Book excerpt: This book highlights current concepts of Social Urbanism, the contemporary set of multiple and interdisciplinary urban studies that have emerged mainly from the complex realities of Latin American cities. The discussion that follows places special emphasis on public land policy and the innovative urban instruments developed in that region to promote social and territorial inclusion. Critical reflections throughout the pages of this book shed light into the local context of each case-study in order to understand their specific set of challenges and opportunities. Relevant lessons are extracted from the three cities here analyzed, the medium-scale city of Medellin, the large-scale city of Bogota, and the megacity of Sao Paulo, as well as from local innovative experiences in Argentina and Uruguay. These cities underwent promising transformation processes over two decades, applying planning and financing instruments of land policy which have produced significant shifts in the urban development paradigm in the region. The quest for social inclusion has emerged as the common denominator in these cities, awakening growing interest across several fields of urban studies, from public policies and city management to urban law, city financing, urban development, and innovative community participation processes. The book brings implications on urban land policy for transition cities in the Global South. The question of social inclusion in Global South cities is however far from being solved; the analysis presented in this book shows advances and hope, besides a long path still ahead, which can only be faced through a continuous and challenging incremental process. May this book be an incremental step.

Within planning practice and urban development, the shift towards private financing of public infrastructure has translated into new tools being implemented to provide joint responsibility for upholding requirements. Developer obligations are contributions made by property developers and landowners towards public infrastructure in exchange for decisions on land-use regulations which increase the economic value of their land. This book presents insight into the design and practical results of these obligations in different countries and their effects on municipal financial health, demonstrating the increasing importance of efficient bargaining processes and the institutional design of developer obligations in modern urban planning. Book excerpt: In 1993, José Medellín, an eighteen-year-old Mexican national who lived most of his life in the United States, was arrested for his participation in the gang rape and murder of two girls in Houston, Texas. Despite telling police that he was born in Mexico, he was never informed of his right to contact the Mexican Consulate, a right guaranteed to him by Article 36 of the Vienna Convention on Consular Relations. The Mexican government filed suit against the United States in the International Court of Justice (ICJ), which ruled that the United States had violated the rights of both Mexico and Medellín, along with fifty-one other Mexican nationals in other cases. The ICJ instructed the United States to provide “review and reconsideration” of the convictions and sentences of the fifty-two Mexican nationals. Armed with this new decision, Medellín sought a writ of habeas corpus, which was denied by the lower courts. He petitioned for a writ of certiorari, which the Supreme Court granted, twice. While President George W. Bush sided with the ICJ, the State of Texas, under Solicitor General Ted Cruz, argued against the president. Despite a nearly universal belief among court watchers and legal scholars that Texas would lose, the Court in a 6–3 decision ruled in favor of Texas and against Medellín in June 2008. Medellín was executed just two months later. In this volume Alan Mygatt-Tauber tells the story of Medellín v. Texas, showing how the Court’s 2008 ruling grappled with the complex question of how a united republic that respects the dual sovereignty of its constituent parts struggles to comply with its international obligations. But this is also a story of international human rights and the anomalous position of the United States regarding the death penalty compared to other nations. In the closing chapters, the author explores the aftermath of the execution, including the continued effort of Mexico to seek justice for its nationals. Mygatt-Tauber offers a detailed examination of the case at every stage of proceedings—trial, appeal, at the International Court of Justice, and in both trips to the Supreme Court. He provides never-before-revealed information about the thinking of the Bush White House in the decision to comply with the ICJ’s judgment and to withdraw from the Optional Protocol to the Vienna Convention that granted the ICJ jurisdiction.

We assume that this elasticity varies across geographical areas. We estimate different specifications of Spatial Panel Models using information of urban areas in Medellin (Colombia), areas known as communes. Spatial Models consider the importance of location and the type of neighbors of each commune. We simulate an intervention over permanent income in order to estimate the income elasticity for each commune and the average elasticity of income-crime on the city. We provide evidence about spatial dependence between the homicides per commune and their neighbors, and about a relationship between homicides and neighbor's income. In our case of study, the average estimated impact of 1% increase in permanent income in a specific commune produces a decrease in the homicide rate on average in 0.39%. Finally, permanent income plays a crime deterrent role, but also this effect of income on crime varies across the city, showing that some areas are strategically located to this kind of intervention.
