Book excerpt: With just over sixteen months to go before the Scottish referendum there are still significant gaps in the Scottish Government's proposed foreign policy, according to a report published today by the Foreign Affairs Committee. There has not been enough analysis on what sort of overseas diplomatic network and external security and intelligence provision Scotland would have to set up. There needs to be a more realistic assessment of the extent to which Scotland could expect the rest of the UK (RUK) to co-operate with, and support it, on security and intelligence. There is a pressing need for official legal advice on a wide range of international legal issues including EU accession, EU opt-outs and membership of international organisations. The Report says that the overwhelming body of law, evidence, practice and precedent supports the view that the RUK would inherit the vast majority of the UK's international rights and obligations whereas Scotland would start anew internationally if it became independent. Having two co-equal states could lead to a level of legal and political insecurity that would not be tolerated by other states. The report disputes the view that Scotland's journey towards membership of the EU and NATO would be straightforward. It is for the EU itself to determine in accordance with its regulations whether and how Scotland would become a member. Scotland may have to make trade-offs to secure the unanimous support it would need from within the EU.

How much would it cost to equip, support and train an independent Scotland's armed forces and how much of this could be procured and delivered domestically? And how many jobs in the defence sector would be placed at risk? The Committee also raises detailed questions about the proposed Scottish defence force: the numbers and types of aircraft and naval vessels which would be needed and how they would be procured and maintained; the numbers of combat troops the Scottish Government envisages (including its plan to re-instate historic Scottish regiments); and the availability of training facilities to maintain the appropriate professional standards. In the event of independence, the defence industry in Scotland would face a difficult future.

Book excerpt: This reports finds that the Coalition Government has developed in public a more mature and measured relationship with the US, although there has been no fundamental change in the nature of the tie. The Committee declares the relationship to be in good health. In particular, the Committee said that it was not aware of any evidence that the House of Commons vote in August 2013 against potential military action in Syria had damaged the UK's relationship with the US. Rather, the Committee concluded that the episode illustrated general features of the UK-US relationship, namely that developments in the UK could influence US policy; and that the underlying tie was resilient. Today's publication follows up a report produced by the previous Foreign Affairs Committee at the end of the last Parliament, which recommended that the UK Government should adopt a more hard-headed and less deferential approach to the US. The Coalition Government seemed to have taken up this recommendation. The Committee criticises the UK Government's poor provision of information about the UK-US Joint Strategy Board, which was created during President Obama's State Visit to the UK in May 2011. Among strategic issues that it considered, the Committee agreed with the Government that the proposed EU-US Transatlantic Trade and Investment Partnership (TTIP) could have significant positive strategic impact for the UK and the transatlantic relationship.

The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.

The most explicit pledges made to date include: that the whole cost of security and defence will be no more than £2.5 billion, that personnel in the armed services will total 15,000 full time and 5,000 reserve personnel, and that the defence force will include "current Scottish raised and restored UK regiments". Will we then have a defence force which is army heavy? An army which is infantry heavy? Or will historic regiments be redesignated as platoons, reserves or non-infantry units? If Faslane is to be kept at its existing workforce, how will people be retrained? What costs will be inccurred in the transition to the new Scottish Defence Force? What are the implications for procurement whether or not Scotland gets the assets it wants? Hanging over all of this is the future of Trident. Will a separate Scotland impose unilateral nuclear disarmament on the UK? Furthermore, membership for Scotland of NATO will require not only the unanimous agreement of all the existing NATO members, but also the resolution of any disputes with the UK. The Scottish Government must spell out what wages and conditions it would propose to offer to compensate those who would leave behind participation in world class armed services. The people of Scotland are entitled to expect that those who propose drastic change can explain what the consequences would be.

