However, as in many parts of the world, there are signs that capture fisheries are fully exploited or overfished. Management of fisheries in the region is often hampered by lack of information on the status of fisheries in terms of biological, social, economic, policy and governance aspects. This regional project documents an alarming decline on coastal fishery resources, based on historic research surveys in South and Southeast Asia. Socio-economic analyses and policy reviews highlight the importance of the fisheries sector but also the challenges facing it. Potential interventions to improve fisheries management in the countries are outlined and defined with environmental, socioeconomic and institutional objectives.

Book excerpt: FAO has promoted the ecosystem approach to fisheries (EAF) as an appropriate framework for the sustainable development and management of fisheries worldwide. With a view to contribute to the identification of lessons and good practices for EAF implementation, this publication documents nine case studies that attempted to put into practice some of the key principles and tools of the approach in the Mediterranean Sea. The case studies were selected to cover a broad range of contexts including smallscale and industrial fisheries operating at local, national and sub-regional scales. It was not within the scope of the publication to evaluate the level of implementation of the ecosystem approach. A specific tool for monitoring implementation is proposed and exemplified. Case studies were analysed with a view to draw preliminary lessons regarding the enabling factors that facilitated the progress made as well as the challenges faced in the transition towards EAF-based management systems. Attention is drawn to key enabling conditions such as favourable policies, legislation and regulatory frameworks, the existence of regional mechanisms for cooperation, favourable market dynamics and social processes, and the relatively low complexity of the fishery systems analysed. A set of factors emerged that contributed to progress during implementation, such as the clear definition of fishing rights, the enhancement of mechanisms for compliance, scientific monitoring and adaptation of management measures, as well as the explicit consideration of biological and socioeconomic aspects in management actions. Further progress in the transition towards sustainable management systems is hampered by external and internal factors. External factors are related, for instance, to environmental changes, the poor regulation and control of competing sectors, consumer behaviour and the governance environment. Issues such as stakeholder representation, knowledge gaps and the availability of sustainable sources of funding are among common internal factors. The authors also discuss how slow progress in the implementation of management plans can generate discredit with the institutions and add additional challenges for any future initiatives to engage stakeholders in participatory management. The case-based results and lessons of how the ecosystem approach to fisheries was considered, developed and implemented in the fisheries discussed in this publication not only contribute to the documentation of current practices in the Mediterranean but may also guide future attempts to further develop the field.

Third, FAO hosted the International Symposium on Fisheries Sustainability in late 2019, and fourth, 2020 sees the finalization of specific FAO guidelines on sustainable aquaculture growth, and on social sustainability along value chains. While Part 1 retains the format of previous editions, the structure of the rest of the publication has been revised. Part 2 opens with a special section marking the twenty fifth anniversary of the Code. It also focuses on issues coming to the fore, in particular, those related to Sustainable Development Goal 14 and its indicators for which FAO is the “custodian” agency. In addition, Part 2 covers various aspects of fisheries and aquaculture sustainability. The topics discussed range widely, from data and information systems to ocean pollution, product legality, user rights and climate change adaptation. Part 3 now forms the final part of the publication, covering projections and emerging issues such as new technologies and aquaculture biosecurity. It concludes by outlining steps towards a new vision for capture fisheries. Book excerpt: Early in the negotiations of the Third United Nations Conference on the Law of the Sea (UNCLOS III) there was widespread agreement that coastal states should exercise exclusive jurisdiction over fisheries in an extended economic zone (EEZ). A number of premises formed the basis for the Law of the Sea Convention's grant of exclusive fishery management authority to coastal states. The first was that coastal state jurisdiction could provide a more functional fisheries management regime. Most fisheries are located within 200 miles of a coast, making the 200-mile [EEZ] a rational area for management. Second, by placing these areas under exclusive jurisdiction of the coastal state, entry into fisheries would be controlled, thereby reducing both the potential for overfishing and for overcapitalization of fishing fleets. In addition, coastal states would have authority to enforce regulations against all vessels within the [EEZ] and not be dependent on the weak flag state enforcement that characterized regulation by international fisheries organizations. Finally, prevailing theories of fisheries management were presumed to be adequate to protect and maintain fisheries if jurisdictional control and effective enforcement authority were established. None of these premises turned out to be entirely valid. This article discusses the continuing decline of the state of fisheries since coastal states were given virtually complete discretion in interpreting and implementing their duties under the LOS Convention and the failure of coastal states to meet their most fundamental obligation -the prevention of overexploitation of EEZ fish stocks. The future of EEZ management is discussed from the perspective of international law, focusing on the role of the LOS Convention, other international treaties and obligations, and relevant developments in international environmental law.
