Book excerpt: This book revisits the discourse theories of Habermas and Foucault in a Chinese context. After arguing that Habermas’s Discourse Theory of Law and Democracy is too normative and idealistic, it presents Foucault’s Discourse Theory of Power Relations to illustrate the tensions between different Western discourse theories. The book then draws on the normative concept of Confucian Rationality from traditional Chinese cultural sources in order to investigate how adaptable these two discourse theories are to the Chinese society, and to balance the tension between them. Presenting these three dimensions of discourse theory, as well as the relations between them, it also uses empirical descriptions of certain facts of political-legal discussion both in traditional China and in the country’s new media age to explain, supplement and question this theoretic framework. The book asserts that, because of the diverse modes of thinking in specific cultures, there might be different normative paradigms of discorse and different political-legal discussion modes across corresponding cultural contexts. Normative discourse theories provide guidance for the practices of deliberative democracy and legal discussions, which can in turn verify, supplement, improve and challenge the normative discourse theories. In addition to demonstrating the multiple dimensions of discourse theories, this research also promotes an approach to the Discourse Theory of Law and Democracy that combines elements of both Chinese and modern society.

Book excerpt: The political writings of the French poststructuralists have eluded articulation in the broader framework of general political philosophy primarily because of the pervasive tendency to define politics along a single parameter: the balance between state power and individual rights in liberalism and the focus on economic justice as a goal in Marxism. What poststructuralists like Michel Foucault, Gilles Deleuze, and Jean-François Lyotard offer instead is a political philosophy that can be called tactical: it emphasizes that power emerges from many different sources and operates along many different registers. This approach has roots in traditional anarchist thought, which sees the social and political field as a network of intertwined practices with overlapping political effects. The poststructuralist approach, however, eschews two questionable assumptions of anarchism, that human beings have an (essentially benign) essence and that power is always repressive, never productive. After positioning poststructuralist political thought against the background of Marxism and the traditional anarchism of Bakunin, Kropotkin, and Proudhon, Todd May shows what a tactical political philosophy like anarchism looks like shorn of its humanist commitments—namely, a poststructuralist anarchism. The book concludes with a defense, contra Habermas and Critical Theory, of poststructuralist political thought as having a metaethical structure allowing for positive ethical commitments.

Book excerpt: Michel Foucault is famous as one of the 20th-century’s most innovative thinkers – and his work on Discipline and Punish was so original and offered models so useful to other scholars that the book now ranks among the most influential academic works ever published. Foucault’s aim is to trace the way in which incarceration was transformed between the seventeenth and twentieth centuries. What started as a spectacle, in which ritual punishments were focused on the prisoner’s body, eventually became a matter of the private disciplining of a delinquent soul. Foucault’s work is renowned for its original insights, and Discipline and Punish contains several of his most compelling observations. Much of the focus of the book is on making new connections between knowledge and power, leading Foucault to sketch out a new interpretation of the relationship between voir, savoir and pouvoir – or, ‘to see is to know is to have power.’ Foucault also dwells in fascinating detail on the true implications of a uniquely creative solution to the problems generated by incarcerating large numbers of criminals in a confined space – Jeremy Bentham’s ‘panopticon,’ a prison constructed around a central tower from which hidden guards might – or might not – be monitoring any given prisoner at any given time. As Foucualt points out, the panopticon creates a prison in which inmates will discipline themselves, for fear of punishment, even when there are no guards present. He goes on to apply this insight to the manner in which all of us behave in the outside world – a world in which CCTV and speed cameras are explicitly designed to modify our behavior. Foucault’s highly original vision of prisons also ties them to broader structures of power, allowing him to argue that all previous conceptions of prison are misleading, even wrong. For Foucault, the ultimate purpose of incarceration is neither to punish inmates, nor to reduce crime. It is to produce delinquency as a way of enabling the state to control and of structure crime.

How is the language we use for violence entangled with the fight against it? In Naming Violence, Mathias Thaler articulates a novel perspective on the study of violence that demonstrates why the imagination matters for political theory. His analysis of the politics of naming charts a middle ground between moralism and realism, arguing that political theory ought to question whether our existing vocabulary enables us to properly identify, understand, and respond to violence. He explores how narrative art, thought experiments, and historical events can challenge and enlarge our existing ways of thinking about violence. Through storytelling, hypothetical situations, and genealogies, the imagination can help us see when definitions of violence need to be revisited by shedding new light on prevalent norms and uncovering the contingent history of ostensibly self-evident beliefs. Heyes notes that Wittgenstein himself was skeptical of political theory, and that his philosophy does not lead naturally or inexorably toward any particular political position. Instead, she says, his ideas motivate certain attitudes toward the "game of politics" that the essays in this volume share: some contributors argue that political theory should use Wittgensteinian methods, others apply Wittgenstein's philosophy of language to figures and debates in areas of political theory (such as post-Kantian genealogy or Habermas's foundationalism), and still others reveal the ways Wittgenstein's concepts inform political foci as diverse as anthropomorphism, defining social group membership, and the nature of liberty.
