Book excerpt: The United States faces a constantly evolving threat from terrorist organizations and individuals who wish to do harm to do harm to its assets and citizens. In 2004, as a response to the 9/11 attacks, the structural organization of the agencies that comprise the U.S. Intelligence Community was changed under the Intelligence Reform and Terrorism Prevention Act. The goal of the transformation was to enhance the ability and effectiveness of those that are supposed to maintain national security. Coordination and information sharing between the agencies in the IC is essential to ensure that the relevant actors have the knowledge and authority necessary to give warning, take action, and adequately inform policy makers. Many of the agencies in the Intelligence Community share overlapping responsibilities, yet also have their own unique and specific purposes. They fall under several different cabinet level departments, and must accommodate widely varied leadership structures and policy guidelines. However, in accordance with the Intelligence Reform and Terrorism Prevention Act the Intelligence Community has been directed to operate under the authority of the Director of National Intelligence. Based on the community's current organizational structure derived from the IRTPA, this paper evaluates if and how the Director of National Intelligence and the Intelligence Community will be successful in enhancing cohesion. The findings illustrate that, because of the structure and the authority granted to the Director, adequate coordination among agencies is unlikely. Furthermore, this paper shows that designing a policy that focuses on and empowers middle managers will provide the ideal solution. A solution in which a synthesis of top-down and bottom-up approaches to policy implementation is the most practical model.

Book excerpt: The establishment of the Department of Homeland Security (DHS) and passage of the Intelligence Reform and Terrorism Prevention Act (IRTPA) shortly after the terrorist attacks of September 11, 2001, collectively constitute the most significant bureaucratic shakeup of the national security apparatus since the National Security Act of 1947. Roughly 10 years following the creation of DHS, questions linger as to whether these reforms have addressed the major domestic intelligence shortfalls identified in numerous post-9/11 congressional hearings and in the final report of the 9/11 Commission.This book seeks to answer those questions by examining the performance of the U.S. domestic intelligence system since 9/11 along three fronts: intelligence fusion, institutional evolution, and intelligence prioritization. Citing the literature from current and former homeland security practitioners, academic experts, non-partisan analysts, and print media commentators, this report concludes that while key measures of progress on these fronts have been observed, shortfalls within the domestic intelligence system do nevertheless remain, requiring further oversight and guidance from federal homeland security policymakers.

Book excerpt: The commission to investigate the September 11, 2001, terrorist attacks on the United States issued its final report in July of 2004, in which it recommended a dramatic overhaul of the nation's intelligence system. Congress responded by hastily enacting the Intelligence Reform and Terrorism Prevention Act of 2004, which adopts many of the 9/11 commission's specific recommendations, though with a number of alterations. Richard A. Posner, in the first full-length study of the post-9/11 movement for intelligence reform, argues that the 9/11 commission's analysis, on which Congress relied, was superficial and its organizational proposals unsound. The commission, followed by Congress, exaggerated the benefits of centralizing control over intelligence; neglected the relevant scholarship dealing with surprise attacks, organization theory, the principles of intelligence, and the experience of foreign nations, some of which have a longer history of fighting terrorism than the United States; and as a result ignored the psychological, economic, historical, sociological, and comparative dimensions of the issue of intelligence reform. Posner explains, however, that a ray of hope remains: the reorganization provisions of the new Act are so vague, as a result of intense politicking, that the actual shape of the reorganized system will depend critically on decisions made by the President in implementing the Act. In a searing critique, Posner exposes the pitfalls created by the new legislation, identifies the issues overlooked by the 9/11 commission and Congress, and suggests directions for real reform. By the nature of IC's design it is secretive and operates behind the scenes. True intelligence reform entails opening this closed society to organizations that do not routinely interact with the IC. This aspect alone is a sharp deviation from the normal intelligence modus operandi that will have to shift from the current 'need to know' mentality toward a 'need to share' collaborative environment. The IC community is transforming in stride while simultaneously supporting the Global War on Terrorism. The establishment of the first Director of National Intelligence is a progressive step toward unifying the 16 organizations under one centralized management authority. The DNI must quickly establish and publish common tactics, techniques and procedures that will unite the IC's efforts in a collaborative work environment. Predictive analysis will enable the civilian leadership and military warfighters to formulate viable courses of action based on the fidelity of the intelligence collected as prioritized by the National Security Strategy. Change in the intelligence community will take time, but strong leadership coupled with clear guidance from the DNI will focus this diverse community and continue to push reform and transformation initiatives forward to build a strong, integrated coalition of intelligence professionals prepared to address an ambiguous global threat."--Abstract.

Book excerpt: The terrorist attacks on 11 September 2001 in New York, Virginia, and Pennsylvania caused an intense self-examination by the United States Federal Government in which it made tough decisions concerning the use of foreign intelligence in relation to law enforcement activities. Existing constraints to collection of foreign intelligence, dissemination to law enforcement agencies, and placement in information databases created a "wall" between the Intelligence Community and the law enforcement agencies. Since 9/11, several key actions have worked to reduce that wall. Laws, such as the USA PATRIOT Act, the Homeland Security Act, and the Intelligence Reform and Terrorism Prevention Act have served to eliminate undue restrictions on transfer of terrorist-related intelligence between law enforcement and the Intelligence Community. Government reorganization actions led to the creation of the Department of Homeland Security, the U.S. Northern Command, and the National Counterterrorism Center, and the establishment of the new position of Director of National Intelligence. What has not occurred, as of yet, is a review of the role Military Intelligence should have in this new construct of intelligence law and counterterrorism organization. Also, current restrictions on Military Intelligence activities within the United States can severely hamper the ability of a commander called upon to execute homeland defense or consequence management missions. A review of these restrictions is imperative. Such reviews should take place soon, in order to fully utilize the capabilities of the Military Intelligence community.
