Book Asian Socialism Legal Change

Download or read book Asian Socialism Legal Change written by John Gillespie and published by ANU E Press. This book was released on 2005-08-01 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: The immense process of economic and social transformation currently underway in China and Vietnam is well known and extensively documented. However, less attention has been devoted to the process of Chinese and Vietnamese legal change which is nonetheless critical for the future politics, society and economy of these two countries. In a unique comparative approach that brings together indigenous and international experts, Asian Socialism and Legal Change analyzes recent developments in the legal sphere in China and Vietnam. This book presents the diversity and dynamism of this process in China and Vietnam-the impact of socialism, constitutionalism and Confucianism on legal development; responses to change among enterprises and educational and legal institutions; conflicts between change led centrally and locally; and international influences on domestic legal institutions. Core socialist ideas continue to shape society, but have been adapted to local contexts and needs, in some areas more radically than in others. This book is the first systematic analysis of legal change in transitional economies.

Book The Political Institutions of Modern China

Download or read book The Political Institutions of Modern China written by William L. Tung and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 422 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is prepared primarily for students who are interested in studying the constitutional development and government structure of twentieth-century China. Since the emergence of the Chinese consti tutional movement at the end of the nineteenth century, political institutions in China have undergone constant changes. The first four chapters treat of constitutional development and government systems from the latter part of the Ch'ing dynasty to the re-unification of China by the Nationalist Party in 1928. The other eight chapters deal with the policies, programs, and institutions of the Nationalist and Commu nist governments up to 1962. While treatises on various subjects have been consulted, the sources of this book are chiefly based on the official documents from the collections as indicated in the bibliography. Materials in the first few chapters are partly drawn from my previous works on government and politics in China. Because of the immense scope of the subject and the intricacy of the problems involved, this work is not intended to be exhaustive, but is rather a brief description and discussion of each topic under consideration. As there are many valuable works on China in general as well as on her history and inter national relations, I have tried not to cover what has already been dealt with by others. In my presentation of facts and views, I have endeavored to be as objective as possible, personal political convictions notwithstanding.

Book Legal Reforms in China and Vietnam

Download or read book Legal Reforms in China and Vietnam written by John Gillespie and published by Routledge. This book was released on 2010-09-13 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although the adoption of market reforms has been a key factor leading to China’s recent economic growth, China continues to be governed by a communist party and has a socialist-influenced legal system. Vietnam, starting later, also with a socialist-influenced legal system, has followed a similar reform path, and other countries too are now looking towards China and Vietnam as models for development. This book provides a comprehensive, comparative assessment of legal developments in China and Vietnam, examining similarities and differences, and raising important questions such as: Is there a distinctive Chinese model, and/or a more general East Asian Model? If so, can it be flexibly applied to social and economic conditions in different countries? If it cannot be applied to a culturally and politically similar country like Vietnam, is the model transportable elsewhere in the world? Combining ‘micro’ or interpretive methods with ‘macro’ or structural traditions, the book provides a nuanced account of legal reforms in China and Vietnam, highlighting the factors likely to promote, change or resist the spread of the Chinese model.

Book Policing Serious Crime in China

Download or read book Policing Serious Crime in China written by Susan Trevaskes and published by Routledge. This book was released on 2012-08-06 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite a resurgence in the number of studies of Chinese social control over the past decade or so, no sustained work in English has detailed the recent developments in policy and practice against serious crime, despite international recognition that Chinese policing of serious crime is relatively severe and that more people are executed for crime in China each year than in the rest of the world combined. In this book the author skilfully explores the politics, practice, procedures, and public perceptions of policing serious crime in China, focusing on one particular criminal justice practice – anti-crime campaigns – in the period of transition from planned to market economy from the 1980s to the first years of the twenty-first century. Susan Trevaskes analyzes the elements that led to the Hard Strike becoming the preferred method of attacking the growing problem of serious crime in China before going on to examine the factors surrounding the failure of the Hard Strike as a way of addressing the main problems of serious crime in China today, that is drug trafficking and organized crime . Drawing on a rich variety of Chinese sources Serious Crime in China is an original and informed read for scholars of China, criminologists generally and the international human rights community.
