Book excerpt: La lucha constante contra la discriminación de género, y por alcanzar una igualdad real y efectiva entre mujeres y hombres en las diferentes esferas de la sociedad, se concibe como una de las principales y más urgentes demandas sociales de nuestro tiempo. Sin embargo, perviven sectores de actividad, como es el caso del deporte, en los que el hecho de materializar tal objetivo se ve limitado, sobre todo, por el mantenimiento de unas estructuras y de una filosofía más propia de épocas ya superadas, en las que aquellos escenarios discriminatorios, principalmente hacia las mujeres, parecían encontrar una justificación de tipo social y/o cultural. En consecuencia, y aun en el contexto de una sociedad como en la que vivimos, el deporte se nos presenta como un bastión tradicionalmente reacio a adaptarse a las exigencias democráticas de igualdad, dando lugar así a una realidad en la que son fácilmente identificables los obstáculos a los que se enfrenta cotidianamente la mujer en su propósito de verse plenamente realizada como deportista. Esas dificultades son las que, en definitiva, vienen a analizarse en la presente obra, mediante la recopilación de las ponencias y comunicaciones del XIV Congreso de la Asociación Española de Derecho Deportivo, y con las que se aportan propuestas viables en aras a su superación desde una perspectiva esencialmente jurídica, pero sin perder de vista la realidad en la que se enmarcan. Un libro en el que resulta destacable la participación conjunta de especialistas del Derecho deportivo y de investigadoras/es noveles con inquietudes sobre todas aquellas cuestiones que conforman esta disciplina, así como de profesionales tanto de este sector como de aquellos de carácter científico donde la materia de estudio plantea una importante trascendencia práctica. Sin duda, un tándem ideal a través del cual se aporta una visión completa de la problemática, acompañada de la oportuna sensibilización sobre la misma.

The analysis is based on more than 720 cases from more than 20 countries, in addition to the OECD and UN model treaties and more than 630 books, articles, and official documents. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept. The book provides many synopses of court decisions and administrative rulings upon which the analysis is based. In addition to cases previously published in law reports and other publications, a number of unpublished decisions are included. A key word index makes it easy to find what is needed in any particular matter. The PE principle, in one version or another, is used in several thousand tax treaties in force today.
