Even liberal proponents of freedom of speech are divided as to whether or not religious expression is part of constitutionally protected rights. What the Malaysian Constitution offers is freedom of speech including the right to religious expression. At the same time it proclaims Islam to be the official religion of the Federation. Malaysia is a multi-religious country prone to inter- and intra-group controversies, and as a rule, the government favours preventive and restrictive measures in order to elude religious strife and hate speech. The concept of freedom of religion in Malaysia is different from that in the West. Religious expression in Malaysia has been a highly contentious issue ever since the 1980s when the then-Prime minister Mahathir Mohamad embarked on his "Islamization policies" project. This paper examines recent cases of blasphemy, hate speech and the contentious "Allah" issue. The government, on one hand, tries to maintain political stability and racial harmony in Malaysia but on the other attempts to maintain the status-quo especially with regards to declaring Malaysia an "Islamic state" and imposing Islamization policies.

For Muslims concerned for this freedom, one of the major difficulties is the 'punishment for apostasy' - death for those who desert Islam. This book argues that the law of apostasy and its punishment by death in Islamic law is untenable in the modern period. Apostasy conflicts with a variety of foundation texts of Islam and with the current ethos of human rights, in particular the freedom to choose one's religion. Demonstrating the early development of the law of apostasy as largely a religio-political tool, the authors show the diversity of opinion among early Muslims on the punishment, highlighting the substantial ambiguities about what constitutes apostasy, the problematic nature of some of the key textual evidence on which the punishment of apostasy is based, and the neglect of a vast amount of clear Qur'anic texts in favour of freedom of religion in the construction of the law of apostasy. Examining the significant challenges the punishment of apostasy faces in the modern period inside and outside Muslim communities - exploring in particular how apostasy and its punishment is dealt with in a multi-religious Muslim majority country, Malaysia, and the challenges and difficulties it faces there - the authors discuss arguments by prominent Muslims today for an absolute freedom of religion and for discarding the punishment of apostasy.

Book excerpt: Article 18 of the Universal Declaration of Human Rights (UDHR), published by the United Nations in 1948, states that “everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.” Malaysia recently won its bid to sit on the United Nations Human Rights Council from 2022 to 2024. However, while the country’s constitution is progressive in underlining the rights of religious minorities, this is severely lacking in practice as it exercises heavy regulation on religion, combined with restrictions on the practices of certain faiths. Based on interviews and focus group discussions conducted in Malaysia, this paper uncovers the challenges faced by religious minorities in the country, and how treatment of them at the hands of religious authorities is illustrative of encroachments on their right to the freedom of religion. The groups that will be focused on are the Millah Ibrahim (Abrahamic Faith), the Baha’i faith, and the Ahmadiyah faith, all of which have been banned by the religious authorities. It was found that the three groups navigate their respective situations differently. For example, Millah Ibrahim adherents are very conscious of the repression that they face, and have resorted to propagating their teachings in secret and migrating to countries that are more lenient towards them. On the other hand, the Baha’i community feel they have relative freedom to practise their rituals despite the fatwa which bans their movement, and therefore do not see the need to take legal action against the authorities. This is in contrast to the Ahmadiyah adherents who use legal means (such as court cases) to counteract the repression towards them. Considering the precarious position of these groups, it is recommended that religious authorities engage with these minority groups so as to deepen their understanding of these groups and to properly assess the perceived threat that they allegedly pose. Such engagement would also allow Malaysia to uphold its commitment to human rights.

As President Barack Obama said, they ought to "bear witness and speak out" when violations of religious freedom occur.With these reports, we bear witness and speak out. We speak against authoritarian governments that repressed forms of expression, including religious freedom. Governments restricted religious freedom in a variety of ways, including registration laws that favored state-sanctioned groups, blasphemy laws, and treatment of religious groups as security threats. The report focuses special attention on key trends such as the impact of political and demographic transitions on religious minorities, who tended to suffer the most in 2011; the effects of conflict on religious freedom; and the rising tide of anti-Semitism. Impacted groups, to name just a few, included Baha'is and Sufis in Iran; Christians in Egypt; Ahmadis in Indonesia and Pakistan; Muslims in a range of countries, including in Europe; Tibetan Buddhists, Christians, and Uighur Muslims in China; and Jews in many parts of the world.

In disputes about faith-based social services, public money for religious schools, the Pledge of Allegiance, Ten Commandments monuments, the theory of evolution, and many other topics, angry contestation threatens to displace America's historic commitment to religious freedom. Part of the problem, the authors argue, is that constitutional analysis of religious freedom has been hobbled by the idea of "a wall of separation" between church and state. That metaphor has been understood to demand that religion be treated far better than other concerns in some contexts, and far worse in others. Sometimes it seems to insist on both contrary forms of treatment simultaneously. Missing has been concern for the fair and equal treatment of religion. In response, the authors offer an understanding of religious freedom called Equal Liberty. Equal Liberty is guided by two principles. First, no one within the reach of the Constitution ought to be devalued on account of the spiritual foundation of their commitments. Second, all persons should enjoy broad rights of free speech, personal autonomy, associative freedom, and private property. Together, these principles are generous and fair to a wide range of religious beliefs and practices. With Equal Liberty as their guide, the authors offer practical, moderate, and appealing terms for the settlement of many hot-button issues that have plunged religious freedom into controversy. Their book calls Americans back to the project of finding fair terms of cooperation for a religiously diverse people, and it offers a valuable set of tools for working toward that end.
