly just that the owner of the land should have the Option either to increase his rent by leaving the disposal Of his game to his tenant, or vice vei'sé. Game would be held to be (as in fact it is) an outgoing from the land, like tithe and other burdens, and therefore to be considered inn-d bargain s and land would either be let gumfiee, or a special! Federal laws regulate interstate commerce in, and importation of game; the preservation of game in Alaska, the Indian Territory, and the District of Columbia, and on Government reservations. State laws regulate the capture, shipment, and sale of game within State jurisdictions. Canadian laws, like those of the United States, may also be divided into General laws, comprising chie y regulations concerning the export of game; and Provincial laws, corresponding to State laws, which govern the capture, shipment, and sale of game. In some States certain counties have special statutes or are partially or entirely exempt from the operation of the general game laws. In the four States of Maryland, Virginia, North Carolina, and Tennessee, where local statutes are especially popular, there are probably more game laws for the three hundred or more counties than in all the rest of the United States. It should be noted, however, that these local laws are enacted by the States and not by the counties themselves. State legislatures are jealous of their rights in such matters, and, except in Mississippi, seldom delegate even the fixing of game seasons to county boards of supervisors. In many instances these laws do not conform to those of adjoining States or counties, and even in so fundamental a matter as the definition of game there is a noticeable lack of agreement. Book excerpt: Excerpt from Digest of the Game, Fish, and Forestry Laws In the minds of those who have to do with the forestry, the fish and the game interests of this Commonwealth, those that have given these subjects careful and thoughtful study, each of them in itself seems to occupy such a place in the makeup of the individual life of so many people and are jointly so interwoven with each other and the general prosperity of our State, as to make even their prospective loss appear in the light of a calamity, a condition that if once established will be extremely hard, if not impossible to overcame, and that will bring serious, very serious results in its train. It has long since been determined that growing timber, forest shade and fruit trees were absolutely necessary to the healthful enjoyment of this life. That the products of growing timber is absolutely necessary to the success of mechanical pursuits. That upon the preservation or reproduction of our forests depends our continuous water supply, our protection from drought, as well as our defense against excessive floods. It is desired to call particular attention to two new statutes relating to forests and forestry. The first is the municipal forest law, which permits municipalities to purchase forest land for the purpose of revenue, using the returns for such municipal purposes as may be necessary; and the other is the new forest fire wardens act, completely changing the system of fire fighting in this Commonwealth. These acts will be found at pages - and - How much better it would have been for this Commonwealth had the subject of forestry, with all that word covers, been intelligently considered and acted upon fifty years ago instead of to-day. How much better it would have been, had the people of this Commonwealth and of this Nation, endorsed the idea of game and wild bird preservation and of fish protection and propagation, fifty years ago instead of at this time. It has been said that the benefit derived by a day afield with rod, or gun, by the tired, or worn out, indoor worker, is something that cannot be correctly expressed in words or figures. Physical exercise and forgetfulness of daily worry and business care, bring their reward in return of health and there is no incentive in this direction, that begins to take the place of the pursuit of game or fish.
