It explores how science permeates shared human consciousness, to produce effects that ripple through the entire social body to restructure relations between persons, discourses, institutions, and power in ways which we are barely conscious of. The book shows how science, through its entwinement with power, discourses, and practices, presents certain social arrangements as natural and certain courses of action as beyond question. By arguing for a non-reductive, liberal scientific naturalism that sees science as one form of rationality amongst others, it opens possibilities for thought and action beyond scientific knowledge. Examining the shifting relations between science and other social institutions, discourses and power, the book addresses the narrowing of freedom by the instrumental modes of thinking that accompany scientific and technological change. McIntyre simultaneously raises the question of the good life and the question of a philosophical critique both directed towards science and, at the same time, shaped by, and responsive to it. By analysing the works of Foucault and Habermas in terms of their social, political, and historical contexts it reveals the two thinkers as linked by a commitment to the Enlightenment tradition and its emancipatory telos. The significant differences between the two are seen to result from Foucault’s radicalization of this tradition, a radicalization which is, at the same time, implicit within the Enlightenment project itself.

After arguing that Habermas’s Discourse Theory of Law and Democracy is too normative and idealistic, it presents Foucault’s Discourse Theory of Power Relations to illustrate the tensions between different Western discourse theories. The book then draws on the normative concept of Confucian Rationality from traditional Chinese cultural sources in order to investigate how adaptable these two discourse theories are to the Chinese society, and to balance the tension between them. Presenting these three dimensions of discourse theory, as well as the relations between them, it also uses empirical descriptions of certain facts of political-legal discussion both in traditional China and in the country’s new media age to explain, supplement and question this theoretic framework. The book asserts that, because of the diverse modes of thinking in specific cultures, there might be different normative paradigms of discorse and different political-legal discussion modes across corresponding cultural contexts. Normative discourse theories provide guidance for the practices of deliberative democracy and legal discussions, which can in turn verify, supplement, improve and challenge the normative discourse theories. In addition to demonstrating the multiple dimensions of discourse theories, this research also promotes an approach to the Discourse Theory of Law and Democracy that combines elements of both Chinese and modern society.

In the decades following his death, neoliberalism has triumphed and attacks on social rights have become increasingly bold. If Foucault was not a direct witness of these years, his work on neoliberalism is nonetheless prescient: the question of liberalism occupies an important place in his last works. Since his death, Foucault's conceptual apparatus has acquired a central, even dominant position for a substantial segment of the world's intellectual left. However, as the contributions to this volume demonstrate, Foucault's attitude towards neoliberalism was at least equivocal. Far from leading an intellectual struggle against free market orthodoxy, Foucault seems in many ways to endorse it. How is one to understand his radical critique of the welfare state, understood as an instrument of biopower? Or his support for the pandering anti-Marxism of the so-called new philosophers? Is it possible that Foucault was seduced by neoliberalism? This question is not merely of biographical interest: it forces us to confront more generally the mutations of the left since May 1968, the disillusionment of the years that followed and the profound transformations in the French intellectual field over the past thirty years. To understand the 1980s and the neoliberal triumph is to explore the most ambiguous corners of the intellectual left through one of its most important figures.

As several commentators have observed, something quite remarkable happens in this late work. In his early career, Foucault had been a great critic of the liberal discourse of rights. Suddenly, from about 1976 onward, he makes increasing appeals to rights in his philosophical writings, political statements, interviews, and journalism. He not only defends their importance; he argues for rights new and as-yet-unrecognized. Does Foucault simply revise his former positions and endorse a liberal politics of rights? Ben Golder proposes an answer to this puzzle, which is that Foucault approaches rights in a spirit of creative and critical appropriation. He uses rights strategically for a range of political purposes that cannot be reduced to a simple endorsement of political liberalism. Golder develops this interpretation of Foucault's work while analyzing its shortcomings and relating it to the approaches taken by a series of current thinkers also engaged in considering the place of rights in contemporary politics, including Wendy Brown, Judith Butler, and Jacques Rancière.

Book excerpt: In his recent writings on religion and secularization, Habermas has challenged reason to clarify its relation to religious experience and to engage religions in a constructive dialogue. Given the global challenges facing humanity, nothing is more dangerous than the refusal to communicate that we encounter today in different forms of religious and ideological fundamentalism. Habermas argues that in order to engage in this dialogue, two conditions must be met: religion must accept the authority of secular reason as the fallible results of the sciences and the universalistic egalitarianism in law and morality; and conversely, secular reason must not set itself up as the judge concerning truths of faith. This argument was developed in part as a reaction to the conception of the relation between faith and reason formulated by Pope Benedict XVI in his 2006 Regensburg address. In 2007 Habermas conducted a debate, under the title ‘An Awareness of What Is Missing', with philosophers from the Jesuit School for Philosophy in Munich. This volume includes Habermas's essay, the contributions of his interlocutors and Habermas's reply to them. It will be indispensable reading for anyone who wishes to understand one of the most urgent and intractable issues of our time.
