Available in PDF, EPUB and Kindle. Book excerpt: This is a very readable book, which will be of interest to both practitioners and academics. . . From an academic point of view, the testing of theories on compliance is particularly fruitful. Here the author defines several elements that challenge and supplement the existing literature. . . The fundamental research question [of the book] is of great importance to the management of marine resources throughout the world. There is no longer any lack of international agreements. The challenge is how to implement the agreements through practical regulatory measures, and how to ensure compliance with the agreements. Here the book contributes important insights. Alf HOEkon Hoel, Nordisk stforum This book provides very detailed insights to how fisheries agreements can shape norms and set standards leading to a high degree of compliance and well-managed fisheries. It gives a very comprehensive description of the development of the management of the Barents Sea fishery since the 1990s, including an impressive account of the NorwegianRussian fisheries negotiations. Geir Hnneland provides an important contribution to and further advances our understanding on the factors influencing rule-compliance in fisheries and in fact beyond. Jesper Raakjr, Aalborg University, Denmark In Making Fishery Agreements Work, Geir Hnneland extends his reputation as a leading scholar on Norwegian/Russian fisheries relationships. His new contribution focuses on the complicated and hard to track post-bargaining processes that can be used to improve compliance over time in situations with large power differentials. Well grounded in compliance theory and common property resource management, Hnnelands interviews and personal observations capture the empirical motivations that underlie compliance in the joint Barents Sea fisheries. David Fluharty, University of Washington, US Fishing vessels plying the cold waters of the Barents Sea provide the empirical basis for this extraordinary effort to answer the question of what it takes for people and their governments to make and stick to agreements and follow the rules. Based on years of study of arrangements between Norway and the Soviet Union/Russia and interviews with the captains of the fishing ships that seek cod and other species in the far north, Hnneland brings findings and theory from many disciplines to the question. In so doing he offers a powerful argument about how post-agreement bargaining at both state and individual levels contributes to compliance and hence sustainable fisheries. Bonnie McCay, Rutgers University, US Environmental governance is not just a matter of laying down clear rules and regulations and then finding ways to enforce them. Developing the idea of post-agreement bargaining and drawing on his exceptional knowledge of the world-class fisheries of the Barents Sea, Geir Hnneland illuminates the ongoing processes of interpretation, mutual accommodation, and adjustment to changing circumstances that play an essential role in making environmental regimes work. Oran Young, University of California, Santa Barbara, US Why do people obey the law? And why do states abide by their international commitments? These are among the questions raised in this important book. The setting is the Barents Sea, home to some of the most productive fishing grounds on the planet, including the worlds largest cod stock. Norway and Russia manage these fish resources together, in what appears to be a successful exception to the rule of failed fisheries management: stocks are in good shape, institutional cooperation is expanding and takes place in a constructive atmosphere. The author argues that post-agreement bargaining helps activate norms and establish standard operating procedure that furthers precautionary fisheries management. The Barents Sea fishery is seen as one of the best-managed international fisheries in the world, and the book specifically enquires into the lessons to be learnt from the NorwegianRussian partnership. It will therefore prove to be of invaluable interest to practitioners, scholars and policy-makers working in the field of fisheries management and environmental agreements.

Book excerpt: "The European Union (EU) negotiates agreements with coastal countries to obtain fishing rights for EU vessels and to support the governance and sustainable development of the local fishing sector. The Court found that these agreements were generally well managed by the European Commission, but that some improvements were needed. The quantities of fish negotiated with the coastal countries regularly exceeded the actual use made by the EU fleet, making the agreements relatively more costly than expected for the EU. The monitoring of catch data and the licencing process was not sufficiently robust, and the support provided for the sustainable development of the local fisheries sectors needed clearer eligibility conditions, and better coordination and consistency with other EU development support."--Publisher's description.

Book Fisheries and Sustainability

Download or read book Fisheries and Sustainability written by Emma Victoria Witbooi and published by Martinus Nijhoff Publishers. This book was released on 2011-11-11 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: Marine living resources are currently under severe threat from unsustainable use. International law urges a precautionary approach in the use of remaining fish stocks, necessitating rational domestic management of coastal fisheries and requiring foreign nations accessing these stocks to cooperate to this end. The manner in which bilateral fishing relations between the EU and various West African states have historically played out, however, has not followed this route. This book is a legal study of these relations from an inter-disciplinary and contextual perspective with particular reference to sustainability questions using three broad conceptual lenses: common resource management, integration towards sustainable development and the colonial legacy to interrogate the extent to which these interactions operated as legal instruments of sustainability.

Book Fisheries and the Law in Europe

Download or read book Fisheries and the Law in Europe written by Jonatan Echebarria Fernández and published by Routledge. This book was released on 2022-02-27 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: Examining fisheries, Brexit, the Trade and Cooperation Agreement (TCA) and its consequences for the Fishing Industry in the UK and the EU, this book explores key issues within the complex topic of fisheries after Brexit. Assessing the new fishing relationship between the UK and the EU, which will continue to develop over the next decade, it provides an important study of the state of fisheries post-Brexit. Taking a cross-cutting economic, legal and policy approach, the book outlines the social and economic impacts of Brexit on the UK and EU fishing industries. It critically analyses the provisions relevant to fisheries in the TCA, reflects on the bilateral fishing negotiations between the EU, UK and Norway, providing inferences as to what the "new and special relationship" might be in fisheries. It then focuses on the 2020 Fisheries Act and explores internal divergences in the nations of the UK because of devolution. Taking an international approach, the work offers an exploration of cooperation in fisheries enforcement, international and regional obligations in marine conservation, and the new horizons for the UK in international fisheries organizations and arrangements now it is no longer a member of the EU. It offers an overview of expert opinion on fisheries post-Brexit, highlighting lessons learned and future developments for fisheries in a post-Brexit world. Having finally signed the Trade and Cooperation Agreement on 31 December 2020 after tense negotiations, the United Kingdom and European Union have found themselves in a new fisheries relationship. This book maps the complex social, economic, legal and policy issues of fisheries in a post-Brexit world and will be of interest to stakeholders and scholars.

Book Fisheries Subsidies under International Law

Download or read book Fisheries Subsidies under International Law written by Chen-Ju Chen and published by Springer Science & Business Media. This book was released on 2010-09-17 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: Subsidies to fisheries have been in existence for centuries. However, these remained outside the spotlight of the international community until the turn of this century when the negative effects that fisheries subsidies have on international trade, the environment and sustainable development became increasingly clear. As a result the Doha Round Negotiations set the parameters for an effective fisheries subsidies regime. WTO Members thus embarked in intensive negotiations with the collaboration of various international organizations. These negotiations culminated with publication of the legal text of the Chairman of the Negotiating Group on Rules in 2007 which reflects to a large extent the mandates of the Ministerial Conferences and reconciles the diverse interests of the negotiators. The EU as a major WTO Member and with its own Common Fisheries Policy which has been in effect for a number of years can serve as the basis for comparison and improvement of the proposed regulations.
