The desert landscape is contrasted by the Verde River, which flows north to south through the reservation. Thirty miles east of Fort McDowell, the Four Peaks rise from the desert floor to an elevation of more than 7,000 feet. The reservation is a parcel of land once inhabitant by the Nomadic Yavapai people, who hunted and gathered food in Arizona desert lowlands and mountainous Mogollon Rim country. The reservation is governed by a Tribal Council elected by tribal members pursuant to the Tribe's Constitution. The Fort McDowell Yavapai Nation takes pride in its economic development and the expansion of direct services to meet the changing needs of all tribal members while at the same time preserving traditional values.

Book excerpt: In the 1970s, the Fort McDowell Reservation in Arizona came under threat by a dam construction project that, if approved, would potentially flood most of its 24,680 acres of land. As part of the effort to preserve the reservation, Mike Harrison and John Williams, two elders of the Yavapai tribe, sought to have their history recorded as they themselves knew it, as it had been passed down to them from generation to generation, so that the history of their people would not be lost to future generations. In March 1974, Arizona State University anthropologist Sigrid Khera first sat down with Harrison and Williams to begin recording and transcribing their oral history, a project that would continue through the summer of 1976 and beyond. Although Harrison and Williams have since passed away, their voices shine through the pages of this book and the history of their people remains to be passed along and shared. Thanks to the efforts of Scottsdale, Arizona, resident and Orme Dam activist Carolina Butler, this important document is being made available to the public for the first time. Oral History of the Yavapai offers a wide range of information regarding the Yavapai people, from creation beliefs to interpretations of historical events and people. Harrison and Williams not only relate their perspectives on the relationship between the “White people” and the Native American peoples of the Southwest, but they also share stories about prayers, songs, dreams, sacred places, and belief systems of the Yavapai.

There is a relatively consistent body of law whose origins flow from precolonial America to the present day. This body of law is neither well-known nor well-understood by the American Public. Federal Indian law - or, more accurately, United States constitutional law concerning Indian tribes and individuals - is unique and separate from the rest of American jurisprudence. Analogies to general constitutional law, civil right law, public land law, and the like are misleading and often erroneous. Indian law is distinct. It encompassed Western European international law, specific provisions of the United States Constitution, precolonial treaties, treaties of the United States, an entire volume of the United States Code, and numerous decisions of the United States Supreme Court and lower federal courts.The nature of the federal, state, and tribal relationship was defined in a highly politicized setting, when the Supreme Court of the United States, led by chief Justice John Marshall, struck down an entire series of state statutes violative of tribal-state and tribal-federal relations. These cases established the principles that Indian tribes possessed sovereignty over their members and territory and that the federal government protects tribal sovereignty, land, and resources from states and non-Indian interests.The Supreme Court of the United States has specifically addressed the issue of whether specialized treatment of Indians by the federal government is unconstitutional racial discrimination. The clear answer of the Court was that it is not. Who are the members of tribes, and how are they chosen? Tribes in Canada, Australia, New Zealand and the United States are now obliged to adopt written constitutions as a condition of recognition, and to specify the criteria used to select members. Tribal Constitutionalism presents findings from a comparative study of nearly eight hundred current and historic tribal constitutions, most of which are not in the public domain. Kirsty Gover examines the strategies adopted by tribes and states to deal with the new legal distinction between indigenous people (defined by settler governments) and tribal members (defined by tribal governments). She highlights the important fact that the two categories are imperfectly aligned. Many indigenous persons are not tribal members, and some tribal members are not legally indigenous. Should legal indigenous status be limited to persons enrolled in recognized tribes? What is to be done about the large and growing proportion of indigenous peoples who are not enrolled in a tribe, and do not live near their tribal territories? This book approaches these complex questions head-on. Using tribal membership criteria as a starting point, this book provides a critical analysis of current political and sociolegal theories of tribalism and indigeneity, and draws on legal doctrine, policy, demographic data and tribal practice to provide a comparative evaluation of tribal membership governance in the western settler states.