For this reason, a security union is closely connected to the existence of a political union. The creation of an independent Scottish state would see an end to the current arrangements for ensuring Scotland's security, as Scotland, including Police Scotland, would no longer be part of the UK's national security infrastructure and capabilities. In practical terms this means that the present level of strategic and operational communication and co-ordination that occurs everyday across the UK, with Scotland playing a key role within it - whether concerned with counter-terrorism, fighting serious and organised crime or protecting against cyber threats - would end

It is also a haven of tolerance and stability in a critically unstable region where those values are needed more than ever. It has huge strategic value to the UK as a bridge to other regional powers, is a key bulwark against ISIL, and has significant oil and gas potential. But it is also vulnerable and needs the support of its friends. It should respond positively to the invitation from the Kurdistan Regional Government (KRG) to be its "partner of choice" on trade, education and cultural exchange as well as on defence and intelligence matters. The Kurdistan Region has work to do on developing its democratic culture and its respect for human rights, and UK support should go hand in hand with proof of progress in these areas. The Committee commends the Region's defence force, the Peshmerga, for its defence of Kurdish territory against ISIL and its protection of vulnerable minorities. It supports the UK Government's decision to offer the Peshmerga equipment and training. Advice is also needed from the Kurdistan Region's experts on issues like counter-terrorism and on the situation on the ground in Iraq and Syria. More diplomats need to be working out of a proper office in Erbil instead of hotel rooms. And this is not easily achieved as the FCO has suffered from cuts to its meagre budget at a time when more expertise and high-level co-operation is desperately needed.

Book excerpt: Proposals for reforms for the EU as a whole are likely to find a more favourable reception than possible requests for further 'special treatment' for the UK. The Committee is sceptical that other Member States would be willing to renegotiate existing EU law so as to allow the UK on its own to reduce its degree of integration, especially where this could be seen as undermining the integrity of the Single Market. Other Member States appear to want the UK to remain an EU Member. Closer Eurozone integration is a potential risk to the position of the UK and other non-Eurozone states in the EU. However, the December 2012 agreement on the Single Supervisory Mechanism for banking regulation shows what the UK can achieve to protect its position. The Eurozone is in any case far from a homogenous bloc and the expansion and closer integration of the Eurozone does not therefore necessarily render the UK's position in the EU impossible or worthless. This report does not examine whether the UK should remain in the EU or withdraw. However, it agrees with the Government that, if the UK were to leave the EU, the current arrangements for relations with the EU which are maintained by Norway or Switzerland would not be appropriate for the UK. If it is in the UK's interest to remain in the Single Market, the UK should either remain in the EU, or launch an effort for radical institutional change in Europe to give decision-making rights in the Single Market to all its participating states

Book excerpt: The cuts imposed on the FCO since 2010 have been severe and have gone beyond just trimming fat: capacity now appears to be being damaged. If further cuts are imposed, the UK's diplomatic imprint and influence would probably reduce, and the Government would need to roll back some of its foreign policy objectives. The FCO's budget is a tiny element of Government expenditure, but the FCO makes disproportionate contribution to policy making at the highest level, including decisions on whether to commit to military action. The next Government needs to protect future FCO budgets under the next Spending Review.

Historic warm relations between the UK government and the leaders of Saudi Arabia and Bahrain are not mirrored in public opinion in Saudi Arabia and the UK, and the UK's reputation in Bahrain has also suffered since 2011. The Government must make its public profile and reputation a more central part of its work in the Gulf, consider how it can best support much-needed economic and political reforms, and how it can explain its policies and point to specific achievements when speaking to the public at home and in the Gulf. In Saudi Arabia, the Government must convert its promising steps so far in providing assistance on legal and judicial reform into solid and reportable programmes. In Bahrain, it must work to secure access for NGOs and the UN Special Rapporteur on Torture, and press more strongly for swifter implementation of reforms. Saudi Arabia's role as a key buyer for the UK defence industry is controversial but the report finds little to suggest that ending defence sales from the UK would have any positive effect. The aggressive way in which the Bahraini security forces handled events in 2011 has deeply damaged Bahrain's reputation. The recommendations of the Bahrain Independent Commission of Inquiry (BICI) were sensible and the Bahraini government's failure fully to implement them is inexplicable.
