The book commences with an introduction of the concept of mens rea and controversies concerning this concept before national courts and ad hoc tribunals. This is followed by an examination of the definitional elements of mens rea at the ad hoc tribunals. The mens rea requirements for the specific liability modes applied at the ad hoc tribunals will be examined. Subsequently, definitional aspects of mens rea at the ICC will be discussed, and in particular the mens rea requirements for the specific liability modes as provided for in the Rome Statute. Separate chapters will address the mens rea requirements for the crimes listed in the Rome Statute: war crimes, genocide, crimes against humanity and the crime of aggression, respectively. An analysis of customary international law or the standards promulgated by the ad hoc tribunals will be used as examples where the ICC case law is scarce. A specific chapter will be devoted to mens rea requirements for political speeches. In some cases, certain speeches have been said to be catalysts of international crimes. Therefore, it is relevant to examine how the accused’s intent was construed. The book will conclude with mens rea defenses in international criminal law, which will be specifically applied to the defenses listed in the Rome Statute.

Reviewing the development of blockade law over the past four centuries, The Law of Maritime Blockade provides a historical analysis of the law as it emerged, tracing its evolution through armed conflicts between 1684 and the present. Referring to the starvation caused by the blockade of Germany during World War I and the humanitarian crisis caused by the sanctions regime against Iraq (1991-2003), this book demonstrates that blockade can have extremely deleterious effects for vulnerable civilian populations. In this context the current law of blockade is examined, and found to be deficient in terms of its protection for civilians. Recognizing and advocating that blockade should remain as a valid and effective method of warfare, the book offers a template for a modern law of maritime blockade that incorporates many of the traditional aspects of the law, while reducing the possibilities that blockades can cause or exacerbate humanitarian disasters.

Book excerpt: How military commanders interpret the rules of targeting impacts not only on whether civilians and civilian objects are harmed in the course of a military operation, but also on the scale of harm that ensues. Commentators have queried whether military commanders observed the law even when parties to a conflict acted in accordance with mandates to protect civilians, as was the case when a coalition of states bombed targets in Libya in 2011. However, limited guidance is publicly available on how military commanders apply these rules on the battlefield. In order to allow military commanders to exercise judgment in determining what steps they are required to take to spare civilians in a specific set of circumstances, the rules of targeting are formulated in an open-ended fashion, which complicates one’s ability to evaluate whether a particular military operation complies with the law. By examining case studies ranging from Operation Desert Storm in 1991 to Operation Protective Edge in 2014, this book addresses lacunae in current scholarship. It puts forward principles which capture how military commanders deliberate while interpreting what the rules of targeting require in particular scenarios. International humanitarian law, this book contends, places a duty on attackers to assume risk in order to mitigate danger to civilians. Drawing on the field of psychology, this study provides an explanation of how military commanders assess when circumstances do not permit them to inform civilians about a forthcoming attack.

Book excerpt: In spite of the Geneva and The Hague Conventions of the late 19th century, the Twentieth Century has been a century of massacres and genocides: the massacres due to European colonialism, two World Wars, the Holocaust, the Armenian and the Rwanda genocides, the casualties caused by the Communist utopia in the USSR, China and Cambodia, and numerous civil wars. Most of the leaders mainly responsible for these massacres and genocides have enjoyed impunity. However, there is a slow popular awakening to the fact that leaders should be accountable for their crimes. A human rights regime was created after World War II, international criminal law has taken root with the Nuremberg and Tokyo Tribunals, and, in the 1990's with the International Criminal Tribunals for the Former Yugoslavia and for Rwanda. In 1998, the Statute for an International Criminal Court was adopted, while the arrest of former dictator Pinochet in London has created both a political storm and a judiciary advance. The "Princeton Principles on Universal Jurisdiction" have been publicized in an effort to strengthen the application of international law in national legal systems. In Cambodia and Sierra Leone, mixed national/international courts are being set up to try criminal leaders. This unique volume offers the reader an overview of the various models which are emerging to ensure that criminal leaders and their collaborators are made accountable for their schemes and actions, and clearly illustrates how national, international and mixed national/international tribunals are slowly eroding the impunity of criminal leaders.
