Book Regulation of Fixed term Employment Contracts

Download or read book Regulation of Fixed term Employment Contracts written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2010-01-01 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent decades enterprises worldwide have reaped advantages of hiring employees on a contractual fixed-term basis, thus derogating from their traditional participation in the social protection of workers and insulating themselves from legal liability for unjust dismissal. A broad spectrum of effectiveness has emerged in this development, as different countries have adopted varying measures to regulate the conditions under which fixed- term employment contracts are written, applied, and interpreted. This important book --- which reprints papers submitted to the 10th Comparative Labour Law Seminar of the Japan Institute for Labour Policy and Training held in Tokyo on 8 and 9 March 2010 - details the regulatory approaches to fixed-term contracts in major industrial jurisdictions in Asia and Europe, providing an opportunity to explore normative directions for labour law and policy in the age of a diversified workforce. Nine Knowledgeable and experienced contributors describe and analyse the legal status of fixed-term employment contracts (including relevant case law) in Australia, Britain, China, France, Germany, Japan, Korea, Sweden, and Taiwan. Each author takes into account evaluations from scholars, policymakers, and stakeholders to his or her country's regulatory approach to fixed-term employment contracts, revealing an array of responses ranging from a view that such contracts enhance employment opportunities in society to advocating suppression of their use as inherently abusive and discriminatory. The combined effect of these nine essays is to greatly increase our awareness of the nature of fixed-term employment contracts, from their fundamental value as social policy instruments to their inextricable connection with the law of dismissal. The book sets the stage for deeper and more firmly grounded work that promises to elucidate the underlying pattern of a new employer-employee relationship emerging on a worldwide scale.

Book Globalization Uncertainty and Women s Careers

Download or read book Globalization Uncertainty and Women s Careers written by Hans-Peter Blossfeld and published by Edward Elgar Publishing. This book was released on 2006-06-27 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalization, Uncertainty and Women's Careers assesses the effects of globalization on the life courses of women in thirteen countries across Europe and America in the second half of the 20th century. The book represents the first-ever longitudinal analysis of micro-level data from these OECD countries focusing exclusively on women's relationship to the labor market in a globalizing world. The contributors thoroughly examine women's employment entries, exits and job mobility and present evidence of women's increased labor market attachment and reduced employment quality in most of the countries studied. They also systematically consider the life course changes influenced by larger transformations in society and, in doing so, explicitly link the phenomena of globalization to individual women's lives in Europe and North America.

Book Front Line Workers in the Global Service Economy

Download or read book Front Line Workers in the Global Service Economy written by Giovanna Fullin and published by Routledge. This book was released on 2021-06-17 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: Walking around the commercial streets of New York, San Francisco, Milan, London, or Paris and looking at the succession of multinational chain stores’ windows, you can easily forget what country you are in. However, if you hear the small talk among the employees, you hear very different stories. In New York, a 30-year-old woman is worried because she does not know if she will work enough hours to make a living the following week—whereas, in Milan, a mother of the same age knows she will work 20 hours a week but is concerned about whether her contract will be renewed at the end of the following month. Following three years of fieldwork, which included 100 in-depth interviews with front-line retail workers and unionists in New York City and Milan, Front-Line Workers in the Global Service Economy investigates both the lived experiences of salespersons in the "fast fashion" industry—a retail sector made of large chains of stores selling fashion garments at low prices—and the possibilities of collective action and structured forms of resistance to these global trends. In the face of economic globalization and vigorous managerial efforts to minimize labor costs and to standardize the retail experience, mass fashion workers’ stories tell us how strong the pressure toward work devaluation in low-skilled service sectors can be, and how devastating its effects are on the workers themselves.

Book Globalization Uncertainty and Men s Careers

Download or read book Globalization Uncertainty and Men s Careers written by Hans-Peter Blossfeld and published by Edward Elgar Publishing. This book was released on 2006-01-01 with total page 536 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalization, argue the contributors to this book, has remarkably accelerated social and economic change in modern societies. One such change is manifested in the world of work and careers. This book explores whether the forces of globalization affect the erosion of standard career patterns of mid-career men in twelve OECD countries. Overwhelming evidence against the 'individualization of inequality' thesis is provided - it is argued that equality remains largely stratified by factors such as occupational class and educational level, and in some countries has even grown over time.

Available in PDF, EPUB and Kindle. Book excerpt: The Labor Law of the People’s Republic of China, originally promulgated in 1994, has undergone many changes and continues to be subject to judgments and arbitral awards arising from disputes and such claims as breaches of labor contract and denial of benefits. This book provides most updated, detailed, and comprehensive interpretation of Chinese labor law issues, focusing on detailed analysis of twenty leading cases. The first part of the book describes in depth the role of labor law in Chinese society, elaborating on its development and its characteristic features. The cases that follow, each described in minute detail, thoroughly explicate the issues that underlie the dynamic growth of Chinese labor law, such as the following: establishment and identification of the employment relationship; performance, change, dissolution, and termination of the employment contract; determining atypical employment relationships; fiduciary duties; health insurance provisions; work-related injury; labor dispatching service; legal remedies—mediation, arbitration, litigation; labor inspection; legal issues on foreigners’ employment in China; violation of rights to privacy, human dignity, and equal employment; enterprise dissolution or merger; employer’s right to dismissal; economic compensations arising from illegal dismissal; and worker’s damages arising from illegal dissolution of the employment contract. The carefully selected cases span the full range of labor law issues, with perspectives from parties to the action, attorneys, and judicial personnel as well as the editor’s expert analysis of the legal principles, statutes, and case law involved. This English translation of a book published in 2016—the first to focus on labor and employment-related issues in China in a comprehensive way via case law—will help the international community to understand China’s labor law environment and its current achievements.
