Book excerpt: Parliament and the Law (Second Edition) is an edited collection of essays, supported by the UK's Study of Parliament Group, including contributions by leading constitutional lawyers, political scientists and parliamentary officials. It provides a wide-ranging overview of the ways in which the law applies to, and impacts upon, the UK Parliament, and it considers how recent changes to the UK's constitutional arrangements have affected Parliament as an institution. It includes authoritative discussion of a number of issues of topical concern, such as: the operation of parliamentary privilege, the powers of Parliament's select committees, parliamentary scrutiny, devolution, English Votes for English Laws, Members' conduct and the governance of both Houses. It also contains chapters on financial scrutiny, parliamentary sovereignty, Parliament and human rights, and the administration of justice. Aimed mainly at legal academics, practitioners, and political scientists, it will also be of interest to anyone who is curious about the many fascinating ways in which the law interacts with and influences the work, the constitutional status and the procedural arrangements of the Westminster Parliament.

Book excerpt: The publication of Parliamentary Privilege in Australia in 1966 established Enid Campbell as the country's leading scholar in the area. Now Professor Campbell has written a successor which, while drawing on parts of the earlier work, focusses on issues and problems which have arisen in recent years, particularly since the enactment of the Commonwealth Parliamentary Privileges Act 1987. Topics specifically examined in the book include - the scope of the central privilege of freedom of speech and debate in parliament; measures adopted by houses of parliaments to regulate exercise of that freedom; restrictions on the uses which may be made of evidence of what has been said and done in the course of parliamentary proceedings; immunities accorded to MPs in respect of various legal processes, such as ones which require them to appear before a court to give evidence; the powers of houses of parliaments to make inquiries and to delegate investigatory powers to committee of their members; the power of houses of parliaments to impose penalties of a criminal character and to discipline their members. This book, like its predecessor, will be the standard reference on the laws concerning the powers, privileges and immunities of Australian parliaments, their members and committees for the next generation.

Book excerpt: Parliamentary privilege ensures that Members of Parliament are able to speak freely in debates, and protects Parliament's internal affairs from interference from the courts. Following (failed) attempts by some MPs to use parliamentary privilege to avoid prosecution for expenses fraud, the Government felt the time was right for a comprehensive review of the privileges of Parliament. Freedom of speech is arguably the most important privilege: a member must be able to speak or raise a matter without fear of a criminal or civil liability. The Government does not feel it necessary to change the protection of privilege in civil cases, nor in relation to injunctions or super-injunctions. But it is open to question whether parliamentary privilege should ever prevent members being successfully prosecuted for criminal offences. The paper consults on whether privilege should be disapplied in cases of alleged criminality, though not in respect of speeches in Parliament. The second major privilege is that of exclusive cognisance: the right of each House to regulate its own proceedings and internal affairs without interference from any outside body including the courts. This includes the conduct of its Members, and of other participants such as witnesses before select committees. Recent court judgments make clear that statute law on employment, health and safety etc do apply to Parliament providing the law would not interfere with Parliament's core functions. The green paper also consults on extending and strengthening select committee powers. A final section covers other miscellaneous privileges.

Download or read book In from the Cold written by Laurence Lustgarten and published by Oxford University Press, USA. This book was released on 1994 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: Security and intelligence agencies are granted unparalleled powers, human rights are restricted, governments keep secrets from their citizens, and huge sums of public money are spent, all in the name of 'national security'. Beginning with a critical theoretical examination of 'national security' and arguing that this concept should be infused with values of democracy and human rights, the authors go on to discuss many important topics, including telephone tapping, bugging, and the collection and retention of personalinformation on file. Other issues analysed include employment vetting and security, detention and deportation, restrictions on the press, and the use of criminal law to stifle criticism. Finally, the mandate, powers, and mechanisms for executive and ministerial control of the security and intelligence agencies are scrutinized, the nearly-completed Scott Inquiry is considered, and the Intelligence Services Act 1994 is analysed in a detailed Coda. This comparative study draws upon a wide range of sources, and, uniquely, upon numerous interviews with security officials in the United Kingdom, Canada, and Australia. In From the Cold is a timely and comprehensive treatment of issues which continue to pose the greatest challenge to democratic states.

Book The Communication of Politics

Download or read book The Communication of Politics written by Ralph M. Negrine and published by SAGE. This book was released on 1996-09-24 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: How should those exercising power be made more accountable, and what roles should the mass media play in that process? Can the public monitor the exercise of power without the existence of a strong and inquisitive media? The Communication of Politics examines these and other questions vital to the debate on the media's role in the democratic process. Ralph Negrine explores the complexity of the links between the media, the institutional political world and the public through case studies drawn from contemporary British politics and other political systems including the United States. He examines some of the often overlooked problems faced by the media in its efforts to create an informed citizenry'. Questioning the practices that filter information and confronting the idea that information itself is unproblematic, Negrine shows why the essential task of uncovering truths remains elusive.

Book The History of the Times

Download or read book The History of the Times written by Graham Stewart and published by HarperCollins (UK). This book was released on 2005 with total page 758 pages. Available in PDF, EPUB and Kindle. Book excerpt: The third in a series chronicling the remarkable history of The Times newspaper and the media mogul who bought and reshaped it in the early 1980s. This volume looks at the history of one of Britain's most venerable newspapers since its takeover by Rupert Murdoch in 1981, and the many changes that took place in the turbulent years that followed. The account will encompass the media mogul's infamous clashes with the British printers' unions, culminating in 1986 with the Wapping dispute in which the power of the unions was decisively broken, with far-reaching implications for British trade unions and the media at large. Taking over from the late John Grigg, who wrote the previous two volumes in this series, Graham Stewart is a highly rated historian with a gift for depicting the complex characters who inhabit the upper echelons of power. With this book, he will provide valuable insight into the workings of one of the most controversial business leaders in the world today and the newspaper that helped shape his media empire.
