Book excerpt: The Arms Export Control Act gives the President authority to sell defense articles and services to eligible foreign countries, generally at no cost to the U.S. government. While the Defense Security Cooperation Agency (DSCA) has overall responsibility for administering the FMS program, the Army, Navy, and Air Force generally execute the sales agreements-commonly referred to as sales cases. Foreign military sales are made on an individual case basis. A foreign country representative initiates a case by sending a letter of request to DOD asking for information, such as the price and availability of goods, training, technical assistance, follow-on support, or other services. Once the customer decides to proceed with the purchase, DOD prepares a Letter of Offer and Acceptance (LOA) stating the terms of the sale for the items and services being provided. After the LOA is accepted, the FMS customer is generally required to pay, in advance, amounts necessary to cover costs associated with the services or items purchased from DOD. The Department of the Treasury holds these advance payments in an FMS trust fund.

Book excerpt: The Air Force lacked adequate management controls over its foreign military sales (FMS) program to ensure that foreign customers' accounts were properly charged for goods and services. GAO's analysis of data maintained by the Defense Finance and Accounting Service indicates that the Air Force may not have charged foreign military sales customers for as much as $540 million worth of delivered goods and services. The Air Force recognizes that it must improve its controls over the program and develop the data needed to identify instances in which foreign customers' accounts have not been charged for goods and services received. However, according to Air Force officials, the data are going to be made available only on an ad hoc basis, meaning that they will not be routinely available to the appropriate personnel for review, including managers, with the requirement that they use the information to ensure that customers' accounts are being properly charged.

Book excerpt: Pursuant to a congressional request, GAO reviewed Department of Defense (DOD) efforts to correct long-standing accounting problems in its Foreign Military Sales (FMS) Program. GAO found that, since March 1988, DOD has: (1) terminated the current central FMS accounting system development effort, citing its excessive costs, schedule delays, and unsatisfactory testing results; (2) transferred responsibility for central FMS accounting from the Defense Security Assistance Agency (DSAA) to the Air Force for development, implementation, and operation of a new system; (3) directed the establishment of a new FMS trust fund by October 1989; (4) directed DSAA to reconcile balances in both the existing and new FMS trust funds; and (5) not clarified the role of the Reconciliation and Case Closure Board in this reorganized effort. GAO believes that, to improve FMS accounting controls and effectively implement its latest initiatives, DOD needs to implement accounting controls to ensure that: (1) the old and new trust funds do not become commingled; (2) military departments transmit and record accurate and complete data in the central FMS system; and (3) central records contain sufficient information to facilitate precise identification and timely resolution of imbalances.

Book excerpt: From 1990 through 2001, the Department of Defense delivered over $138 billion in services and defense articles--including classified and controlled parts--to foreign governments through its foreign military sales programs. Classified spare parts are restricted for national security reasons, while controlled parts contain technology that the military does not want to release. GAO was asked to review the Air Force's internal controls aimed at preventing countries from requisitioning and receiving classified or controlled spare parts that they are ineligible to receive. The Air Force's internal controls for its foreign military sales program using blanket orders are not adequate, placing classified and controlled spare parts at risk of being shipped to countries not authorized to receive them. The Air Force's system has erroneously approved foreign country requisitions for classified and controlled spare parts based on incorrect federal supply classes. The system approves items for shipment based in part on an item's federal supply class--not the item's entire national stock number, which is a combination of the supply class number and a part number unique to the item. GAO found that because the system was not properly programmed and countries used unrestricted supply class numbers, the system erroneously approved 35 of 123 selected requisitions reviewed. For example, one country ordered a controlled outline sequencer used on various aircraft by using a supply class that was unrestricted, but incorrect for the part it requisitioned. Because supply class 1680 was not restricted and the system did not verify that 1680 was the correct supply class for national item identification number 010539320, the system approved the requisition. Had the system validated the entire 13-digit national stock number, it would have found that the number was incorrect and would not have approved the requisition. In addition, the Air Force has no written policies or procedures in place for recovering items that have been shipped in error. The Air Force has not validated modifications to the Security Assistance Management Information System that restrict parts available to foreign countries and has not tested the system since 1998 to ensure that it is working properly. Because modifications were not validated, the Air Force did not detect improperly made modifications to the system, and foreign countries were able to requisition and obtain controlled spare parts that, at the time, the Air Force was trying to restrict. GAO identified 18 instances in which countries requisitioned and received a controlled part for which they were not eligible because programmers had entered the restrictions in the wrong area of the system. Although Air Force officials subsequently told us that the part was improperly restricted, this example nevertheless demonstrates the need to validate system changes. Air Force command country managers did not always document reasons for overriding the recommendations of the system or the foreign military sales case manager. For 19 of the 123 requisitions GAO reviewed, command country managers overrode the system recommendations and shipped classified and controlled spare parts without documenting the reasons for overriding the system. Book excerpt: In fiscal year 2008, the Foreign Military Sales (FMS) program sold over $36 billion dollars in defense articles and services to foreign governments. The Departments of State, Defense (DOD), and Homeland Security (DHS) all have a role in the FMS program. In 2003, GAO identified significant weaknesses in FMS control mechanisms for safeguarding defense articles transferred to foreign governments. In 2007, GAO designated the protection of technologies critical to U.S. national security a high-risk area. GAO was asked to (1) evaluate program changes State, DOD, and DHS have made since 2003 to ensure that unclassified defense articles transferred to foreign governments are authorized for shipment and monitored as required, and (2) determine what information DOD has to administer and oversee the FMS program. GAO conducted 16 case studies; analyzed U.S. port data and FMS agreements; reviewed program performance metrics; and interviewed cognizant officials. GAO is making recommendations to State, DOD, and DHS to improve the procedures, processes and information critical for shipment verification, monitoring, and administering the FMS program. State and DHS concurred; DOD concurred with two recommendations and partially concurred with three. GAO believes all recommendations remain valid.
