Book The Rules of Pleading Under the New York Code and the Codes of Other States and the Practice Relating to Pleading

Download or read book The Rules of Pleading Under the New York Code and the Codes of Other States and the Practice Relating to Pleading written by Edwin Baylies and published by Forgotten Books. This book was released on 2017-10-11 with total page 824 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Rules of Pleading Under the New York Code and the Codes of Other States, and the Practice Relating to Pleading: With an Appendix of Forms New York Code of Civil Procedure, would be found of use to the practitioner in other Code States. In addition to the statement of the rules of pleading, a few chapters of the book have been devoted to the practice relating to pleading, and an appendix of forms is given. These forms are intended rather as suggestions than as precedents, for under the present system, precedents of pleadings are of doubtful value. Each cause of action set forth in a pleading must stand or fall upon the facts of that particular case; and no collection of forms can furnish a system of ready-made pleadings, though it may serve as a reminder of a necessary allegation that other wise would have been omitted. The general plan of the work appears in the table of contents, and the matters of detail in the index. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book A Treatise on Pleading and Parties to Actions with Second and Third Volumes Vol 1 Of 3

Download or read book A Treatise on Pleading and Parties to Actions with Second and Third Volumes Vol 1 Of 3 written by Joseph Chitty and published by Forgotten Books. This book was released on 2017-11-09 with total page 878 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Pleading, and Parties to Actions, With Second and Third Volumes, Vol. 1 of 3: Containing Precedents of Pleadings, and an Appendix of Forms Adapted to the Recent Pleading and Other With Practical Notes The Editor was induced to adopt that course, because sufficient reason appeared to him to exist for not presenting to the Profession in the United States a set of Precedents, which, in the numerous jurisdictions of the Union, would not be considered as having the stamp of authority. He still thinks that his view was correct, and has adhered to it in preparing the present edition. The Precedents under the New Rules are very con cise and convenient; but it would be presumption in the Editor, upon his own view of their superior utility, to offer them instead of those which, from long adoption and use, have the weight of judicial decision. An Appendix of Forms in Assumpsit, adapted to the New Rules, from the second volume of the new London edition, is inserted at the end of the third volume of the seventh American, and of this edition. Book A Treatise on Pleading Vol 2 of 3

Download or read book A Treatise on Pleading Vol 2 of 3 written by Joseph Chitty and published by Forgotten Books. This book was released on 2018-02-24 with total page 722 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Pleading, Vol. 2 of 3: With a Collection of Precedents and an Appendix of Forms Adapted to the Recent Pleading and Other Rules, With Practical Notes But the term Precedents, in all these cases, denotes a document that has been long in use, and not a mere novel invention, which, for the above rea son, cannot safely be relied upon, as has been unfortunately frequently ex emplified by the numerous successful demurrers to new forms of pleas re cent] y invented in consequence of the necessity to plead almost every matter of defense Specially. For this reason the following collection, with a few ex ceptions and subject to the introduction of alterations required by the new rules, was nearly forty years ago made by the author, not of his own plead ings, or those of any living practitioner, but from higher sources; and for the same reason he begs that every practitioner. When he adopts one of the new forms introduced into this edition, will consider the same merely as intended to assist, and not entirely confided in, unless prescribed by statute or rule of Court, or sanctioned by express decision. It may here be proper to state the history of the greater part of the pre cedents collected in this and the next volume. The author had the good for tune to commence his legal studies under the directions of his relatives, the late Mr. Serjeant George Bond and Mr. Luders, who obtained for him the privi logo of access to the best pleadings adopted, prepared, settled, or otherwise sanctioned and constantly used by those eminent pleaders, most of them after wards judges, viz. Wallace, Warren, Buller, Chambre, Gibbs, Bond, Wood, Holroyd, Law, Abbot, 8m. 8m. 'these forms (i might say from time to time immemoriall y) had been improved with great care, after having been trans lated from the old entries. The author also selected some excellent original forms from the original demurrer books of Mr. Justice Ashurst, with his valuable notes and observations (j). This entire collection was deficient only in the precedents in assumpsit. The author was enabled to supply that chasm during his pupilage under Mr. Tidd, who evinced peculiar skill and perspicuity in his pleadings in that form of action, which, of necessity, in its Special counts discloses so much of the plaintifi' 's cause of action.
