Book Forum Non Conveniens in the Modern Age A Comparative and Methodological Analysis of Anglo American Law

Download or read book Forum Non Conveniens in the Modern Age A Comparative and Methodological Analysis of Anglo American Law written by Michael Karayanni and published by BRILL. This book was released on 2021-11-22 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book’s compelling thesis is that the role of the forum non conveniens should be strengthened and even enhanced, particularly in light of modern advancements such as Internet transactions, efficient jet travel and telecommunications facilitating transfer of documents and testimony. Karayanni argues, more importantly, that in order to face technological complexities, the forum non conveniens doctrine needs to undergo a basic transformation. He proposes that American and English law doctrines similar to the forum non conveniens, like the reasonableness test and the forum conveniens doctrine, be integrated. Published under the Transnational Publishers imprint.

Book Transnational Litigation in Comparative Perspective

Download or read book Transnational Litigation in Comparative Perspective written by Stephen C. McCaffrey and published by . This book was released on 2010 with total page 750 pages. Available in PDF, EPUB and Kindle. Book excerpt: Transnational Litigation in Comparative Perspective: Theory and Application is the only casebook that examines the principal issues in transnational litigation from a comparative perspective. Each chapter focuses on a particular core problem that all legal systems must address. The first half of each chapter is devoted to exploring the theoretical context of the issue, thereby enabling students to appreciate the complexity of the problem and to see how achieving a resolution requires balancing competing interests. The second part of each chapter then focuses on how different systems deal with these challenges. Topics covered include protective measures, personal jurisdiction, forum non conveniens, forum selection clauses, state immunity, state doctrine, service of process, gathering evidence abroad, choice of law, and recognition and enforcement of foreign judgments. Distinctive Features *Uses a comparative approach that better prepares future lawyers for international litigation that may be initiated in countries other than the U.S. *Offers a hypothetical at the beginning of each chapter to introduce the fundamental issue; the hypotheticals raise questions that are diagnostic rather than prescriptive, leading to many "right" answers *Accommodates different types of courses--professors who employ a less theoretical approach can use the hypotheticals to ground class discussions *Considers issues unique to arbitration as they arise in connection with the various topics studied

Book Forum Shopping Despite Unification of Law

Download or read book Forum Shopping Despite Unification of Law written by Franco Ferrari and published by BRILL. This book was released on 2021-08-16 with total page 464 pages. Available in PDF, EPUB and Kindle. Book excerpt: According to some commentators, forum shopping is an “evil” that must be eradicated. It has been suggested that the unification of substantive law through international conventions constitutes one way to achieve this outcome. This book shows that the drafting of uniform substantive law convention cannot prevent forum shopping. The reasons are classified into two main categories: convention-extrinsic and convention-intrinsic reasons. The former category comprises those reasons upon which uniform substantive law conventions do not have an impact at all. These reasons range from the costs of access to justice to the bias of potential adjudicators to the enforceability of judgments. The convention-intrinsic reasons, on the other hand, are reasons that relate to the nature and design of uniform substantive law conventions, and include their limited substantive and international spheres of application as well as their limited scope of application, the need to provide for reservations, etc. This book also focuses on another reason why forum shopping cannot be overcome: the impossibility of ensuring uniform applications and interpretations of the various uniform substantive law conventions.

Book Always on the Same Path Volume II

Download or read book Always on the Same Path Volume II written by B. S. Markesinis and published by Hart Publishing. This book was released on 2001-03 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: Markesinis (common and civil law, University College, London) notes that many of the legal doctrines considered uniquely English were actually elaborated by writers conversant with French and German law. He decries the lack of comparative study in present day England and attempts to demonstrate the utility of comparative legal studies in 11 chapters (one written in German). For the most part, the essays explore issues of German law. Specific topics include the horizontal effect of the German human rights bill, tortious liability of statutory bodies, judicial style and reasoning in England and Germany, developing an English law of privacy, and foreign ideas and law in the English Courts. Download or read book Conflicts in a Conflict written by Michael Mousa Karayanni and published by Oxford University Press, USA. This book was released on 2014 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflicts in a Conflict outlines and analyzes the legal doctrines instructing the Israeli courts in private and civil disputes involving the Occupied Palestinian Territories of the West Bank and the Gaza Strip, since 1967 until the present day. This book's compelling thesis is the existence of a close relationship between conflict of laws doctrines as they developed over the years, and Israeli policies generally in respect of the Palestinian Territories. This study of the conflict of laws in a war setting and conflict of laws in a jurisdictionally ambiguous location, will greatly serve scholars and practitioners in similarly troubled and complex legal situations elsewhere.
