Book Family Justice Review

  • Author : Family Justice Review
  • Publisher : The Stationery Office
  • Release : 2011-04
  • ISBN : 9780108510557
  • Pages : 234 pages

Download or read book Family Justice Review written by Family Justice Review and published by The Stationery Office. This book was released on 2011-04 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: The legal framework of family justice in England and Wales is strong. Its principles are right, in particular the starting point that the welfare of children must be paramount. Every year 500,000 parents and children are involved in the system. But the system is under great strain: cases take far too long (the average case took 53 weeks in 2010); too many private law disputes end up in court; the system lacks coherence; there is growing mistrust leading to layers of checking and scrutiny; little mutual learning or feedback; a worrying lack of IT and management information. The Review's recommendations aim: to bring greater coherence through organisational change and better management; making the system more able to cope with current and future pressures; to reduce duplication of scrutiny to the appropriate level; and to divert more issues away from the courts. The chapters of the review cover: the current system; the proposed Family Justice Service; public law; private law; financial implications and implementation; and there are eighteen annexes. The proposals are now out for consultation, with the final report due in autumn 2011.

Book The Violence of Incarceration

Download or read book The Violence of Incarceration written by Phil Scraton and published by Taylor & Francis. This book was released on 2023-04-21 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conceived in the immediate aftermath of the humiliations and killings of prisoners in Afghanistan and Iraq, of the suicides and hunger strikes at Guantanamo Bay and of the disappearances of detainees through extraordinary rendition, this book explores the connections between these shameful events and the inhumanity and degradation of domestic prisons within the 'allied' states, including the USA, Canada, Australia, the UK and Ireland. The central theme is that the revelations of extreme brutality perpetrated by allied soldiers represent the inevitable end-product of domestic incarceration predicated on the use of extreme violence including lethal force. Exposing as fiction the claim to the political moral high ground made by western liberal democracies is critical because such claims animate and legitimate global actions such as the 'war on terror' and the indefinite detention of tens of thousands of people by the United States which accompanies it. The myth of moral virtue works to hide, silence, minimize and deny the brutal continuing history of violence and incarceration both within western countries and undertaken on behalf of western states beyond their national borders.

Book Child Rights in India

Download or read book Child Rights in India written by Asha Bajpai and published by Oxford University Press. This book was released on 2018-02-15 with total page 990 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legislation is one of the most important tools for empowering children. It reflects the commitment of the state to promote an ideal and progressive value system. Recent years have seen several key developments in the law, policy, and practice related to child rights. Significantly, with the adoption of the United Nations Convention on the Rights of the Child in 1989, a rights-based approach has acquired prominence in the child rights discourse across the world. The book analyses the laws in the light of court judgments and policy initiatives taken in India. It also examines the interventions and strategies employed by non-governmental organizations in recommending legislative reforms in support of children. This fully revised third edition focuses on the new legal developments in India—such as the Juvenile Justice (Care and Protection of Children) Act, 2015; the new Central Adoption Resource Agency guidelines; the Right of Children to Free and Compulsory Education Act, 2009; and the National Food Security Act, 2013—thus attempting to integrate the law in theory and field practice.
