Book excerpt: While colonial imposition of the Canadian legal order has undermined Indigenous law, creating gaps and sometimes distortions, Indigenous peoples have taken up the challenge of rebuilding their laws, governance, and economies. Indigenous conceptions of land and property are central to this project. Creating Indigenous Property identifies how contemporary Indigenous conceptions of property are rooted in and informed by their societally specific norms, meanings, and ethics. Through detailed analysis, the authors illustrate that unexamined and unresolved contradictions between the historic and the present have created powerful competing versions of Indigenous law, legal authorities, and practices that reverberate through Indigenous communities. They have identified the contradictions and conflicts within Indigenous communities about relationships to land and non-human life forms, about responsibilities to one another, about environmental decisions, and about wealth distribution. Creating Indigenous Property contributes to identifying the way that Indigenous discourses, processes, and institutions can empower the use of Indigenous law. The book explores different questions generated by these dynamics, including: Where is the public/private divide in Indigenous and Canadian law, and why should it matter? How do land and property shape local economies? Whose voices are heard in debates over property and why are certain voices missing? How does gender matter to the conceptualization of property and the Indigenous legal imagination? What is the role and promise of Indigenous law in negotiating new relationships between Indigenous peoples and Canada? A Métis man is gored by a radioactive bison, gaining super strength, but losing the ability to be remembered by anyone not related to him by blood. Nanites babble to babies in Cree, virtual reality teaches transformation, foxes take human form and wreak havoc on hearts, buffalo roam free, and beings grapple with the thorny problem of healing from colonialism. Indigenous futurisms seek to discover the impact of colonization, remove its psychological baggage, and recover ancestral traditions. These eight short stories of “Métis futurism” explore Indigenous existence and resistance through the specific lens of being Métis. Expansive and eye-opening, Buffalo Is the New Buffalo rewrites our shared history in provocative and exciting ways.

Book excerpt: This book explores the foundations and characteristics of public policy discourse on Aboriginal affairs between publication of H.B. Hawthorn's Survey of the contemporary Indians of Canada in 1966-67 and the establishment of the Royal Commission on Aboriginal Peoples in 1991. The primary sources are 222 documents prepared by Aboriginal and non- Aboriginal organizations and governments over this period. The focus in analyzing these documents is to trace the evolution of policy discussions and debates in four key areas: lands and resources, governance, criminal justice, and education. The analysis considers three basic questions: who was involved in policy discussions; how did policy discussions occur; and what was said about key issues in the domain of Aboriginal affairs. Building on the analysis, the book examines the documentary evidence in light of the role of international influences, the dominant preoccupations of Aboriginal peoples and Canadian governments in the evolution of their relationship, and the extent to which the relationship has been accompanied by clarity of Canadian government policy and genuine consultation.

"We Are In Charge Here" examines the central institution of the most populous Indigenous self-governance regime in Canada, the elected Assembly of the Nunatsiavut Government. Nunatsiavut – "our beautiful land" in Inuktitut – was established in 2006 by a modern treaty between the Labrador Inuit and the Canadian state. Graham White offers a thorough observation of the Assembly, based on interviews with Assembly members and others involved in Nunatsiavut politics, observation of Assembly sessions, and a review of official documents, in order to provide a comprehensive picture of the Assembly, its members, and its operations. The book examines the Assembly’s effectiveness in performing traditional legislative functions such as representation, policy making, and accountability. It addresses key concerns including executive-legislative power relations, Inuit influence on Assembly operations, and the Assembly’s role in realizing self-government. Book excerpt: Forging Alberta’s Constitutional Framework analyzes the principal events and processes that precipitated the emergence and formation of the law and legal culture of Alberta from the foundation of the Hudson’s Bay in 1670 until the eve of the centenary of the Province in 2005. The formation of Alberta’s constitution and legal institutions was by no means a simple process by which English and Canadian law was imposed upon a receptive and passive population. Challenges to authority, latent lawlessness, interaction between indigenous and settler societies, periods (pre- and post-1905) of jurisdictional confusion, and demands for individual, group, and provincial rights and recognitions are as much part of Alberta’s legal history as the heroic and mythic images of an emergent and orderly Canadian west patrolled from the outset by red coated mounted police and peopled by peaceful and law-abiding subjects of the Crown. Papers focus on the development of criminal law in the Canadian west in the nineteenth century; the Natural Resources Transfer Agreement of 1930; the National Energy Program of the 1980s; Federal-Provincial relations; and the role and responsibilities of the offices of Justices of the Peace and of the Lieutenant-Governor; and the legacies of the Lougheed and Klein governments.
