En el estudio preliminar del catedrático de Historia del Dere­cho y de las Instituciones de la Universidad de Murcia, Anto­nio Pérez Martín, se exponen los aspectos más polémicos que, a día de hoy, suscita este texto alfonsí. En primer lugar, su datación, tema no pacífico ya que un sector de la doctrina la fija en 1254-1255, mientras que otro entiende que es obra posterior al reinado del rey sabio, en torno a 1293. En segundo lugar, su autoría material, atribuida por Pérez Martín al denominado «Jacobo el de las Leyes». Finalmente, Pérez Martín dedica gran parte de su estudio a otras dos cuestiones capitales para poder entender el Fuero Real: las influencias que recoge, en especial las provenientes del Fuero Juzgo y el significado de la obra, entendida como un intento del soberano por crear un código de aplicación general en todo el reino con una pretensión centralizadora, cuestión ésta tratada por Pérez Martín con sumo detalle en su trabajo.
