The argument is based on the international law principle that, where a state fails to protect a vulnerable group of people from harm, whether perpetrated by the state or private actors, it has breached its obligations to protect against human rights violation. This book provides a comprehensive legal analysis for why a state should be accountable in international law for allowing women to suffer extreme forms of domestic violence and how this can help individual victims. It is irrelevant that the violence is perpetrated by individuals and not state actors such as soldiers or the police. The state's breach of its responsibility is in its failure to act effectively in domestic violence cases; and in its silent endorsement of the violence, it becomes complicit. The book seeks to reformulate academic and political debate on domestic violence and the responsibility of states under international law. One of the most prominent controversies has been the wearing of the headscarf by some Muslim women. Since 2004, half of Germany's 16 states have introduced laws prohibiting public school teachers (and other civil servants in several states) from wearing the headscarf at work. The eight other German states have no such restrictions. Some of the laws banning religious symbols and dress exempt Christian symbols. The bans in Germany are neither necessary nor justified. Where there are concrete concerns that a teacher's conduct breaches the duty to ensure that schools remain neutral on questions of religion and ideology, they should be addressed through ordinary disciplinary procedures, on a case-by-case basis. Teachers should be assessed on the basis of their actions, not views imputed to them by virtue of religious dress.

While this might be so, it must be complemented by the necessary financial and human resources to make the law effective. Natalie Persadie explains that, among developing countries, such as Trinidad and Tobago, the achievement of legal advances for women—at either the international or national levels—is particularly difficult where practical measures are not subsequently implemented. This is, perhaps, attributable to a lack of political will. Important issues such as gender equality and domestic violence are not given priority and laws aimed at protecting women and promoting women’s rights are ineffective, scant, or unenforced. Gender justice can only be realized through a multilevel approach from above and, more importantly, from below, as women have the potential to effect real national and international legal and institutional change to ensure gender equality at both levels.
