Book excerpt: Under the 1982 United Nations Convention on the Law of the Sea, coastal States have sovereign rights to explore, exploit, conserve, and manage the living resources of the 200 nautical mile exclusive economic zone (EEZ). However, 40 years after the adoption of the Convention, there is still a great deal of uncertainty about the nature and extent of these sovereign rights. Coastal State Jurisdiction over Living Resources in the Exclusive Economic Zone examines the ways in which coastal States can exercise authority on the basis of their sovereign rights over living resources in the EEZ. Dr Camille Goodman explores the key concepts of 'fishing' and 'fishing related activities' to establish what vessels and which activities can be regulated by coastal States, canvasses the criteria and conditions that coastal States can apply as part of regulating foreign access to their resources, and considers the regulation of unlicensed foreign fishing vessels in transit through the EEZ. Goodman also examines how such regulations can be enforced within the EEZ and the circumstances under which enforcement can take place beyond the EEZ following hot pursuit. To assess how the EAF is being implemented through national policy and legal frameworks, FAO developed "A diagnostic tool for implementing an ecosystem approach to fisheries through national policy and legal frameworks". This second edition of the legal report on the EAF contains a revised analysis of the extent to which the 82 EAF legal requirements, which are considered the minimum standards in legislating for the EAF, are incorporated in the United Republic of Tanzania's policy and legal instruments relevant to the fisheries sector and other relevant sectors of the country (such as environment, wildlife, ecosystems, and maritime affairs). Based on this preliminary diagnosis, gaps were identified in the assessed instruments, and recommendations were made for improving the implementation of the EAF. This second edition of the EAF Legal Report of the United Republic of Tanzania is based on the findings from two missions carried out by FAO, with support from the EAF-Nansen Programme, to the United Republic of Tanzania. The first mission was undertaken in March 2023, when the first edition of the report was presented to the government and various other stakeholders, in Dodoma, and additional information was collected. Additional information was collected in the second mission, undertaken in August 2023, when FAO supported the Ministry of Livestock and Fisheries of the United Republic of Tanzania in launching the process for the comprehensive review of the 2015 National Fisheries Policy and the 2003 Fisheries Act, as amended in 2020, from Mainland Tanzania, at a national workshop held in Morogoro. The second edition of the EAF Legal Report of the United Republic of Tanzania was endorsed by the Ministry of Livestock and Fisheries in August 2023.

To ensure that fish populations are not overexploited, the NOAA Fisheries' Marine Recreational Information Program (MRIP) monitors recreational catch through a variety of in-person, telephone, mail-in, and other surveys. NOAA Fisheries' management of recreational catch also must take into account annual catch limits (ACLs) established to prevent overfishing for all managed species in federal waters. While MRIP has worked to improve recreational catch surveys over the past decade, the surveys were never designed to meet the demands of in-season management of ACLs. In some cases, estimates of harvest have triggered accountability measures such as early season closures and reductions in future recreational ACLs, which have been a source of contention with the recreational fishing community. This report presents approaches for optimizing MRIP data and complementary data for in-season management and considers alternatives for managing recreational fisheries with ACLs to better serve both social and economic management objectives.
