Book excerpt: Over the last few decades, the prison populations in European countries have grown and their profiles have changed. There are more than 100,000 foreign prisoners in European countries. Their numbers vary greatly from country to country, but the average percentage of foreigners in the total European prison population is over 20%. Why are foreigners over-represented in European prison populations? Who are they and on what grounds are they held in detention? Are foreign prisoners more vulnerable due to language difficulties, cultural differences, and their distance from relatives? Are they being socially excluded? Is their treatment and legal position different from other prisoners? And, how are national prison systems and other authorities addressing this issue? Funded by the European Commission, this extensive study - developed within the framework of the EU program "Social Exclusion" - offers an answer to the questions stated above. With this, a distinction is made between foreigners who are detained for committing a crime - or are suspected of one - and foreigners whose deprivation of liberty is based on migration law. Originally published as a two volume set in 2007, this comprehensive single volume reprint contains country reports of twenty-five EU Member States, as well as six reports of organizations which contributed to the research. The first chapter presents a comparative overview with conclusions and recommendations. At the end, a detailed bibliography will be given which includes relevant websites and legal documents.

The first edition was one of the earliest to establish that the newly-developing international law of human rights could be set down as any other branch of international law. It also incorporates the complementary fields of international humanitarian law and international criminal law, while addressing the problems associated with their interaction with human rights law. The book is more than a descriptive analysis of the field. It acknowledges areas of unclarity or where developments may be embryonic. Solutions are offered. Recent developments have confirmed the value of solutions proposed in this edition and the previous one. Central to most of the chapters is the human rights norm of most salience in the treatment of prisoners, namely, the prohibition of torture and cruel, inhuman or degrading treatment or punishment. The early chapters focus on the period of first detention, when detainees are most at risk of having information or confessions, however unreliable, extracted by unlawful means. Voices contemplating the legitimacy of such treatment to combat terrorism have been heard in the wake of the atrocities of 11 September 2001. The book finds that the evidence clearly suggests that the absolute prohibition of such treatment remains firm. Other chapters deal with problems of poor prison conditions and of certain extraordinary penalties, notably corporal and capital punishment. A chapter explores ethical codes for members of professions capable of inflicting or preventing the prohibited behaviour (police and medical and legal professionals). Chapters are also devoted to the extreme practice of enforced disappearance and the contribution of the new convention on this phenomenon, as well as to extra-legal executions.

Through select granular experiences of detention over the course of more than 140 years, this book explains how America built the world's largest system for imprisoning immigrants. From the late nineteenth century, when the US government held hundreds of Chinese in federal prisons pending deportation, to the early twentieth century, when it caged hundreds of thousands of immigrants in insane asylums, to World War I and II, when the Federal Bureau of Investigation (FBI) declared tens of thousands of foreigners "enemy aliens" and locked them up in Immigration and Naturalization Service (INS) camps in Texas and New Mexico, and through the 1980s detention of over 125,000 Cuban and almost 23,000 Haitian refugees, the incarceration of foreigners nationally has ebbed and flowed. Book excerpt: After a year in which prisons held a record number of prisoners, the prison system remains under pressure, and important lessons must be learnt if prisons are to be safe and effective. Despite sustained and chronic pressure, the report recognises progress over the past year. Overall, the Inspectorate's assessments of prisons inspected last year were more positive than those of prisons inspected the previous year, particularly in resettlement work. The number of self-inflicted deaths also decreased last year. The Chief Inspector identifies a number of warning signs, and new concerns: growing concerns about safety, particularly in dispersal prisons and young offender institutions, and rates of self-harm among women; unsuitable, cramped or unhygienic accommodation in some prisons; difficulties in complying with duties under the Disability Discrimination Act, and other equality duties; low activity levels in too many training prisons; the growing problem of alcohol misuse and the limited investment in this in prisons or the community; the potential effect of the recession on prisoners' employment and resettlement prospects. The report also refers to the inspection of immigration detention and the new inspection programme on police custody. Immigration removal centres were, on the whole, less safe and respectful than those inspected last year, though activity and welfare support had improved. The detention of children remains a major concern and is ripe for review. Inspections of police custody, jointly with the Inspectorate of Constabulary, have confirmed much good practice, but also revealed some deficiencies.
