This book was released on 2022-06-17 with total page 49 pages. Available in PDF, EPUB and Kindle. Book excerpt: The implementation of a twin peaks model represents a significant change to the South African financial supervisory architecture. The Prudential Authority (PA), operating within the administration of the South African Reserve Bank (SARB), is responsible for promoting and enhancing the safety and soundness of financial institutions that provide financial products and securities services. A separate authority, the Financial Sector Conduct Authority2 (FSCA), is responsible for market conduct regulation and supervision. The introduction of the twin peaks architecture was motivated by a need to increase the robustness of the financial sector regulatory and supervisory system, reinforce financial stability, improve protection of customers, and enhance cooperation among the regulators.

Book excerpt: This Technical Note discusses recommendations made during the Financial Sector Assessment Program (FSAP) for South Africa in the areas of contingency planning, crisis management, and bank resolution. The proposed scope of the new resolution regime and of the South African Reserve Bank’s (SARB) jurisdiction as the resolution authority remains unclear. It is suggested that authorities should consider focusing on all deposit-taking institutions and only those other financial institutions that are currently deemed systemic. Non-deposit-taking financial institutions that are not found to be systemic should be resolved by the Prudential Authority or the Market Conduct Authority, whichever is the lead regulator.

Book Banking Regulation in Africa

Download or read book Banking Regulation in Africa written by Folashade Adeyemo and published by Routledge. This book was released on 2021-12-28 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is little literature on the development of banking regulation in Nigeria, or the scope of powers of the Central Bank of Nigeria, which is its core banking sector regulator. The critical impetus of this book is to contribute to the literature of this area, with a detailed exploration of the Nigerian regulatory architecture. In addition, the book also engages in a comparative analysis with two emerging economies in Africa: South Africa and Kenya. It also considers the UK and the US as comparator jurisdictions in light of their regulatory responses to the global financial crisis of 2008. This book contributes to the ongoing discourse in this area by exploring, in detail, the theoretical underpinnings of regulation and supervision, to determine whether there is an understanding of what constitutes effective regulation in these jurisdictions. Given that Nigeria is the core jurisdictional focus, a historical account of banking exchanges from the pre-colonial era to more recent times is provided. Offering an understanding of how political, local and economic settings, in conjunction with the theories of regulation, have impacted and influenced regulatory development in Nigeria, the book engages in an examination of Nigeria’s historical experiences with bank failures, including the banking crisis it experienced in 2008. The newly enacted Banks and Other Financial Institutions Act 2020 is also explored as part of this discourse. Through a critical analysis of the law, the book demonstrates that the Nigerian regulator has historically adopted a reactionary strategy, instead of a proactive and pragmatic approach, which is imperative for an effective regulatory regime. The outcome of this analysis is that there are lessons to be learned, and proposals are discussed in order to rethink the act of banking regulation.

Book Financial Regulation in Africa

Download or read book Financial Regulation in Africa written by Iwa Salami and published by Routledge. This book was released on 2016-04-15 with total page 177 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the wake of the global financial crisis, there has been a worldwide search for alternative investment opportunities, away from advanced markets. The African continent is now one of the fastest-growing economic regions in the world and represents a viable destination for foreign direct and portfolio investment. This book, which is the first comprehensive analysis of financial integration and regulation in Africa, fills a huge gap in the literature on financial regulation and would constitute an invaluable source of information to policy makers, investors, researchers and students of financial regulation from an emerging and frontier markets perspective. It considers how financial integration can facilitate African financial markets to achieve their full potential and provides a comparative study with the EU framework for financial integration and regulation. It assesses the implementation of effective and regional domestic infrastructures and how these can be adapted to suit the African context. The book also provides an assessment of government policies towards the integration of financial regulation in keeping with the regional agenda of the African Union (AU) and the African Economic Community (AEC).

Book An Appraisal of the Twin Peaks Model of Financial Regulation in South Africa

Download or read book An Appraisal of the Twin Peaks Model of Financial Regulation in South Africa written by Shaynel Praful Joshi and published by . This book was released on 2019 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2008 Global Financial Crisis proved to be a landmark event in the context of financial regulation to the extent that it gave rise to questions of which approach would best suit financial regulation in the pursuit of financial stability. As such the question followed whether there should be a single mega regulator covering all the basis of financial regulation and supervision or whether the mandate should be covered by different institutions of which the central bank should be part thereof. It was within this context that the Twin Peak model attracted the attention of the South African national treasury as a regulatory approach to follow which would serve South Africa better on the whole. This dissertation investigates this model as the way forward having enacted the Financial Sector Regulation Act to give effect to it. The purpose of this dissertation is to consider the specific Twin Peaks model adopted as the new approach to financial regulation in South Africa. The main components of this model will be interrogated in order to determine whether this model is an appropriate regulatory model that caters for the main aspects of financial regulation. This includes the promotion and maintenance of financial stability, safety and soundness of financial institutions and appropriate business conduct regulation. It will be shown that that through this model South Africa has augmented its approach to financial regulation to the South African Reserve Bank as the central bank through an advanced and pronounced financial stability mandate via the legislative framework of the Financial Sector Regulation Act that will enable the efficient execution of this mandate. The dissertation will also delve into a comparative investigation which will focus on the Twin Peaks model which was first pioneered in Australia in 1998 to comparatively benchmark the South African model. The lessons learnt from the failure of the model to work efficiently in Australia will also be discussed. The dissertation is concluded with recommendations for the effective implementation of Twin Peaks in South Africa.

