El autor realiza un breve recorrido histórico-jurídico del Derecho a la protección de datos personales que permite disfrutar conociendo las curiosidades de sus inicios; empezando en Estados Unidos, donde se gesta la noción legal de derecho a la intimidad o righttoprivacy, pasando por las primeras normas nacionales europeas en Alemania y Francia, y terminando en España donde es posible hablar del derecho a la intimidad como fundamento de la protección de datos a partir de la publicación de la Constitución de 1978. Junto a la labor de los distintos Estados, se repasa aquello que las organizaciones internacionales han aportado para tratar de conseguir unagobernanza global de la privacidad. También queda recogida la labor realizada por de los diversos tribunales que han contribuido a la configuración del derecho a la protección de datos: el Tribunal Constitucional, en España; el Tribunal Supremo de los Estados Unidos; o el Tribunal Europeo de Derechos Humanos (TEDH) en la UE. Se analiza la evolución del derecho en la Unión Europea desde la Directiva 95/46/CE hasta el reciente Reglamento General de Protección de Datos. El último capítulo, aun dentro del ámbito de aplicación de la Unión Europea, recoge la evolución de la regulación del derecho a la protección de datos desde el modelo de la Directiva hasta el modelo proactivo del RGPD, analizando las novedades que el reglamento trae consigo tanto en conceptos como en definiciones.
