They are likely to deliver commitments and rules, which go significantly beyond the GATS package negotiated over two decades ago – and to extend their umbrella to a greater range of countries. In addition, the level of market access commitments ultimately incorporated into TiSA will set a new benchmark and reference point for future EU FTA negotiations. Depending on the outcome of remaining negotiations, the TiSA may also establish influential new and consolidated texts on such matters as data transfer, forced localisation, source code, regulatory transparency, and domestic regulation.

Paragraph 2(a) of the GATS Annex on Financial Services is generally known as the Prudential Carve-Out (PCO). Notwithstanding GATS obligations, it allows WTO Members to pursue prudential regulatory objectives. This book studies the GATS PCO in light of its negotiating history and economic rationale as well as PCOs in all preferential trade agreements notified to the WTO Secretariat up to the summer of 2017. The author clarifies the state of play of international cooperation on financial services regulation; provides a current understanding of the GATS PCO; analyses how PCOs are drafted in preferential trade agreements and, finally, he seeks to understand whether alternative approaches to the mainstream understanding of the PCO are possible and suggests options for reform.

ASEAN aspires to deepen integration in the services sector in order to enhance the sector's contribution to economic development and growth in each country. Despite this, services liberalization has progressed slowly compared to goods liberalization both at the multilateral and the regional levels. Different regulatory mechanisms across countries have contributed to the slow pace of liberalization. Logistics is an important industry in the services sector. The integration of logistics is important for deepening economic integration in ASEAN as it facilitates the movement of goods, services and people within and across countries, among producers and from producers to consumers. In view of its importance, ASEAN has identified logistics as one of its priority integration sectors. It has also developed a Connectivity Master Plan and a Strategic Transport Plan, where logistics plays an important role. This book examines the current state of services liberalization in the ten ASEAN economies. It also assesses the FDI enabling environment and the extent of FDI liberalization in the logistics sector as well as the liberalization challenges encountered in each of the ASEAN economies. The book, thus, provides a comparative picture of services liberalization as well as the state of logistics liberalization and development in each of the ten ASEAN member countries. The exact scope of regulatory flexibility is often unclear and, at times, flexibility may be counterproductive to sustainable economic growth in developing countries. Undisputedly, developing countries would have some flexibility with respect to tailoring preferential services trade agreements to their individual economic needs and circumstances, but empirical data from over 280 preferential services trade agreements worldwide shows that this flexibility is rarely used. This volume clarifies the regulatory scope of flexibility for preferential services trade agreements between developing countries by linking the legal interpretation of WTO law with evidence from research in economics and political sciences. The book suggests that the current regulatory framework leaves room for meaningful flexibility for developing countries, and encourages policymakers and scholars to take these flexibilities into consideration in their design and study of trade policies.