Book Banking Regulatory and Market Framework in South Africa

Download or read book Banking Regulatory and Market Framework in South Africa written by Tankiso Moloi and published by . This book was released on 2014 with total page 30 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper examined and discusses banking regulation and market framework in the South African context. In South Africa, the principal legal instrument which seeks to achieve credibility, stability and economic growth, is the Banks Act, No. 94 of 1990 (the Banks Act). Further, South Africa has 17 registered banks, two mutual banks, 12 Branches of international banks in the Republic of South Africa, 43 representative offices and 15 controlling companies. The dominant banks in the South African banking landscape where outlined as the Standard Bank of South Africa, ABSA Bank, FirstRand Bank and Nedbank. It was observed that the reason for the increased market share by the big four banks in South Africa was seen as caused by the decline of confidence levels in the small banks as a result of Saambou's Bank failure. Due to the dominance of four banks, using the HHI it was exhibited that the level of concentration in the South African banking sector was high at 0.187 in 2011. This paper concluded that South Africa has a developed and well regulated banking system which compares favourably with regulatory environment applied by the developed countries. However, it was cautioned that further regulation such as the recently announced 'Twin Peaks' approach to financial regulation could result in unintended consequences, such as driving a larger share of activity into the shadow banking sector.

Book Bank Credit Extension and Real Economic Activity in South Africa

Download or read book Bank Credit Extension and Real Economic Activity in South Africa written by Nombulelo Gumata and published by Springer. This book was released on 2017-03-13 with total page 612 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents empirical evidence that supports and facilitates a practical, integrated approach to how bank regulatory and selected macro-prudential tools interact with monetary policy to achieve price and financial stability. The empirical results contained in various chapters accompany in-depth historical analysis and counterfactual scenarios that enable proper policy evaluation and the interaction of bank regulatory, macro-prudential and monetary policy tools in South Africa. The presented evidence also identifies financial asset boom and bust episodes and the associated costly output losses. In addition, the authors explore the amplification of credit dynamics by commodity prices and sector credit re-allocation due to capital inflows shocks. The book’s empirical analysis uses a wide range of statistical and econometric approaches on granular data and economic variables to derive policy implications and recommendations. This in-depth quantitative analysis includes determining inverse transmission of global liquidity, as well as the effects of capital flows, lending-rate margins, financial regulatory uncertainty, the National Credit Act, bank capital-adequacy ratios, bank loan loss provisions, loan-to-value ratios and repayment-to-income ratios on the macro-economy.

Book excerpt: This paper discusses the Financial System Stability Assessment for South Africa, and reviews the Report on the Observance of Standards and Codes on Securities Regulation. The assessment reveals that South Africa’s sophisticated financial system is fundamentally sound and has so far weathered the global financial market turmoil without major pressures. Banks and insurance companies have enjoyed good profitability, capitalization levels, and reserves. The financial sector regulatory framework is modern and generally effective. Stress tests suggest that capital and reserve cushions at banks and insurance companies are sufficient to absorb large shocks.

Book Market Abuse Regulation in South Africa the United States of America and the United Kingdom

Download or read book Market Abuse Regulation in South Africa the United States of America and the United Kingdom written by Howard Chitimira and published by Vernon Press. This book was released on 2018-05-15 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a concise comparison of the regulation and enforcement of the anti-market abuse laws (insider trading and market manipulation) in South Africa, the United States of America (USA) and United Kingdom (UK). Bringing together a number of previously published articles, the book provides a novel discussion of the challenges associated with the enforcement of market abuse laws in both developing countries such as South Africa and developed ones such as the USA and the UK. This is primarily done to examine and expose the current strengths and weaknesses of market abuse laws in relation to certain aspects of the corporate, securities and financial markets environments in South Africa, the USA and the UK. Accordingly, chapters two to five of the book unpack the regulation and enforcement of market abuse laws in South Africa and the USA in a comparative perspective. Thereafter, chapters six to eight of the book discuss the regulation and enforcement of market abuse laws (Financial Markets Act 19 of 2012) and other related statutes in South Africa and the UK. The book proposes some measures that could be utilised to enhance the enforcement of anti-market laws in South Africa, USA and the UK. New market abuse-related challenges that occurred during the global financial crisis are also briefly discussed. The book further provides a relatively adequate overview of the comparative analysis of the regulation of market abuse in South Africa versus two key developed and respected jurisdictions, namely, the USA and the UK. Accordingly, it is hoped that the book can aid regulatory authorities, financial market participants, academics, students and other interested readers to understand market abuse offences and possible measures that could be employed to combat such offences.

The National Treasury has authority to set and oversee national regulatory policy. Banking supervision is effective and has contributed to reducing the impact on the financial sector of the global financial crisis. Insurance regulation is sound and while the assessment identifies areas for development, these are being addressed.
